COMMON AUCTION CONDITIONS OF SALE AND SPECIAL CONDITIONS OF SALE The sale of each property is subjected to our Conditions of Sale, which are available from each vendor’s solicitor. You should read the aforementioned Conditions of Sale carefully before bidding at auction. ADDENDUM In the event of there being alterations to the Particulars of Sale or the General or Special Conditions of Sale, a printed notice will be available prior to the auction. This addendum will be attached to the Sale Contract and forms part of the Contract. It is vital that you obtain a copy of the addendum before bidding. THE PARTICULARS All particulars contained in this catalogue have been compiled using information supplied by the vendor’s solicitor. For each property every effort has been made by us to check and verify the information supplied. If subsequent amendment is necessary this will be included in an addendum, which will be available on the day at the auction. CONDITIONS OF SALE   The Documents of Title are available for inspection; arrangements may be made by contacting each vendor’s solicitor. The purchaser shall be deemed to purchase with full knowledge of the conditions of title.  

A binding contract is entered into on the fall of the Auctioneer’s hammer to the successful bidder.

 

The successful bidder will be required to sign the Contract and pay to the vendor’s solicitor a 10% deposit before leaving the auction hall.

 

The Auctioneer has authority to sign on behalf of both the successful bidder and the vendor if necessary.

 

Completion shall take place on the 31 October 2014, on which date the balance purchase monies must be paid.

 

Bids may not be made subject to finance and each bidder must be in a position to pay the deposit at the auction and to pay the balance purchase monies on the completion.

AUCTION GUIDE SELLERS STEP BY STEP AUCTION GUIDE 1. Contact a member on the Tim Martin and Company auction team for an appraisal of your property. 2. If possible, please provide a photograph(s), tenure, tenancy details, location and site plan. Please provide any further additional information such as planning permission approval paperwork. 3. Subject to receipt of the above information and a site inspection, Tim Martin and Company will advise you whether they think your property is suitable for sale by auction. If not, then an alternative method of sale will be suggested. 4. A guide sale price will be discussed and agreed with the vendor. 5. Once the parties agree that a property will be entered into the auction, terms of engagement will be completed between Tim Martin and Company and the vendor. This agreement will outline Tim Martin and Company’s commission fee and also all associated marketing costs. 6. Tim Martin and Company will prepare draft sale particulars and catalogue entry paperwork for approval. Simultaneously, the vendor will instruct their solicitor to prepare a legal pack. The legal pack will outline the conditions of sale, title documents, lease (if appropriate), searches and planning documentation. 7. Tim Martin and Company will coordinate viewings of your property prior to the auction. 8. Prior to the auction day a reserve price will be agreed between the parties. 9. Should the property be sold at auction (i.e. it reaches the agreed reserve price) then the successful purchaser will sign the completed sale memorandum and pay a 10% deposit. 10. Completion of sale will occur on 31 October 2014 BUYERS STEP BY STEP AUCTION GUIDE 1. View the properties by requesting an auction catalogue or via Tim Martin and Company’s website www.timmartin.co.uk which will provide marketing details for each lot. 2. Identify a lot or lots that may be of interest to you. 3. View the property or properties that may be of interest by contacting Tim Martin and Company. 4. Contact Tim Martin and Company’s auction team to register your interest(s). Some properties maybe sold or withdrawn prior to the auction day. Please note offers for any of the properties can be submitted to Tim Martin and Company up to the day of the auction day. If an offer is agreed prior to the auction, you will need to be in a position to exchange contracts and pay a 10% deposit before the day of the auction. 5. Request a legal pack from the vendor’s solicitor. The legal pack will contain the conditions of sale, title deeds, leases, searches, replies to pre contact enquires. 6. Arrange for a survey of the subject property of you desire. 7. Arrange your finance as you are required to pay a deposit on the day and completion of legal formalities on 31 October 2014. If you require a mortgage it is important that you obtain a mortgage offer from your lender before the auction day. On the day of auction, request an order of sale and an addendum (if appropriate). These will contain any final changes to the details of the lot information. Register your interest at the appropriate Tim Martin and Company desk and receive your bidding number. 9. If you are a successful bidder for a particular lot, a member of the Tim Martin and Company auction team will direct you to the Contract table. At this point you will be required to sign and exchange unconditional contracts and pay a deposit of 10% of the purchase price. Completion of the sale will be on 31 October 2014. 10. If you are a successful bidder you will be required to provide 2 forms of identification to include photo identify i.e. driving licence or passport and proof of address i.e. utility bill or bank statement. 11. Please note that a binding unconditional contract is entered into upon the fall of the auctioneers hammer to the successful bidder and it may be the case that the successful bidder is liable for the property’s insurance from exchange and not completion. THE AUCTION DAY VENUE The auction will commence at 12 noon on Friday 19th September 2014, in The Auction Room, Tim Martin and Company, 27 Castle Street Comber.

AUCTIONEER’S ANNOUNCEMENTS You should arrive at the auction promptly, in order to hear the preliminary addendum remarks and announcements made by the auctioneer, as these may affect the property you wish to purchase.

AMENDMENTS ON THE AUCTION DAY The vendor or the vendor’s representatives may make amendments up until the time of the auction and therefore we would strongly recommend that you contact us before the sale to check if there is an addendum, and whether the property has been withdrawn or sold prior.

PROCEDURE AT THE AUCTION If you are intending to bid, please make your bids clearly and in plenty of time. If you are the highest bidder, on the fall of the auctioneer’s gavel, you will be under a binding contract to purchase the property. You will be presented with a Purchaser’s Card by one of the auctioneer’s clerks, which you should complete with your name and address and the name and address of your solicitors. This information will be used by us to complete the memorandum of sale, which is contained at the back of the catalogue. As soon as possible after completing the Purchaser’s Card and prior to leaving the auction room, you should make your way to the Contract Table in the auction room and sign and exchange contracts and at the same time provide a cheque for 10% of the purchase price.

DEPOSIT MONIES Unless otherwise specified, cheques should be made payable to the vendor’s solicitor, drawn on a UK clearing back and be for 10% of the purchase price. We do not accept cash unless prior arrangements have been made. All cheques are specifically cleared as soon as possible and therefore you should ensure that you have adequate funds in your account.

VALUE ADDED TAX VAT may be chargeable on the purchase price. It is advisable to check with the vendor’s solicitor prior to the auction.

INSURANCE Once the gavel falls, the buyer is usually responsible for the insurance of the property. Please make the necessary arrangements prior to sale.

QUESTIONS The auctioneers will not be in a position to answer questions for the duration of the auction.

LOT 1 Comprises of lands contained in folio 6367 Co Down extending to 25.9 acres as outlined in the attached map, former dwelling and range of agricultural lands. The dwelling, situated on an elevated position enjoying extensive views in all directions over the surrounding countryside, provides a possibility (subject to planning) for a replacement dwelling.
