6 Poole Hill, Bournemouth, BH2 5PS United Kingdom Tel: 01202296400 Email: [email protected] Web: www.bournemouthbeaches.com Company reg: 6074826 VAT reg: 983027215 TERMS AND CONDITIONS Reservations of all accommodation whether made by telephone, fax, in person, in writing or from the Internet are accepted by Bournemouth Beaches Limited hereinafter referred to as BBL on the following conditions:   1.                  CONTRACT OF HIRE The hiring contract will be between you the Hirer and the Owner of the property for which the booking is made and shall be deemed to be made subject to these Conditions of Hire. BBL act only as Agents for owners, and are not Principals. The Contract of Hire is not effective until BBL despatches to the Hirer written confirmation of the booking. The contract is for the hire of the property for holiday purposes only. The Hirer acknowledges that the tenancy does not create an assured tenancy. We do not accept bookings from Hirers less than 18 years of age. 2.             INITIAL PAYMENT All bookings shall require an Initial Deposit to be paid. Such Initial Deposit will be specified by BBL upon booking. Bookings will be confirmed upon receipt by BBL of the required deposit payment. If the holiday commencement date is within 6 weeks of the booking date, the full accommodation rental will be required.   3.             BALANCE PAYMENT   Where the Hirer has only paid an Initial Deposit on the Booking Date, the remaining balance shall be payable not less than 6 weeks before the Holiday Commencement Date. The Owner/BBL reserve the right to cancel a holiday where full payment has not been received less than 42 days before the Holiday Commencement Date. The Initial Deposit paid on the booking is non-refundable (except where provided in the terms and conditions).   4.            SECURITY DEPOSITS The Owner/BBL reserve the right to request payment of a Security Deposit should it be deemed necessary.   Any Security Deposit charged by the owner and administered by the owner themselves or by BBL will be cashed before the Holiday Commencement Date and reimbursed promptly after the holiday (less charges which have been incurred). BE AWARE:  Where a Security Deposit is not charged you authorise BBL to charge your credit/debit card for any excess as deemed appropriate and arising from any accident damage, wear tear, excessive cleaning costs etc, this charge will be made after your holiday and without any notice to you.   5.      CREDIT/DEBIT CARDS   Where a Hirer wishes to use a credit/debit card in respect of either the Initial Deposit or payment of the balance, BBL reserves the right to levy a charge for such payments.   Whether you pay by credit/debit card or not, when making a booking an agent will ask you for your credit/debit card details to confirm the booking. This card will be used to levy charges should a Security Deposit not be taken or where charges exceed the amount of the Security Deposit.     6.            VALUE ADDED TAX

  Where VAT applies to the property rental, it is included in the quoted price at the rate of the time of printing i.e. 20%. All VAT inclusive rentals are subject to change if the rate changes. BBL Confirmation of Booking is not a VAT invoice.   7.            CONFIRMATION OF BOOKING   Once BBL has issued a Confirmation of Booking, the Hirer is responsible for the total published price of the Property and extras as shown on the confirmation.   8.            BOOKING CANCELLATION AND AMENDMENTS

  In the event of cancellation or amendments of your booking, BBL is entitled to charge you as follows:  a)      Cancellation 43 days or more before the Holiday Commencement Date deposits will be refunded however a cancellation fee of £30 will incur and will be deducted from the Initial Deposit; b)      Cancellation between 29 and 42 days before the Holiday Commencement Date BBL shall retain the Initial Deposit; c)       Cancellation 28 or less days before the Holiday Commencement Date BBL/Owner shall retain the Initial Deposit and reserve the right to levy a charge on for the remaining balance in full.  d)   In the event you need to amend dates of your stay or wish to change property a £18 fee will incur   9.             AMENITIES   The use of accommodation and amenities, where offered, such as swimming pools, rowing boats etc. is entirely at the users' risk, and the Owner/BBL limit their liability for injury, or loss or damage to user's or visitors' belongings to the fullest extend permitted by law. However, the Owner/BBL do not seek to exclude or limit legal liability for the negligence of their servants or agents.   10.         PARTY NUMBERS   In no circumstances may more than the maximum numbers of persons, as stated on the website, occupy a Property. BBL will only accept bookings from families, single professionals and couples. The Owner/BBL reserve the right to refuse admittance if this condition is not observed. In addition, the Owner/BBL reserve the right to refuse or revoke any bookings from parties that may in their opinion (and at their discretion) be unsuitable for the Property concerned and no monies paid will be return to the Hirer.     11.         HIRER'S RESPONSIBILITIES   The Hirer agrees that in occupying the Property he/she ensure that all other guests:  a)      will not make any alterations to the Property or any of the contents, whether internal or external; b)      will not deface or damage the Property or any of the contents in any manner whatsoever; c)       will ensure that at all times the Property is kept reasonably clean; d)      will ensure that all contents remain at the Property at the end of the tenancy; e)      will ensure that no smoking shall be allowed at the Property, other than outside (such associated refuse from smoking to be removed by the Tenant at the end of the Tenancy), except where expressly allowed by BBL/Owner; f)        will not allow any pets at the Property, except where expressly allowed by BBL/Owner; g)      no advertising shall be displayed from any part of the Property, whether internal or external; h)      will not do anything in connection with the use of the Property that shall be considered a nuisance to any adjourning Property and shall not cause any damage to such Property; i)        will not play music at a level which can be heard from outside the Property between the hours of 9.00am and 10.00pm and shall only play music at all other times as considered reasonable in the circumstances; j)        will not use the property for any illegal or immoral purpose; k)      shall not allow assign or underlet the Property or to allow sharing of occupation; l)        will ensure that at the end of the Tenancy, the Property is reasonably clean and tidy.   Should BBL/Owner incur any cost in respect of the Hirers breach of any of the above, BBL/Owner reserves the right to deduct such cost from the Hirers Security Deposit or to charge the cost to the Hirers credit/debit card.   12.          DAMAGE All damages and breakages are the legal responsibility of the Hirer and should be notified to the Owner/BBL or Key holder before the end of your holiday. Whilst minor damage or breakages will not normally be charged, in circumstances where extra cleaning is required or there has been breakage or damage beyond what is reasonably expected, the Owner/BBL reserve the right to charge your credit/debit card (unless payment is made directly to the Owner/BBL when sales receipt is issued to the Hirer) for the cost of cleaning or replacement and any additional costs incurred as a consequence and may, at their discretion, refuse future bookings. 

Where the works have been carried out by a third party we charge 10% plus VAT of the total value of the invoice in addition to a management fee of £15 plus VAT will be charged. Where works are carried out by Bournemouth Beaches directly (including source purchase and deliver of goods) a £15 fee per purchase per receipt will be applied for items up to £150.00 and 10% handling fee of the value of the items above £150.00 or hourly rate of £15.00 per hour (all subject to VAT).   13.         LITERATURE AND WEB DETAILS The Owner/BBL take every care to ensure the accuracy of the Property descriptions. All information on the BBL website is given in good faith and is believed to be correct at the time of going to press, but the Owner/BBL cannot be held responsible for changes beyond its control, which may become known after publication of this literature. In addition, whilst properties may be described as non-smoking or no pets, this cannot be guaranteed. The Owner/BBL's description of a Property shows the amenities available at that Property, but generally does not state what is not available. Please be aware that if a Property is advertised as having an enclosed garden, this does not necessarily mean a secure garden. It may be enclosed by hedging or open style fencing.  Further, the Owner/BBL will not be liable to you, any member of your party or person visiting the property during the period of your hire of it for happenings outside its reasonable control, such as breakdown of domestic appliances, plumbing, wiring, temporary invasion of pests, damage resulting from exceptional weather conditions or other unforeseeable circumstance. You also accept that BBL, in acting as agent for the Owner will not in any way be liable for any negligence on the part of the Owner resulting in loss, injury or accident.   Guests and their visitors should be advised that some service and or facilities may be changed at the owners or agents discretion or as operational needs dictate. For instance where garden areas may state BBQ then this should be interpreted as either BBQ on site or suitable for BBQ. Swimming pools are not attended by life guards and are therefore used by guests and visitors at their own risk. We always advise guests that the property descriptions given are as a useful guide and if you have a specific requirement or question this should be directed to our sales staff to clarify. Photos are updated regularly but the owner reserves the right to change fixtures or furnishings without notification. Please note that when booking a property you are charged for accommodation not services or specific facilities. Some services or facilities are complimentary and in the event of a complimentary service failing or not being available Bournemouth Beaches cannot be held responsible or provide compensation. Where properties are described as being suitable for children this should be understood as the landlord advising that there are no overwhelming dangers or elements to the property that make it prohibitive for children. It should be understood that all properties contain potential dangers to persons of all ages if reasonable care is not taken or misuse is applied. BBL enters into a contract of letting with guests on the understanding that children will be supervised at all times and that sufficient care and support arrangements will be made by the guests for any special needs required by any of their party.   14.         LEGAL In the event of any disputes arising between parties it shall be referred to the jurisdiction of the English courts only and any actions shall be heard in the court for the area in which the Property is situated. Any contract shall be governed by English law and interpretation. Any disputes arising between BBL and the Hirers, if not mutually resolved, can be referred to a single arbitrator agreed, or in the default of such agreement, to the President for the time being of the Law Society or Institute of Arbitrators. In either case, such arbitration would be subject to the provisions of the Arbitration Act of 1996 or any statutory modification thereof for the time being in force. All parties will contribute equally to the cost of Arbitration.   15.          AVAILABILITY The Hiring Contract is made on the understanding that the Property and its facilities as published will be available for the dates stated. In the unlikely event that a property is not available through events arising outside the control of BBL, then BBL may be forced to cancel the booking. The Hirer will be advised as early as possible. Where possible, The Hirer will be offered suitable alternative accommodation, which, if not acceptable, will entitle the Hirer to a refund of all monies due. The Hirer will not as a result have any further claims against BBL or the owner. Please note that reservation requests taken via our website are not confirmed bookings until we have contacted you and/or accepted a payment.   16.       COMPLAINTS   We hope you have a very pleasant stay with us. Our staff members work hard to ensure that everything is correct and that we serve our customers to a high standard. If you have a complaint please call our office during office hours and speak to a member of the sales staff who will do their best to help. Please be advised that the 'out of hours' number is for urgent maintenance issues only. The number is manned by a third party contractor who does not have access to our booking system or client data base. We want to do whatever we can to correct any reasonable complaint so please contact us as soon as possible. Please be advised that we are unable to entertain retrospective complaints I.e. complaints after your stay if we have not had the opportunity to address these whilst you were staying with us. We take complaints seriously and will thoroughly investigate any complaint in order to correct it and to avoid re occurrence. If we can not or do not address your complaint to reasonable satisfaction during your stay and you wish to make

a formal complaint then please write to us via letter or email and a manager will investigate your concern.   This brochure and Booking Conditions supersede previous issues.
