Dear First name, Re: Your responsibilities to Tesco regarding your permission to work in the UK We are required by immigration legislation to ensure that we do not employ or continue to employ any person who has limited leave to remain in the UK past the expiry date of their permission documentation. You have presented documents which indicate that your leave to remain/permission to work in the UK will expire on (Insert Date). It is your responsibility to ensure that your permission to stay and work does not expire: please make any applications for your permission to be extended well in advance of the expiry date. You will need to check with the Home Office first, however, about the earliest date that you are able to submit an extension application since this can vary. So long as your extension or new application is valid and has been made before your current permission expires, your permission will automatically be extended, until such time as you hear back from the Home Office. Please ensure that you keep copies of your application or online application, and proof of postage, since we may need to see evidence that a valid application has been submitted. Please note that a solicitor’s letter is not acceptable proof. Once you have heard back from the Home Office, you must inform us what the outcome is, and we must then take copies of your new right to work documentation. If your leave to remain/permission to work in the UK expires, and you have not made an application to extend it before your expiry date, Tesco cannot allow you to continue to work. You will be suspended without pay until you are able to provide new permission to work or live in the UK. Prolonged inability to provide new permission documents will result in your dismissal from the company. The Home Office is able to fine Tesco up to £20,000 if it finds that your documentation has expired. International Students/Graduate Entrepreneurs If you have a Tier 4 Student Visa or a Tier 1 Graduate Entrepreneur visa, please be aware that the terms of your visa restrict your working hours – you will be restricted from working more than 10 or 20 hours per week. This includes any ad-hoc overtime and any work you may do for another employer. Students do not have the hours’ restriction if they are not in term-time, but you must supply us with your term-time dates so we know when the hours’ restriction does not apply.

It is very important that you ensure that you do not work more than the number of hours stated on your permission to work documents (either 10 or 20 per week). Should you be found to be working in breach of the terms of your visa this will be viewed very seriously by the Company and is likely to result in your dismissal. You should also be aware that in the event that you work hours in excess of those permitted under your visa the Company will not pay you for the hours worked. Ongoing checks Tesco will conduct right to work checks regularly throughout your employment, through the Employer Checking Service, Biometric Checking Service, and Premium Sponsor License Service. By signing and returning the enclosed copy of this letter, you are confirming your agreement to checks being completed on your right to work status as deemed necessary by Tesco, as well as confirming that you understand your own responsibilities regarding your permission to work in the UK, and any restriction on the number of hours you can work, as outlined in this letter.
