LETTER FROM THE PRESIDENT Happy New Year Neighbors!

I hope your holiday season was enjoyable and not too fattening. As you plan events and goals for the upcoming year, please consider participating in the neighborhood. If you want Bella Vista to continue to be a pleasant and safe place to live, get involved. Continuing to assume “someone else will do it” isn’t going to work forever and we know what happens when you assume….. Can you spare a couple of hours each month to help maintain the environment of possibly your largest investment? We will have two Board positions open in May and no experience is required. FIRE PROTECTION UPDATE

Bella Vista is located in a Cedar Park ETJ (extra territorial jurisdiction) which means we do not pay taxes to Cedar Park and therefore, do not receive various services such as library access, garbage services or fire protection. Therefore ESD #14 (Emergency Services District) which was created by the legislature is responsible for providing fire protection to homes within the District. The ESD realizes that the Volente Fire Department cannot service our area for a variety of reasons; therefore, the ESD contracted with the City of Cedar Park to provide fire protection. Over the course of 5 years, the cost of services from the City of Cedar Park and the Volente Fire Department have increased significantly and the tax rate has not changed; therefore the ESD can no longer afford the increased fees without operating in a deficit. The ESD is currently negotiating with several other fire departments for services to homes in the ETJ and will secure the appropriate resources to ensure our homes are protected adequately. This is a much simplified description of the situation which is somewhat complex, but your Board President and Vice President are very familiar with the details and both are available to answer your questions and address your concerns. A list of facts will be provided in the next issue of the newsletter.

Q: Why did I receive a letter regarding my fence?

A: The

Bella Vista DCCRs require improvements (i.e. fencing) be in a good state of repair to preserve the appearance and value of the Subdivision, therefore, stained fencing that has faded or fencing which displays sprinkler markings (see photo) need to be addressed.

Q: How can I correct the violation? A: The situation can be resolved by either

power washing the fence or re-staining the fence which may also need power washing. New fencing will most likely require two coats of stain and very faded fencing may need heavy power-washing. Ultimately the fencing appearance must be uniform (i.e. one color).

BELLA VISTA JANUARY 2011 BOARD REPORT The Board of Directors would like to address any concerns you may have regarding the fining policy that was mailed out in December. Most of our neighbors follow the Declaration of Covenants, Conditions & Restrictions (“DCCR”s) very closely and others do not. This policy is intended for residents that do not correct the violations after several notices have been sent to the home. An inspector for Real Manage drives through Bella Vista every two weeks and notes violations that have not been corrected in the previous two weeks. Over the course of almost two months, several notices will be sent to the home regarding an outstanding violation and if the situation is not corrected within that time, fines will be applied. Bella Vista DCCRs have 14 categories of violations and it is highly likely that each of us has received a letter in the past. The vast majority of us correct violations long before a subsequent notice is sent; therefore, the policy will not be applicable. Many of you have complained to Real Manage or a board member about a garbage container left out beyond Tuesday, a trailer parked nearby for more than 2 days, a lawn not maintained or some other chronic violation and the Board has taken the only action available to alleviate these unfortunate situations from continuing. Bella Vista 9th Annual Cedar Park Swimming Kids Triathlon May 1st, 2011 at Elizabeth Milburn Pool • Event Information: This triathlon is a USAT sanctioned event. The purpose of the Cedar Park Swimming Kid’s Triathlon is to offer kids between the ages of 7 and 15 the opportunity to experience a multi-sport event in a safe and positive environment. The age you turn during the calendar year of 2011 is the age group in which you will compete in. While competition is always part of any race, it is not the primary focus of this race. The main focus of this event is for the kids, their families and the community to have FUN! • The event will take place at the Elizabeth Milburn Park in the City of Cedar Park, located at, 1901 Sun Chase Blvd., 78613, on Sunday, May 1st, starting at 8:00 AM. – Limited to 300-Participants (Continued on Page 5)
