Entries may be purchased via the internet or through a designated BBBSSA Representative. Online entry purchasers will receive a confirmation email of purchase and hard copy tickets mailed directly to the Arizona address listed within 10 business days of purchase. In-person entry purchases will receive an immediate hard copy ticket, unless otherwise instructed by the respective BBBSSA Representative. The ticket confirmation number is not required to claim a prize. By entering the Raffle, the entry purchaser acknowledges that he or she is aware of, and agrees to abide by, the Raffle’s rules and regulations. The Raffle Administrator and her immediate family members residing in the same household are ineligible to win a prize in the raffle. Purchasers do not need to be present during the drawing or attend the Annual BIG Gala to be eligible to win. RAFFLE DRAWINGS: Only 250 tickets will be sold at the single price of $100 per ticket. The draw will be held live Saturday October 5th, 2019 at the Annual BIG Gala, Shaken Not Stirred for which entries will be accepted until close of the formal event program, leading to the live draw. Final Draw deadlines will be adjusted in the event of early sellout as described later in this paragraph. Prizes with the lowest suggested retail prices will be drawn first, progressing in order to the Grand Prize. After each draw, the winning entry number will remain removed for all subsequent draws however entry purchasers may win more than one prize. PRIZES: The odds of a single ticket winning are roughly 1 in 83. The Grand Prize winner, when claiming his/her prize, will be provided the opportunity to accept either the Trip as described or the cash total of $5,000. Once documented, the purchaser is not able to retract or change. Cash distribution may take up to 14 business days to be available for the purchaser. The Grand Prize winner of the “James Bond Island” trip to Phuket, Thailand is presented by AAA Arizona, who is the booking agent. The Trip is listed to include the following, booked and secured through AAA Arizona: round-trip economy class airfare for two departing from Tucson, Arizona, seven-night stay at Anantara Mai Khao Phuket Villas which provides daily breakfast, full day Thai market tour and cooking school for two, half day private tour of Phuket Island for two, full day speedboat tour of Phi Phi Island and the featured all day tour of Phang Nga Nay and Khai Island aka James Bond Island, by speedboat. The package also includes a morning experience at the Phuket Elephant Sanctuary, which will be booked by Big Brothers Big Sisters of Southern Arizona, on behalf of the purchaser, at the direction of AAA Arizona. Based on the chosen dates of travel by the purchaser, listed lodging and/or attractions may not be available. Booking agent will seek similar or like experience and accommodations in substitution at the sole discretion of the Administrator. Purchaser is responsible for securing/updating their own passports, recommended to be valid for at least six months beyond the travel dates scheduled. Purchaser is responsible for vaccinations that maybe recommended for international travel. The purchaser is responsible for the cost of travel between the hotel and attractions as well as additional meals unless otherwise listed in the package offering. The Grand Prize winner of the James Bond Island trip must contact the Booking Agent to begin travel arrangements within 80 days of the drawing. Purchaser must provide at least 90-day advance notice with flexibility for booking arrangements. Trip must be taken within a year of the drawing date and is no longer valid after October 5th, 2020. The second prize, Tanque Verde Ranch is listed as an all-inclusive 2-night stay for two. This includes 3-meals per person, per day and access to available activities: supervised children’s programs (ages 4-11), horseback trail riding and lessons, scheduled breakfast rides and cowboy cookouts, mountain biking, fishing, guided hikes, nature programs, and yoga. Package excludes specialty activities/items which are of additional cost including: sunrise and sunset rides, vendor hosted activities such as silversmithing or leather belt making and alcoholic beverages. The certificate is non-refundable and non-transferable. Purchaser must use the package prior to the expiration date listed, October 31, 2020. Purchaser is responsible for making reservations for all items including lodging and activity participation in advance directly with Tanque Verde Ranch as directed on the certificate. Purchaser must bring the gift certificate at the time of redemption to be honored. Booking is subject to availability and blackout dates apply, including but not exclusive to Thanksgiving, Christmas and Spring Break seasons. The third prize, The Amberwood Cabin stay in Greer Arizona is listed as a 5-night stay in a rustic log cabin that sleeps up to eight people. The package excludes meals and activities in the surrounding area. The certificate is non-refundable and non-transferable. Purchaser must use the package prior to the expiration date listed, May 31, 2020. Purchaser is responsible for making reservations directly with the property owner/ property management company as directed on the certificate. Purchaser must bring the gift certificate at the time of redemption to be honored. Booking is subject to availability and blackout dates will apply. Reservation periods available are October 12–November 30, 2019 and January 1–May 31, 2020. Only specified prizes may be exchanged for a cash value. With proper transfer or sales documents bearing notarized signatures, as required by the Raffle and allowed by the prize provider, a prize may be transferred or sold. Prizes may also be donated back to Big Brothers Big Sisters of Southern Arizona. Package values based on MSRP at time of prize selection, as listed by the prize provider. NOTIFICATION OF WINNERS: All winners will be notified via mail by the Raffle Administrator of the requisite procedure to claim the prize. All Prize winners must claim their prize within fourteen (14) calendar days of the draw. The Grand Prize winner of the Trip to James Bond Island, Phuket Thailand, is required to contact the provider and begin trip booking within 80 days of the drawing. The remaining prizes are subject to availability with blackout dates. Each expires in 2020 and require advanced notice to book reservations. Three (3) business days after the Draw, a complete prize winners list, displaying first and last names of winners, will be available on SoAzBigs website. Using the information provided, if a selected winner is unable to be contacted or located prior to the deadline for claiming the prize, the prize or a cash equivalent will revert to Big Brothers Big Sisters of Southern Arizona. In the event a winning entry has more than one name listed, the Raffle Administrator will physically award the prize to the first name listed on the entry. For tax purposes, the prize can be split among all verified prize winners. Big Brothers Big Sisters of Southern Arizona nor their legal counsel are responsible for resolving disputes which may arise from any conflict between or amongst joint ticket holders or purchasers. PRIVACY: By entering the Raffle, entry purchasers agree that their information provided in connection with the Raffle entry may be used for communications promoting the Raffle and future raffles sponsored by or conducted for the benefit of Big Brothers Big Sisters of Southern Arizona. An entry purchaser may subsequently “opt-out” of the receipt of Raffle communications by following the directions in any email or by contacting the Raffle Administrator. Other than as provided herein, or as required by law or court order, an entry purchaser’s information will not be shared with or sold to any other person or entity. Purchase of an entry in the Raffle constitutes permission for the Raffle and Big Brothers Big Sisters of Southern Arizona to use winner’s name, and/or likeness, in perpetuity, for purposes of advertising the Raffle or future raffles without further consent or compensation, unless prohibited by law. REQUIREMENTS: Potential winners must complete all steps outlined in their winners’ letter within the designated timeframe. If an entrant is found to be ineligible, or if a potential winner does not comply with the Official Rules, then the potential winner will be disqualified and the prize or a cash equivalent will revert to Big Brothers Big Sisters of Southern Arizona. RAFFLE CANCELLATION: In the unforeseen event the Raffle is cancelled or cannot be completed, every effort will be made to refund the ticket purchase price to all Raffle ticket purchasers. Tickets purchased by credit card will be refunded to credit card holder’s account. Big Brothers Big Sisters of Southern Arizona’s liability to any ticket purchaser is limited to the purchase price of the ticket. WAVIER / LIMITATIONS OF LIABILITY: Except as described in the previous paragraph, entry purchasers, by participating (and winners, by accepting a prize), release Big Brothers Big Sisters of Southern Arizona and their respective parent companies affiliates, partners, subsidiaries, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising and promotion agencies, from any and all liability with respect to participation in the promotion, possession, use and distribution of the prize(s) awarded. In the event a dispute shall arise between the purchaser and, Big Brothers Big Sisters of Southern Arizona and/or it’s representatives any controversy or claim arising out of or relating to the raffle, shall be-resolved in Pima County Justice of the Peace Court. INTERNET: The Raffle will pursue all available legal remedies against any individual(s) damaging or attempting to damage any Big Brothers Big Sisters of Southern Arizona website or attempting to undermine the lawful operation of the Raffle. GOVERNING LAW: Should a dispute arise between a purchaser and Big Brothers Big Sisters of Southern Arizona and/or its representative, purchaser agrees that all cases, controversies, and legal issues shall be governed by the laws and jurisdiction of the State of Arizona. TAXES AND IRS RULES: All winners shall be responsible for any and all federal state and local income or excise taxes, fees, assessments and like charges associated with the prizes. All cash prizes will be paid net of applicable income tax withholding and Form W-2G will be issued to all winners. SPECIAL NOTE: At the time of this printing, federal law requires that corresponding tax withholding on prize values of $5,000 or greater must be collected from winners upon award and distribution. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time prizes are claimed will be followed. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution.
