Conditions  of  Participation:  Golden  Ticket  Challenge     1.  

Introduction  and  object  of  these  conditions  

  1.1  

The   honor   7   challenge   (“challenge”)   is   organised   by   Huawei   Technologies   (Netherlands)  B.V.  (“organiser”).  

1.2  

The  following  Conditions  of  Participation  shall  apply  between  the  participants  in  the   challenge  and  the  organiser.  By  taking  part  in  the  challenge,  the  participants  accept   these  conditions.  

1.3  

Details   on   requirements   for   participating,   action   to   be   taken,   the   duration   of   the   challenge,   individual   parts   of   the   challenge   and   any   prizes   follow   from   the   descriptions   provided   to   the   participants   in   the   course   of   the   challenge.   Such   detailed  descriptions  take  precedence  over  these  Conditions  of  Participation.  

  2.  

Rules  for  participating  in  the  challenge  

  2.1  

The   challenge   is   open   to   all   persons   aged   18   years   or   over,   who   are   resident   in   France,  Germany,  Netherlands,  Spain  or  the  United  Kingdom.  

2.2  

The  organiser’s  employees  and  employees  of  cooperation  partners,  who  are  or  were   involved  in  creating  or  implementing  this  challenge,  are  excluded.  

2.3  

To  take  part  in  the  challenge  the  following  actions  are  required:   Commenting   a   post   on   a   Honor,   JBL,   Parrot   Facebook   Page   and/or   tweeting   with   #emojigoldenticket  

2.4  

The   challenge   starts   on   15.09.   The   Partner   Event   is   split   into   four   different   challenges,   with   each   challenge   limited   in   time   of   2   weeks.   The   terms   of   the   challenges  will  be  announced  via  http://www.hihonor.com/goldenticket.  

2.5  

The   organiser   reserves   the   right   to   exclude   participants   who   violate   these   Conditions  of  Participation  from  taking  part  in  the  challenge  at  any  time  and  without   prior  notice.  This  shall  apply  in  particular  if  a  participant  makes  false  statements  or   uses   media   in   his/her   postings   which   violate   applicable   law   or   infringe   third-­party   rights.   If   a   participant   is   excluded,   prizes   and   benefits   may   even   be   subsequently   revoked  and  reclaimed.    

  3.     3.1  

Prizes,  notification  of  winners  and  entitlement  to  prizes     1  of  2  Golden  Tickets  will  be  raffled  after  2  challenges  each.  

3.2  

The  winners  shall  be  determined  by  random  selection  amongst  all  participants  of  2   consecutive   challenges.   The   winner   of   the   Golden   Ticket   will   be   drawn   within   1   week  after  the  end  of  2  challenges.    

3.3  

Participants   shall   be   individually   notified   by   email   or   via   the   social   networks   about   winning  a  prize.  

3.4  

If   a   participant   fails   to   accept   his/her   prize   within   a   period   of   7   days,   his/her   prize   shall  be  forfeited.  

3.5  

Payment  of  the  prizes  in  cash,  in  tangible  assets,  their  exchange  or  transfer  to  other   persons   is   not   possible.   Delivery   of   the   prizes   shall   be   agreed  individually   with   the   participants.  

  4.  

Special  Rules  

  4.1  

The  organiser  shall  publish  selected  postings  and  content  from  participants  from  the   social  networks.  By  entering  the  challenges  via  the  hashtag  #emojigoldenticket  or  in   the  relating  posts,  the  participant  consents  to  this.  

4.2  

The   organiser   shall   not   be   responsible   for   the   conduct   and   the   information   and   content  (“content”)  published  by  the  participants  in  the  course  of  the  competition  and   shall   not   adopt   this   as   its   own.   Furthermore,   the   organiser   shall   not   be   obliged   to   check  this  but  reserves  the  right  to  withdraw  its  publication  if  there  is  clear  evidence   that  the  content  violates  legal  requirements,  official  prohibitions,  third-­party  rights  or   accepted  principles  of  morality.  

4.3  

Participants   must   ensure   that   they   are   entitled   to   the   required   rights   of   use   in   respect  of  the  content,  in  particular  with  regard  to  commercial  use  of  the  content  as   set   out   in   Para.   4.1.   Participants   must   ensure   that   the   contents   reproduction,   its   being   made   accessible   to   the   public   or   its   editing   by   the   organiser   and   by   third   parties   authorised   by   the   organiser   does   not   violate   statutory   provisions,   accepted   principles  of  morality  and/or  third-­party  rights.  

4.4  

In   particular,   if   other   persons   can   be   identified   in   photographs   apart   from   the   participant,   such   photographs   may   only   be   uploaded   if   the   third   party/parties   has/have  consented  to  this  and  there  is  no  infringement  upon  of  third  parties’  privacy   rights.    

4.5  

Participants  may  not  harass  other  persons  within  the  scope  of  the  competition.  For   example,   no   communication,   forwarding   or   share   functions   may   be   used   to   send   communications  where  it  is  expected  that  their  receipt  is  not  desired  by  the  recipient.  

4.6  

If  claims  are  made  upon  the  organiser  for  unacceptable  content  or  other  violations  of   the   law,   for   which   a   participant   is   responsible,   the   participant   shall   indemnify   the  

organiser   at   first   request   and   support   the   organiser   in   defending   itself   against   the   claims.  Indemnification  shall  include  the  necessary  legal  costs.   4.7  

Participants   shall   grant   the   organiser   the   non-­exclusive   right,   free   of   charge   and   unlimited  in  terms  of  place,  to  reproduce,  disseminate,  make  accessible  to  the  public   and  to  edit  the  content  provided  by  them  to  the  organiser  and  to  transfer  such  rights   to   third   parties   such   as   technical   service   providers.   The   rights   shall   be   granted   without   limitation   in   time   until   revoked   by   the   users.   The   purpose   of   granting   the   above-­mentioned   rights   is   to   operate   and   make   the   competition   available   and   to   present   postings   from   participants   in   both   online   and   offline   media   for   organiser’s   commercial  use.  The  participant  waives  his/her  right  to  be  named  as  the  author.  

  5.  

Exclusion  of  legal  recourse  

  5.1  

Legal  recourse  shall  be  excluded  if  it  relates  to  the  determination  of  the  winners.  

  6.  

Privacy  policy  

  6.1  

The  participant  has  taken  note  of  the  privacy  policy  and  accepts  the  use  of  his/her   data  described  therein.  

  7.  

Miscellaneous  

  7.1  

Different  terms  and  conditions  of  the  participants  shall  not  be  recognised  unless  the   organiser  expressly  agrees  to  their  validity  in  writing.  

7.2  

The  law  of  the  Netherlands  shall  apply.
