July 31, 2014 IMPERIAL BEACH LIBRARY DESIGN-BUILD PRE-QUALIFICATION REQUEST FOR STATEMENT OF QUALIFICATIONS (RFSQ) 6575 DEPARTMENT OF GENERAL SERVICES The County of San Diego is seeking a qualified Design-Build Entity (D-BE) to design and construct a new branch library for the County of San Diego to serve the City of Imperial Beach and surrounding areas. The Project will be located on a County-owned parcel on Imperial Beach Boulevard and 8th Street (APN 626-400-54) with off-street parking located at St. James Lutheran Church (APN 626-400-71) and on-street parking on the east side of 8th street. The Project will consist of demolition of the existing 5,100 square foot library and associated improvements, and approximately 14,000 square feet of construction and remodel. A new freestanding, single-story library structure of approximately 12,000 gross square feet is to be constructed, connecting to and incorporating the renovation or reconstruction of the approximately 2,000 square foot existing adjacent Marina Vista Community Room, including all required infrastructure, off-site improvements, surface parking, and associated work. The library will include spaces for children, teens, and adults; a marketplace area featuring popular books and media; a computer lab, homework center, and Wi-Fi; a resource room for flexible programming; and approximately 700 square feet of space for the Friends of Imperial Beach Library operated bookstore. The Guaranteed Maximum Price (GMP) for this project shall not exceed $7,900,000, including up to $660,000 for FF&E. Energy efficiency of LEED Silver certified, and Zero Net Energy design are required. In accordance with the provisions of Public Contract Code Section 20133, the County of San Diego is utilizing a two-step process to prequalify, select and award a contract to a D-BE for the Imperial Beach branch library. This is the first step in which the County is issuing this RFSQ with the attached Pre-Qualification Questionnaire. The County will score and rank all submittals. The three (3) highest-scoring D-BEs will be eligible to advance to the second step in the process, the issuance of a Design-Build Request for Proposals (RFP). D-BEs scoring below the three (3) highest-scoring D-BEs will be notified in writing that they are not eligible to participate in the RFP process. DUE DATE AND TIME The Due Date and Time is August 27, 2014, 4:00 PM. SUBMIT To: County of San Diego, Department of Purchasing and Contracting, 5560 Overland Avenue, Suite 270, San Diego, CA 92123-1204. RFSQ SUBMITTALS A complete response to the RFSQ will consist of providing all information requested in Section A – Forms and RFSQ Information and in Section B – Pre-Qualification Questionnaire. This response must be submitted in a three-ring binder with tabs identifying each section and as described in Section A. Attachments must be clearly identified under separate tabs. The front of the binder must indicate the D-BE’s name and address in the following format: PRE-QUALIFICATION DOCUMENT RFSQ 6575 [Design-Build Entity Name and Address] Project Name: Imperial Beach Library Submit one (1) binder clearly marked “Original” and Four (4) duplicate hard copy binders of the Pre-Qualification Document and attachments to the County of San Diego Department of Purchasing and Contracting, at the address noted above, prior to the Due Date and Time, attention Hugo Mora. For purposes of determining responsiveness or non-responsiveness to this procurement, the conforming documentation will be the “Original” hard copy materials submitted in the three-ring binder. Pre-Qualification Documents shall be submitted in a sealed envelope or package clearly marked on the exterior and in the same format noted above. Parking may be limited, so be sure to deliver your responses early. 2

Late submissions cannot be considered unless a late submission is the only one received or there was mishandling on the part of the County of San Diego Purchasing and Contracting staff. Submittals must be received at the Purchasing and Contracting front counter by the identified Due Date and Time. PRE-QUALIFICATION CONFERENCE A Pre-Qualification conference is scheduled for 1:00 PM, August 6, 2014, at 5560 Overland Avenue, First Floor, Room 172, San Diego, CA 92123. Questions and answers resulting from that conference will be posted to BuyNet. PROJECT REQUIREMENTS

1.1

PROJECT DESCRIPTION 1.1.1

The proposed project is a new single-story structure of approximately 12,000 gross square feet, on a County-owned parcel at 810 Imperial Beach Boulevard in the City of Imperial Beach (APN 626-400-54), and connecting to the existing Marina Vista community room which is to be remodeled or reconstructed and integrated into the new facility (“Project”). The work will include all required infrastructure, off-site improvements, surface parking, and demolition of existing structure(s) and improvements. The existing library and Project site sit on County property on the corner of Imperial Beach Boulevard and 8th Street. The site is adjacent to an existing City of Imperial Beach Community Center, the Community Room portion of which is to be renovated or reconstructed and connected to the new library as part of the Project. The new library will complete a small community centered complex sharing parking with the Community Room, Senior Center and Veteran’s Park. One of the Project goals is to integrate the new library building so that it will enhance the overall community complex. The existing Veteran’s Park and Senior Center must remain operational during construction with minimal impact to operations. In addition, there is very limited laydown and storage area available onsite for contractors. The D-BE may find it necessary to make arrangements for offsite project trailer and/or materials storage. The library will include spaces for children, teens, and adults; a marketplace area featuring popular books and media; a computer lab, homework center, and Wi-Fi; a resource room for flexible programming; and approximately 700 square feet of space for the Friends of Imperial Beach Library operated bookstore. The Guaranteed Maximum Price (GMP) for this Project shall not exceed $7,900,000, including up to $660,000 for FF&E.

1.1.3

The library design shall implement low impact development standards and use sustainable design principles, practices and performance. The design of the architectural, engineering, landscaping and the building systems shall be integrated for efficiency and ease of maintenance. The D-BE shall recognize building operations and maintenance as a key component in all aspects of the design. The Project shall minimize negative environmental impact and meet or exceed minimum criteria for LEED Silver designation. The Project shall also meet the County Net Zero Energy initiative for new construction.

1.1.4

The library design shall use a retail-like market place design model, with an emphasis on noise abatement, as well as use innovative lighting and theming to enhance the user experience and maintain an active, user-friendly public environment.

COMPARABLE PROJECT ATTRIBUTES A- 4

A Comparable Project has ALL of the attributes listed below in parts 1.2.1.1 through 1.2.1.4. If a submitted project has only a portion of the attributes, only those attributes that are comparable will be scored. If a submitted project has none of the attributes, it will be scored zero and will not be used for Reference Questions. A comparable project is defined as having ALL of the following: 1.2.1.1

A construction cost at the time of bid of at least $6,000,000.

1.2.1.2.1 Is either a freestanding library building of at least 5,000 square feet, or an integrated library that is part of larger building or complex, the library portion of which is at least 5,000 square feet. OR 1.2.1.2.2 Is a freestanding non-chain retail or similar market-place with unique theming interior design, lighting and signing of at least 5,000 square feet. 1.2.1.3 Has been completed by the D-BE/GC as primary at-risk construction entity, or Architect, as Architect-of-Record, and occupied in the last 10 years or construction is currently at least 70% complete. Note: At least one (1) of the three (3) projects must have been completed in the last 5 years. Do not include any brochures for projects; any information provided will not be included as part of the questionnaire analysis or scoring. 1.2.1.4

Meet at least five (5) of the following project attributes:

a) Located in California (At least one (1) project of the three (3) must be located in California) b) Completed with the D-BE General Contractor and Architect together. Partial consideration will be given to completion by designated Project Manager or Project Architect staff with another firm if within the past 5 years. (At least one (1) of the three (3) projects must be completed by the D-BE General Contractor with the Architect.) c) Located on an active public site with adjacent operating businesses and residences. d) Had constrained construction and staging areas. e) Included interior improvements, FF&E and building signage. f) Contained noise abatement features. g) Included integrated lighting, which is defined as lighting that responds to the individual and unique public areas in the building architectural features and theming. Integrated lighting is not uniform general lighting throughout the facility. h) Included theming design, which is defined as the use of furnishings, finishes, lighting and layout in developing and executing interior spatial volume. Theming should reflect and enhance the individual unique identity of the public areas in the building. Children’s areas should look, feel and respond to needs of A- 5

Theming is not providing the same interior furnishing, finishes, lighting and layout throughout the facility. LEED Silver certified or higher. Please note that the Comparable Project attributes are referenced again in Part V of this RFSQ.

1.4

The D-BE is solely responsible for due diligence in identifying and avoiding all potential conflicts of interest related to contracting for, and construction of, this Project. 1.5

GUARANTEED MAXIMUM PRICE (GMP) The Guaranteed Maximum Price shall not exceed $7,900,000. At this time, the County anticipates including an allowance for FF&E of up to $660,000. More detailed information will be provided during the RFP phase. Any proposals received in response to the RFP (second step of the process, should County choose to proceed) that are greater than the GMP established for the Project will be given a score of zero (0) for the pricing criterion of the evaluation. A minimum bonding requirement of $9.0 million will be required in response to this RFSQ. A- 6

RFSQ PROCESS

2.1

PROCESS OVERVIEW 2.1.1

RFSQ documents, project information and any issued addenda are available to be downloaded, free of charge, from the Department of Purchasing and Contracting BuyNet website at http://buynet.sdcounty.ca.gov. It is the D-BE’s responsibility to periodically check the website for addenda or other updates to this RFSQ.

2.1.2

Due Diligence Material, if provided, is subject to the following disclaimer: Neither the County nor any of its agents, advisors, or representatives has made or makes any representation or warranty, express or implied, as to the accuracy or completeness of the Due Diligence Material. Without limiting the generality of the foregoing, the Diligence Material may include certain assumptions, statements, estimates, and projections provided by or with respect to the County. Such assumptions, statements, estimates, and projections reflect various assumptions made by the County, which assumptions may or may not prove to be correct. 2.1.3 All inquiries related to this RFSQ must be directed concurrently by email to the Project Manager and Procurement Contracting Officer identified in the Cover Letter of this RFSQ. D-BEs should not rely on information received from, and should not attempt to contact any other County personnel or members of the Project team about this RFSQ unless authorized by the Procurement Contracting Officer.

If required, written addenda to the RFSQ will be issued and posted on BuyNet.

Pre-Qualification Documents will be evaluated by a Qualification Evaluation Committee (QEC) appointed by a Source Selection Authority (SSA).

2.1.6

The County of San Diego Procurement Contracting Officer will notify all D-BEs and post a “Notice of Pre-Qualification” on BuyNet for five (5) business days after receipt and approval of the Qualification Evaluation Committee’s recommendation.

SUBMISSION OF PRE-QUALIFICATION DOCUMENT 2.2.1

The Pre-Qualification Document must be submitted and received at the front desk of the County of San Diego Purchasing and Contracting at the address noted and by the Due Date and Time specified in the Cover Letter to this RFSQ.

2.2.2

It is understood and agreed upon by the D-BE in submitting a Pre-Qualification Document that the County has the right to withhold all information regarding this Pre-Qualification until after contract execution. The Qualification Evaluation Committee (QEC) report shall be subject to disclosure after contract execution. DA- 7

Information releasable after contract execution is subject to the disclosure requirements of the Public Records Act, California Government Code section 6250, et seq.

D-BEs shall provide all materials required in this RFSQ.

2.2.4

The Pre-Qualification Document shall provide clear and sufficient detail to enable the QEC to evaluate the responsiveness and quality of the proposal to each of the RFSQ requirements listed in “Submittal Requirements”. Although some factors are weighted more important than others, all factors are considered necessary for a responsive submittal.

EVALUATION AND PRE-QUALIFICATION 2.3.1

The Pre-Qualification Document will be evaluated based upon the information provided in response to this RFSQ and any other information known to the County based on the qualification criteria listed in the Pre-Qualification Score Sheet. For purposes of the County’s evaluation of the Pre-Qualification Document, only the hard-copy materials submitted in the three-ring binder document marked “Original” will be considered.

2.3.2

The County reserves the right to request clarification and/or request additional information from D-BEs if deemed necessary. Such clarifications and/or additional information shall be submitted by the D-BE as an addendum to the Pre-Qualification Document upon request of the Procurement Contracting Officer. The fact that the County may request such clarification from one D-BE does not obligate it to seek similar clarification from any other D-BE.

2.3.3

Upon receipt and approval of the QEC’s recommendation of the three (3) highest qualifying scores, the Procurement Contracting Officer will post a “Notice of PreQualification” for five (5) business days. The “Notice of Pre-Qualification” will identify the three (3) D-BEs that will be eligible to participate in the RFP process.

SIGNATURE The Pre-Qualification Document shall be certified by an authorized officer or employee of the submitting D-BE who has actual authority to contractually bind the D-BE. The name and title of the authorized officer or employee shall be included.

2.5 PROPRIETARY INFORMATION All response documents become the property of the County and subject to Public Records Act requirements of California Government Code section 6250, et seq. D-BEs shall mark any documents “CONFIDENTIAL” that they deem to be confidential before submission to the County. However, the County will only keep such documents confidential to the extent permitted by law. A- 8

NOTE: As a Public Agency, the County of San Diego must adhere to the California Public Records Act, therefore, pricing cannot be considered confidential/proprietary. 2.6

UNNECESSARILY ELABORATE INFORMATION Unnecessarily elaborate brochures, visual or other presentations, art work and paper and binding beyond those sufficient to present a complete and effective Pre-Qualification Document are neither necessary nor desired, and are strongly discouraged.

2.7

COUNTY COMMITMENT 2.7.1

The County shall have the right to reject or accept any Pre-Qualification Document, or any part thereof, for any reason whatsoever, at its sole discretion.

2.7.2

This RFSQ or any resulting “Notice of Pre-Qualification” does not commit the County to issue a Request for Proposal, award a contract, nor does it commit the County to pay any costs incurred in the response to this solicitation, attendance at the Pre-Qualification conference, or in the preparation or submission of the PreQualification Document or attachments, nor procure or contract for services or supplies. Further, no reimbursable cost may be incurred in anticipation of selection or a contract award.

2.7.3

The County reserves the right to cancel this RFSQ at any time, in part or in its entirety.

2.7.4

No prior, current, or post award conversation or agreement(s) with any officer, agent, or employee of the County shall affect or modify any terms or obligations of this RFSQ, or any contract resulting from this process.

2.7.5

The County reserves the right to waive any informality or irregularity in the PreQualification Documents submitted.

LATE, MODIFIED, OR WITHDRAWN PRE-QUALIFICATION DOCUMENT 2.8.1

Late submissions of the Pre-Qualification Document cannot be considered unless the late submission is the only one received or there was mishandling on the part of the County of San Diego Purchasing and Contracting staff. The Pre-Qualification Documents must be received at the Purchasing and Contracting front counter by the identified Due Date and Time.

2.8.2

Any modification of a Pre-Qualification Document is subject to the same conditions as the initial submission.

2.8.3

The Pre-Qualification Document may be withdrawn at any time prior to the Due Date and Time by written notice, or in person by the D-BE or its authorized representative, provided the authorized representative’s identity is made known and the representative signs a proposal withdrawal receipt.

NON-RESPONSIVE SUBMISSIONS Any Pre-Qualification Document may be construed as non-responsive and ineligible for consideration if it does not comply with the requirements of the RFSQ. Failure to comply with the format and acknowledgment of receipt of addendum are common causes for holding a submittal non-responsive.

2.10

KNOWLEDGE OF RFSQ AND CONDITIONS Before submitting a Pre-Qualification Document, D-BEs shall carefully read all sections of this RFSQ and any addenda thereto, including all forms and exhibits, and shall fully inform themselves as to all conditions and limitations.

2.11

DUTY TO INQUIRE Should a D-BE find discrepancies in or omissions from the RFSQ or other documents, or should the D-BE be in doubt as to their meaning, the D-BE shall at once notify the Project Manager and the Procurement Contracting Officer by email. Addenda, if issued, will be posted on BuyNet. It is the D-BE’s responsibility to periodically check the website for such addenda. The County will not be responsible for any oral instructions nor for any written materials provided by any person other than the Procurement Contracting Officer or his/her designee. Responses will not be provided to questions received after the date stated in the Cover Letter.

2.12

PROTEST PROCEDURE Any protest resulting from this qualification process is to be processed as prescribed in Board Policy A-97.

SR FH 25-632384 for D-BEs that are non-residents of California (out-of-state invoices) and that receive California source income. Fifteen (15) business days prior to the first payment, new suppliers or suppliers with expired forms or forms with incorrect information, must submit new forms to the County (forms are available from the Franchise Tax Board website listed below). 2.13.2 Under certain circumstances D-BEs may be eligible for reduced or waived nonresident withholding. If the D-BE has already received a waiver or a reduced withholding response from the State of California and the response is still valid, the D-BE should submit the response to the County in lieu of the forms. Failure to submit the required forms will result in withholding of payments. It is recommended that D-BEs speak with their tax advisers and/or the State of California for guidance. DEBRIEF When a D-BE has been notified by the Procurement Contracting Officer that its PreQualification Document is no longer being considered, the D-BE may submit a request to the Procurement Contracting Officer for a “debriefing” on the findings on its PreQualification Document submittal (with no comparative information about PreQualification Documents submitted by others).

2.15

NEWS RELEASES D-BEs shall not issue any news release pertaining to this RFSQ without prior written approval of the County’s Contracting Officer, which may be withheld at the County’s sole discretion. A minimum of two (2) business days’ notice is required for approval.

2.16

EVENTS The timing and sequence of events resulting from this RFSQ shall be determined by the County.

3.1.2

The Pre-Qualification Document must be submitted in a three-ring binder with tabs identifying each section as indicated above. Attachments must be clearly identified. The front of the binder must indicate the RFSQ and D-BE’s name and address in the format noted in the Cover Letter.

3.1.3

The Internal Contract or Binding Agreement between the members of the D-BE must include a statement that specifically states that all partners and members agree to be fully liable for their performance under the terms of the County’s Design-Build contract with the D-BE.

WRITTEN REQUIREMENTS 3.2.1

The Pre-Qualification Document shall be prepared and submitted in the required format with all forms, answers and attachments sequentially numbered to correspond to the applicable question or requirement.

3.2.2

The Pre-Qualification Document shall be printed legibly or typed and be concise but comprehensive, and in accordance with the requirements herein. The submittal shall not include promotional material of any kind.

4.

EVALUATION OF PRE-QUALIFICATION DOCUMENTS

4.1

EVALUATION PROCESS 4.1.1

The evaluation process shall follow sequential steps and utilize scoring criteria to ensure that each Pre-Qualification Document is evaluated in the same manner: (a) Timely Receipt: Timely receipt at the County. Submittals must be received at the Purchasing and Contracting front counter by the Due Date and Time. (b) Evaluation of Pre-Qualification Documents: Objective conformance review by the Qualification Evaluation Committee. (c) Scoring and Ranking: Scoring and ranking of Pre-Qualification Documents by the Qualification Evaluation Committee to determine three (3) highest scores.

4.1.2

The Pre-Qualification Document will be evaluated in order. Adherence to Essential Requirements in Part II will be evaluated first, and only those Submittals meeting all essential requirements will be evaluated further.

4.1.3

Public Contract Code, Section 20133, requires that Pre-Qualification be based on specific criteria contained in the Code plus any additional criteria established by the County. A- 13

The evaluation shall be based on a formal scoring method using scoring criteria. Each Pre-Qualification Document shall be reviewed for compliance with the RFSQ criteria.

4.1.5

Each Qualification Evaluation Committee member shall rate the value of each PreQualification Document based on his or her individual evaluation. The Committee members shall together then determine an agreed-upon rating for each criterion to establish the final score.

4.1.6

The County reserves the right to require interviews and to include such presentations in the evaluation.

SCORING AND RANKING 4.2.1

The scoring and ranking is based on evaluation of the Pre-Qualification Document as measured against the scoring criteria in compliance with the RFSQ. PreQualification Documents will be evaluated and ranked from highest to lowest. The County will identify the three (3) highest scores in the following manner: 4.2.1.1

Information - This section consists of basic information about the DBE that will not be scored.

4.2.1.2

Essential Requirements (Pass/Fail) This section contains the minimum basic requirements the D-BE, architect, and general contractor and stated disciplines to be prequalified must possess to be considered responsive to the solicitation. Each question is potentially disqualifying. a. Provide certification that the answers submitted in the PreQualification Document are true and correct. If certification is not provided, the submittal shall be deemed non-responsive and will not be scored. b. Provide Surety Declaration stating that minimum bonding capacity will equal the amount estimated for the project. D-BEs who cannot meet minimum bonding capacity will not be deemed qualified. c. D-BEs will be disqualified for answers to any question in Part II of the Questionnaire in a manner indicated as “Disqualifying”. d. Provide signed and completed PC-600 form and Representations and Certifications Form. If forms are not provided, the submittal shall be deemed non-responsive and will not be scored.

The purpose of the scoring and ranking of the Pre-Qualification Documents is limited to the identification of D-BEs with the three (3) highest scores that will be eligible to advance to the second step in the selection process, the issuance of an RFP, if the County chooses to proceed. The scores of the eligible D-BEs that are established at the conclusion of the Pre-Qualification (RFSQ) phase will not be used in ranking the eligible D-BEs entering into or during the second step in the selection process, RFP phase, except as noted herein in section 4.3 THE COUNTY’S RIGHTS.

THE COUNTY’S RIGHTS 4.3.1

After completion of the RFP process (second step), the County will enter negotiations with the highest ranked D-BE, which may include potential refinements to the Proposal. If contract negotiations with the highest ranked D-BE are unsuccessful, the County may terminate the negotiations and begin negotiations with the next highest ranked D-BE. If contract negotiations with the next highest ranked D-BE are unsuccessful, the County may terminate the negotiations and begin negotiations with the third highest ranked D-BE.

5.

DESIGN-BUILD ENTITIES (D-BEs)

5.1

DEFINITION OF A DESIGN-BUILD ENTITY A Design-Build Entity (D-BE) as defined by Public Contract Code Section 20133(c)(3): “Design-Build Entity means a partnership, corporation, or other legal entity that is able to provide appropriately licensed contracting, architectural, and engineering services as needed pursuant to a design-build contract.”

5.2

LISTING OF DESIGN-BUILD ENTITY MEMBERS 5.2.1

The D-BE shall identify and list in Part I of the Questionnaire the General Contractor and Architect. The D-BE must complete Part II of the Questionnaire. The General A- 15

If the D-BE consists of a member performing both design and construction services (e.g. a General Contractor with a licensed design staff), then that member must complete Part IV for both parties. The D-BE will be scored as, and must qualify as, both General Contractor and Architect.

5.2.3

Substitutions. If the D-BE wishes to substitute any Member or required discipline identified in the Pre-Qualification Document, it may not do so without the express written consent of the County of San Diego. No such approval will be granted unless the Member or firm is proposed to be replaced by a firm of equal or higher qualification, which is subject to review and approval of the County. This is not an implied consent. Upon notice of a substitution, the County reserves the right to: 1) rescore the Pre-Qualification Document of the D-BE requesting the substitution, and 2) disqualify the D-BE if it determines, in the County’s sole discretion, that the proposed firm is not “equally or more highly qualified”.

5.2.4

Services of other subcontractors or sub-consultants not listed in this RFSQ response or in a subsequent RFP proposal, if successful, and in excess of ½ of 1% of the GMP, must be procured by a public proposal process (Public Contract Code Section 20133(f), subsequent to award of a contract. This public proposal process shall provide: (a) announcement in a legal newspaper for a minimum of ten (10) days, (b) fixed date and time of public opening of proposals to be held in San Diego County, and (c) selection by the D-BE on the basis of its determination of best value.

5.2.5

Since the County encourages D-BEs to seek out local business in San Diego County in the awarding of subcontracting opportunities, an overall score of 5% is assigned to this effort in the RFP. Offerors must demonstrate how they plan to implement this outreach opportunity to both large and small businesses, minority and women owned businesses, and disabled veterans business enterprises (DVBEs). As part of this subcontracting outreach, there is a minimum 3% DVBE participation requirement.
