I joined the law firm of Buxbaum & Chakmak located in the Village in 1990. Two years later Jess Swick suggested – sort of demanded - that I join the Chamber. I took his advice and have been active with the Chamber ever since. I was on the Board for 12 years, worked on many committees and was President in 2002-2003. I was in charge of the Village Venture street marshals for nearly 20 years, was an ambassador and currently chair the Government Relations Committee. I have thoroughly enjoyed the opportunity to work with Maureen and so many talented Chamber members, as well as Claremont’s mayors and City Councils. As an attorney I have provided estate planning and probate advice to many Chamber members, and I continue to get member referrals. With so much going on and this year officially coming to an end, it’s incredibly challenging to know where to begin this month’s newsletter. First, it is always wonderful each year to see how many people are shopping local this holiday season. This was evident in the LARGE number of receipts that got submitted in our chamber annual “More the Merrier” campaign that was concluded on the 20th of December. I’d like to say thank you to all those that shopped local this holiday season and congratulations to this years winners. For me, December has always a month of celebration and reflection. With all that has occurred this year and all the hustle and bustle in our lives, I can’t help but feel incredibly fortunate to work with and for such a great group of people, both in business and in volunteerism. I have never been a “glass is half empty or full” kind of guy. But lately my glass has been closer to full than empty. I hope that you too are in the festive spirit this time of year and throughout. As this year comes to an end, we should keep in our mind and hearts those that have less than us and are not as fortunate to live and work in such a great community and remember that every day brings with it a new opportunity to make it a great one. I look forward to all of the new and exciting things happening in the upcoming year. Make sure to keep your eyes and ears open for all of the wonderful networking events, ribbon cuttings, and lunch and learns. I am excited to say that I believe 2016 will be nothing short of a great year (but isn’t every year a great one?). I am definitely looking forward to it. Foothill Gold Line January 2016 Update A Message from Foothill Gold Line Construction Authority CEO, Habib F. Balian: 2015 was a milestone year for the Construction Authority, the San Gabriel Valley corridor cities and stakeholders who have been outspoken supporters of the Foothill Gold Line for more than a decade. The year culminated with more than 4,000 residents and elected officials helping to celebrate the on-time, on-budget completion of the Foothill Gold Line from Pasadena to Azusa. The celebrations followed a year filled with activity, including thousands of safe work hours by our contractors, successful testing of the line, and installation of one-of-a-kind artwork at the six new stations. The project’s success was the result of an unprecedented partnership between the Construction Authority, Los Angeles County Metro, three design build teams, five corridor cities, elected officials at all levels, and othersall of whom now eagerly anticipate revenue operations beginning on March 5, 2016. As Los Angeles County Metro prepares to begin passenger service to Arcadia, Monrovia, Duarte, Irwindale and Azusa, the Construction Authority is focused on making the 12.3 mile Glendora to Montclair segment ready to break ground. Memorandums of Understanding with the six corridor cities have been put in place over this past year, allowing design and engineering work to begin in earnest; and the Construction Authority is on schedule to issue a request for qualifications for the first design-build contract in late 2016 and to break ground in 2017.This schedule assumes the nearly $1.2 billion in construction funding

needed is secured from a sales tax measure for transit and highway improvements being contemplated by Los Angeles County Metro for the November 2016 ballot. The Glendora to Montclair project has been identified as one of the top priorities for funding through the tax measure, and I am encouraged by those who over the past several months have recognized the crucial role this next segment will play in improving mobility and the quality of life for our region. The segment from Glendora to Montclair will offer much-needed relief to the increasingly congested I-210 Corridor (expected to take on the majority of population and job growth in the San Gabriel Valley in the coming decades) and provide direct connections to more than a dozen universities, the Los Angeles County Fairplex, and all of San Bernardino and Riverside Counties via the Montclair TransCenter. Over the coming months, the Los Angeles County Metro board will make crucial decisions about the sales tax measure, including finalizing the program of transit and highway improvements to be funded through the measure and the timeline for funding each project. With all current indications good that the Foothill Gold Line from Glendora to Montclair will be included in those plans, the Construction Authority is working to prepare the project for the likelihood that the measure will be approved by voters in less than a year. Cal Chamber Explains New Laws for 2016 The California Chamber of Commerce is presenting handy summaries of new legislation taking effect in 2016 that will affect the day-to-day operations of California employers. The summaries appear in a CalChamber white paper, available to download at www.calchamber.com/ newlaws2016. Some of these new laws make important changes to existing state law. Other mandates make small changes to different parts of existing law or may affect only certain types of employers, such as employers with piece-rate workers. The CalChamber also reminds employers that the minimum wage increases on January 1, 2016, to $10 an hour. The increase is not a new law, but is the last mandatory increase from the legislation signed into law in 2013. Paid Sick Leave Already in place are the July 13, 2015 amendments to the mandatory paid sick leave law. Those changes included clarifying who is a covered worker; providing alternative methods of accruing paid sick leave other than one hour for every 30 hours worked; clarifying protections for employers that already provided paid sick leave or paid time off before January 1, 2015; and providing alternative methods for paying employees who use paid sick leave. More details appear in a CalChamber white paper, available at www.calchamber.com/paidsickleave. The Labor Commissioner’s Office also has released revised FAQs to reflect its position on the paid sick leave amendments. Leaves and Benefits Other changes to leave and benefit laws include changes to kin care requirements; school and child care activities leave; National Guard leave and protections; unemployment insurance and electronic reporting (taking effect January 1, 2017); state disability insurance eligibility waiting periods (taking effect July 1, 2016); and unemployment insurance training benefits.

Discrimination/Retaliation The Fair Pay Act prohibits an employer from paying any of its employees less than employees of the opposite sex for “substantially similar work, when viewed as a composite of skill, effort and responsibility.” The act places specific requirements on employers to affirmatively show that a wage differential is not unlawful but is instead based entirely and reasonably upon one or more acceptable listed factors, including seniority and merit systems or other bona fide factors coupled with a showing of “business necessity.” It also creates a private right of action for retaliation and discrimination. Other new laws expanding employee protections in 2016 include: whistleblower and anti-retaliation protections; protection against retaliation for requesting reasonable accommodation; immigration-related protections; and expansion of anti-discrimination protections in state contracts. Wage and Hour Many of the new wage-and-hour laws deal with how the laws will be enforced, instead of imposing significant new obligations on employers. Urgency legislation that went into effect when the Governor signed it on October 2, 2015 gives employers the right to correct two types of violations relating to itemized wage statements before an employee may bring a civil action under the Private Attorneys General Act, subject to specified limitations. Other wage-and-hour laws set new rules for employers with piece-rate employees; deal with the meal periods in the health care industry (urgency legislation that went into effect on October 5, 2015); expand the Labor Commissioner’s ability to enforce state and certain local laws; reduce the prohibited amount of weekly disposable earnings that may be garnished (effective July 1, 2016); provide an amnesty program for port drayage companies that misclassify commercial drivers; and make various changes relating to public works and prevailing wages. Other new laws deal with franchisor/franchisee agreements; and require ride-sharing services, such as Uber and Lyft, to participate in the state Department of Motor Vehicles “pull-notice” system to regularly check the driving records of participating drivers.

New laws affecting hiring practices in 2016 deal with the use of the federal E-Verify system; job protections for grocery store workers when the store changes ownership; and classifying cheerleaders for professional sports teams as employees, not independent contractors. Workers’ Compensation Workers’ compensation-related bills signed into law in 2015 will require creation of a formulary for prescription medications in the workers’ compensation system by July 1, 2017; clarify that workers cannot be denied benefits based on citizenship or immigration status; require certain forms, notices and fact sheets to be made available in additional languages by January 1, 2018; clarify medical provider network laws; allow investigation and enforcement of the obligation to secure valid workers’ compensation insurance.

The Division of Workers’ Compensation also recently finalized regulations revising certain benefit notices for January 1, 2016.

Those who brought receipts to the Chamber office, The Bath Workshop and Vom Fass where given a raffle ticket and entered into the drawing. The prizes included massage packages, portrait sessions, dinner and a show, wine, teeth whitening, a variety of gift cards and the grand prize was an Apple iPad. A total of 2,020 tickets were counted at the end of the campaign which represent $101,000 spent in Claremont.
