Driving Contract for Minors This contract is between __________________, a minor driver (hereafter referred to as “I”) and ___________________, parent of the minor (hereafter referred to as “Parent”). I agree to the following terms and conditions and acknowledge that such agreement is a necessary part of parent decision to give me use of a car. Both parties agree to the following: 1.

Although I paid for the _____________________ (“Car”), all rights associated with ownership shall reside with parent while I am a minor, including but not limited to the right to sell the vehicle.

2.

I cannot modify the car in any manner without the express written approval of parent. This shall include, but not be limited to, modifying the appearance of the vehicle, changing the sound system, or any modifications to the performance of the vehicle.

3.

I shall never lend the car to a friend without the express prior approval of parent.

4.

I agree to pay for gasoline used for the car.

5.

I agree to be responsible for following maintenance schedule recommended by manufacturer.

6.

Parent shall have the right to rescind or restrict my use of the car at any time, for any reason whatsoever.

7.

Parent shall initially pay for insurance (this policy is subject to future modification). However, I agree to pay for 100% of any insurance increase that is caused by a ticket or accident.

If I receive a moving violation, I shall lose the privilege of driving the car for 60 calendar days. Parent may reduce this penalty if deemed, in parent’s sole judgment, that citation was the result of inexperience rather than poor driving behavior. Speeding tickets, going through red lights, or rolling through stop signs shall be automatically deemed to fall into the poor driving behavior category.

If I receive a citation for reckless driving that is upheld by a judge, I shall forfeit my right to drive the car for 1 year. Reckless driving is a designation by the police department for a very serious violation, such as excessive speeding (going 80 MPH in a 35 MPH zone, for example). It is defined as “operation of an automobile in a dangerous manner, including speeding, cutting in and out of traffic, failing to yield to other vehicles, and other negligent acts. It is a misdemeanor crime.” There will be zero tolerance for reckless driving.

If I am cited for driving while having a trace amount of alcohol in my body (as opposed to being legally drunk), I shall forfeit the right to drive the vehicle for 3 months. This will include a scenario where I have one sip of wine at a family event. Zero tolerance will be the standard for drinking and driving.

If I receive a DUI (defined as being at the adult legal threshold for being drunk as opposed to having a trace amount of alcohol in my system) which is upheld by a judge, I shall indefinitely forfeit my right to drive.

I agree not turn on the music system in the car until prior approval is granted by parent.

13.

I agree to abide by all regulations that pertain specifically to sixteen and seventeen year-old drivers. If I break curfew or drive with another minor in the car (if against state regulations), my privilege to drive the car shall be rescinded for 30 calendar days, whether or not I am cited for such violation. The only exception shall be for cases where prior approval is granted by parent.

I agree to abide by laws forbidding sixteen and seventeen year-old drivers from using cell phones while driving, even if hands-free (with a bona fide emergency being the only exception). If I violate this law, even if not cited by the police, I shall lose my privilege of driving the car for 30 calendar days. A second violation will lead to loss of driving privileges for 90 calendar days. Sending or reading text messages while driving will cause the loss of driving privilege for 90 days. This also applies when at red lights or stopped in traffic. Parent shall have the right to periodically check cell phone records to see if there is any cell phone activity during periods of driving. Until the following rule is waived by parent, the cell phone must be in off position (airplane mode) at all times that the vehicle is turned on. There will be zero tolerance for driving and using the cell phone.

15.

I acknowledge that driving as a minor is a privilege that carries with it important obligations to other drivers as well as to myself. I agree to make my best effort to drive carefully, courteously, calmly, and with respect for other drivers, and to make my best effort to be a safe and responsible driver.
