Mandatory Pre-Proposal Meeting There will be a Mandatory Pre-Proposal meeting on Thursday, October 30, 2014 at 11:45 am on the Lincroft Campus, 765 Newman Springs Road, Lincroft, NJ in the MAS building, First Floor, Room No. MAS115. B. Questions Deadline Inquiries concerning this RFP must be submitted via email or fax. Responsive Proposals Required

The College may refuse to consider proposals that fail to meet the requirements of this RFP, which may include, but are not limited to the following deficiencies: 1. Submission of an unsigned proposal 2. Submission of a proposal beyond the established date and time 3. Submission of a proposal that fails to conform to all requirements of this RFP 4. Missing or ambiguous fee proposal information It is the responsibility of each proposer to identify and address any additional requirements or information that the proposer believes may be needed in order to submit a fully conforming proposal. By submitting a proposal, the proposer accepts responsibility for understanding all pertinent requirements of the work as defined below, as well as the information required in the RFP response. SUMMARY The College is seeking Architectural and Engineering services for the renovation of nine science labs, cosmetic upgrades to four additional labs, and optional pricing for three alternate projects. Purpose and Intent Brookdale Community College is seeking a qualified architectural/engineering firm to design renovations to the Lower Level of the Main Academic South Building. The project will require renovation of nine science labs, cosmetic upgrades to four additional science labs and optional pricing for three alternates. The Firm selected must assess a broad range of programming needs and physical planning issues and propose viable alternatives for dealing with them. Included among these issues are the inclusion of flexible space that can be used for a variety of purposes, space allocations based upon function, and the development of a design that will yield the greatest return on our investment. As such, the successful Firm will have demonstrated experience in designing higher education science facilities. The successful Firm also should possess the resources and expertise necessary to evaluate the requirements of a multi-purpose facility, develop optimum space utilization for diverse populations, and provide the required infrastructure to support the renovation of an existing facility. The College desires this building to be as environmentally friendly as practicable given that this is a renovation.

Standards of Performance: Applicable Codes and Standards All investigation, specification, design, observations, and services shall be completed consistent with requirements of the New Jersey Uniform Construction Code. Firm shall identify other Codes and Standards that apply to the work, and shall ensure that any analysis and design undertaken complies with the identified Codes and Standards. Description of Proposed Work The work will consist of complete Architectural/Engineering (A/E) Services as required for functional programming, design and alterations to the Main Academic South Building (Lower Level) as described below: The chemistry labs included in this project are: general chemistry labs MAS 013, MAS 015, MAS 017, MAS 034 and MAS 021 which is an Organic Chemistry lab. All the general chemistry labs capacity will be 24 students and one faculty station with one exception. The Organic Chemistry lab MAS 021 will have a capacity limit of 12 students and 1 faculty station. These labs will be a complete demolition of current space and rebuild. Common elements for the chemistry lab renovation are: a configuration of the stations as island seating for 4 students, sinks must have GFCI outlets near sinks, impervious countertops with current utilities lowered for better line of sight. Each lab will need acid and fireproof storage cabinets, separate LCD projector and screen away from the proximity of the white boards, additional electrical capacity with data drops, wireless capabilities, and hoods need to be ADA compliant, and a handicap workstation. The biology labs included in this project are: MAS 041 Biology Independent Study Lab (add 5 computer workstations), MAS 042 General Biology Lab, MAS 045 General Biology Lab, and MAS 046 Dissection Biology Lab. Common elements for renovation will be as follows: cabinetry/casework could be refinished but utilities must be lowered on student workspace to improve line of sight, new impervious countertops, new lighting, new storage for students for books and personal items, wireless capabilities, LCD projectors and screens, vent hoods need to be ADA compliant, a handicap workstation, additional electrical outlets at workstations with data drops, built in storage for apparatus, 24 student stations and one faculty station. MAS 011 Environmental Sciences Lab, MAS 048, MAS 052, and MAS 056 Anatomy and Physiology Labs will be cosmetic upgrades which will be new lighting, flooring/carpeting and painting of the rooms. For your informational use, attached you will find Attachment G. This document has input from the Science Department faculty on desired needs to be possibly incorporated into the renovation project. Modifications to and/or supplements of existing central E/M/P/FP systems as required are included in the project scope.

The work includes documentation of existing conditions research and review of extant archival documents. The work includes interviews with appropriate College personnel as required to understand limitations of design based on existing conditions. Analysis and design of appropriate engineering systems is of paramount concern, especially with regards to interface with existing building systems. Design of modifications to the existing electrical, mechanical, plumbing, and fire protections systems as required by the addition are included within the work. Fixtures, furniture, and signage will be provided to the Owner by the A/E during Part 2 services. Telecommunications and data infrastructure information will be provided by the College’s OIT Department during Part 2 services. The A/E will be responsible for the coordination of fixtures, furniture, signage, and telecommunications systems with the building alterations. The A/E shall provide preliminary planning of these items during Part 1 services. A/E shall be responsible for all office equipment planning. A/E will be responsible for specifying disposition of demolished building materials. The College desires a recycling threshold at 75% off all non-hazardous waste materials. BCC will contract for materials testing as required to confirm the presence or absence of hazardous materials. BCC will be responsible for the abatement of hazardous materials through contracts with appropriate contractors. Alternates 1. MAS 020 Prep Room need of cosmetic upgrades – painting, flooring and lighting. 2. MAS 029/031 Learning Assistants Room improve line of sight into main lab. 3. MAS 022 Water Drainage Issues – Resolve water seepage from outside. SCOPE OF WORK Delivery Method/Form of Agreement The work will proceed under the terms of the most recent AIA Standard Form of Agreement B101 Owner/Architect Agreement. . Required Services The required Services associated with the Schematic Phase of the Project include, but are not limited to, the following: o

Provision of a detailed Project Work Plan showing major milestones for the Project. Milestones include, but are not limited to, project kick-off meeting, meetings with the project team, verification of final program, submission of schematic plans, submission of revised schematic plans, and submission of schematic construction cost estimate.

o

Schedule shall also describe estimated regulatory review and approval time, bidding, phasing, construction, and occupancy. The schedule shall indicate regular project meetings, which will be held bi-weekly.

o

Meeting with representatives of the various departments involved, including preparation of meeting minutes.

o

Review of record Construction Documents and field verification of existing site conditions, dimensions, building and HVAC systems and conditions. Special attention must be given to the existing infrastructure and the effect of construction on adjacent, occupied spaces. Special attention must be given to the investigation and documentation of E/M/P/FP systems. A/E team shall review extant information available on site, pull documents for copying, and return all originals to the original location. The College will provide a copy of all material requested by the A/E team, at no expense to the A/E.

o

Preparation of a complete and detailed Code Analysis, considering all applicable codes, licensing requirements, and regulatory agency recommendations.

o

Preparation of a complete and detailed engineering narrative, describing anticipated effects of the alterations on existing building infrastructure.

o

Development of a Functional Space Program, complete with adjacency diagrams and area information.

o

Using the approved program to develop up to three (3) schematic plans, which will include locations of furniture, office equipment, and fixtures. The schematic design solutions must address all relevant code and regulatory requirements.

o

Provision of outline specifications based on the approved schematic package.

o

Using the approved Schematic Design submission, development of schematic Construction Cost Estimate (CCE), in CSI format. CCE shall include construction costs, overhead and profit, new equipment and furniture. CCE shall be prepared by a qualified, professional estimator, and the accepted schematic CCE will be used to determine the Fixed Limit of Construction Cost.

o

Provision of all submitted drawings, budgets, schedules, and documents to the College on CD. All drawings shall be in AutoCAD format. All schedules, correspondence, reports, specifications and budgets shall be in Microsoft Office 2010 format (MS Project, Word, and Excel).

o

The required services associated with the balance of the project include, but are not limited to, the following:

o

Upon acceptance of the schematic submission, provide full scope A/E services for the project, including design development, finish selections, coordination of furniture planning, office equipment planning, construction documents, and administration of the contract of construction.

o

Construction documents shall include impact drawings, describing the anticipated effect of utility shutdowns required for construction on systems affecting other areas of the structures.

o

Develop Project Manual in CSI format, in consultation with appropriate BCC departments. Specifications shall be edited and modified expressly for this project, and they shall not alter or conflict with boilerplate material provided for the project by BCC.

o

Develop necessary engineering and architectural details in the Construction Documents. Develop construction costs estimates, in CSI format. Assist Construction Manager with value engineering efforts.

o

Prepare documents, attend meetings, submit reports, and perform other services required to represent BCC in securing approvals, license, and final Certificate of Occupancy from regulatory agencies.

o

Provide bid phase and construction administration services in accordance with the terms and conditions of the RFP and the Agreement Between Owner and Architect,

o

Provide closeout phase services, including, but not limited to, submission drawings, budgets, schedules, and documents on Compact Disk. All drawings shall be in latest AutoCAD format. All schedules, correspondence, reports, specifications, and budgets shall be in Microsoft Office 2010 format.

Required Services-Related Information The Architect shall coordinate moveable furniture locations and schedules that will be approved by the College during Part 2. The Architect shall coordinate fixed casework locations and schedules with the fixed casework contractor, should a fixed casework contractor be used for the project. The Architect shall show fixed casework and moveable furniture information on the A/E drawings. During the Construction Phase, the Architect shall conduct bi-weekly meetings held at the site. Meeting minutes for meetings must be issued within five (5) working days of the meeting. Time, when stated as a number of days, shall be calendar days including Saturdays, Sundays and holidays. AIA Layering Standards for CAD drawings shall be used by the A/E in the preparation of all “as-built” conditions drawings based on the as-built drawings submitted by the Construction Manager. Electronic Media The Architect shall provide copies of all drawing and document files to Owner on compact disk at closeout of the project. The files shall be provided at no additional expense to the

Owner, and the Architect shall not be entitled to any release or waiver as a condition of provision of files. Relationship of This Section to Agreement Note that the above list of activity supplements, but does not supersede or replace requirements of the executed Agreement. TERM AND TERMINATION The College views the work as a Two Phase Project so the term will likely be one year. The College reserves the right to terminate this contract upon 30 days advance written notice. CRITERIA FOR SELECTION In determining the firm best suited to perform the necessary services for the College, the reputation, its size, its experience, and the relative cost of services, will all be taken into account. The College will select the firm that in the College’s sole judgment provides the most advantageous combination of qualifications and price. Firms will be evaluated on the following criteria: o Expertise, experience, and qualifications of the proposed personnel in providing services as it is related to the Scope of Work. (35%) o

Soundness and creativity of the phased approach and its ability to meet the established needs of the College for this project. (35%)

o

Fee proposal. (30%)

FORMAT OF RESPONSE A.

Contents of Proposal The proposer’s written proposal shall include the following: 1. Identification of the office and team who will perform the services, a résumé of their professional background and accomplishments, number and composition of staff and their respective years of experience. 2. Firm’s experience in the areas described above, specifically describing any recent higher education and/or public sector experience, and a list of relevant clients, past and present, to be used as references. 3. A general discussion of the scope of the service to be provided, with reference to the scope of work set forth in this RFP. 4. A brief summary of why your firm is most qualified and should be selected.

5. Other information as the proposer shall deem appropriate. 6. Fee Proposal Form (Attachment A1, A2) 7. Includes a work plan to be used for the project and time schedule for completion of each of the tasks of the project, including the anticipated review time and the overall project time. B.

Required Forms Attachment A: Ownership Disclosure Form - All corporations or partnerships submitting a proposal must include a completed Ownership Disclosure Form with their proposal. Attachment B: RFP Certification Form - All proposers must sign the RFP Certification Form and include a copy of their current Business Registration Certificate issued by the State of New Jersey, Department of Treasury. Attachment C: Mandatory Equal Employment Opportunity Language - All proposers must sign and return the Mandatory Equal Employment Opportunity Language Form. Attachment D: Equal Employment Opportunity Information Form must be completed and returned with the proposal. Attachment E: Disclosure of Investment Activities in Iran Attachment F: Addendum Acknowledgement Record must be signed and returned with the proposal. Attachments G-1, G-2: Fee Proposal must be completed and included with the proposal.

FEE PROPOSAL The proposal shall include any account option(s) that may be available for proposed services to the College. The fee schedule shall include fees related to: schematic design phase, construction document phase, bid selection phase, and construction administration phase (see Attachment G-1 and G-2). The response should also include unit pricing for all reimbursable items and provide a schedule of standard hourly billing rates for employees, consultants, subcontractors, etc. which can be used for the calculation of fees for any additional services requested and authorized by the owner. Hourly billing rates submitted shall remain constant over the life of the Contract; they shall not be subject to escalation or adjustment.

BACKGROUND INFORMATION ON THE COLLEGE Brookdale Community College was established in 1967 as a unit of the New Jersey Master Plan for Higher Education, and became part of a statewide network of 19 county colleges. The College offers pre-baccalaureate preparation (A.S. and A.A. degrees) as well as programs and certificates, which are designed to prepare students for employment (A.A.S. degrees). The College also maintains a comprehensive Business and Community Development operation, which provides lifelong learning opportunities to the citizens and businesses of Monmouth County. The College opened its doors to students on September 29, 1969. The College is centered on the main campus in Lincroft, New Jersey, on the site of the former Brookdale Farm. The main campus is spread across more than 200 acres of woodlands and rolling hills and includes 27 buildings comprised of classrooms, library, theatre/auditorium, student center, bookstore, athletic arena, dining services, administrative offices, maintenance facility, day care center, and the Monmouth Museum. The College also operates the Freehold Campus, as well as four Higher Education Centers (HECs) located throughout Monmouth County in Neptune, Wall, Long Branch, and Hazlet. Offerings at these sites include GED preparation, Adult Basic Education, English as a Second Language, and a variety of credit courses. Additionally, the College leads the Communiversity, an alliance of six New Jersey higher education institutions offering select associate, bachelors and master degree programs in Monmouth County. INSURANCE The Contractor shall secure and maintain in force for the term of the contract liability insurance as provided herein. The Contractor shall provide the Owner with current certificates of insurance for all coverage’s and renewals thereof, naming the Owner as an Additional Insured and shall contain the provision that the insurance provided in the certificate shall not be canceled for any reason except after thirty days written notice to the Owner. The insurance to be provided by the Contractor shall be as follows: a. Comprehensive General Liability Insurance or its equivalent: The minimum limit of liability shall be $1,000,000 per occurrence and a $2,000,000 general aggregate with an excess umbrella of $3,000,000 as a combined single limit for bodily injury and property damage. The above required Comprehensive General Liability Insurance policy or its equivalent shall name the Owner, its officers, and employees as Additional Insureds on a primary and non-contributory basis. The coverage to be provided under these policies shall be at least as broad as that provided by the standard basic, unamended, and unendorsed Comprehensive General Liability Insurance occurrence coverage forms or its equivalent currently in use in the State of New Jersey, which shall not be circumscribed by any endorsement limiting the breadth of coverage.

b. Automobile liability insurance which shall be written to cover any automobile used by the insured. Limits of liability for bodily injury and property damage shall not be less than $1,000,000 per occurrence as a combined single limit. c. Worker’s Compensation Insurance applicable to the laws of the State of New Jersey and Employers Liability Insurance with limits not less for (Each Accident $500,000; Disease – EA Employee $500,000 and Disease – Policy Limit $500,000) Contractor agrees to name Brookdale Community College as an additional insured on a primary and non-contributory basis. Contractor also agrees to save and hold harmless Brookdale Community College, its departments, agencies, boards, commissions, officers, officials, agents, servants, administrators, and employees (“indemnitees”), from and against any and all liability arising out of this contract, whether such liability is direct or vicarious. Contractor further agrees to indemnify and hold harmless any all “indemnitees” for their own negligence, regardless of whether such negligence is responsible wholly or in part for the damages suffered. This provision shall be construed as broadly in favor of indemnification as permitted by New Jersey law." OTHER MATTERS A.

Prohibited Communications Except as and to the extent specifically provided for in this RFP, communications regarding the subject matter of this RFP between any potential vendor, service provider, bidder, offeror, lobbyist or consultant and any Trustee, employee or administrator of the College, at any time prior to contract award, are prohibited! Permitted communications shall be limited to the following:     

Public Records Proposers are advised that the College is subject to the New Jersey Open Public Records Act (OPRA) and that it is likely that all material submitted in response to this RFP is likely to be deemed a “government record” pursuant to the Act and therefore required to be made available for public inspection and copying. If any proposer deems any material to be within any exemption to the Act (exemptions are listed at http://www.state.nj.us/grc/public/exempt) and not a “government record,” it shall so indicate on each page of the proposal that it believes to contain such information. In the event a request is made under OPRA for any such identified information, the College shall refuse such request; however, if proceedings are then brought to enforce a 11

requester’s right under OPRA with respect to such material the proposer shall be required to indemnify, defend, and hold the College harmless as to all costs and expenses including legal fees, fines and penalties, that may arise or result from the College’s denial of any such request. C.

Pay to Play Compliance In accordance with the New Jersey “Pay-to-Play” statute, N.J.S.A. 19:44A-20 et. Seq. (P.L. 2005 c. 271) proposers are advised of the responsibility to file an annual disclosure statement on political contributions with the New Jersey Election Law Enforcement Commission (“ELEC”) pursuant to N.J.S.A. 19:44A-20.13 (P.L. 2005, c.271, s.3) if the vendor receives contracts in excess of $50,000 from public entities in a calendar year. It is the vendor’s responsibility to determine if filing is necessary. Additional information on this requirement is available from ELEC at 888 313-3532 or at www.elect.state.nj.us.

Conflict of Interest If a firm responding to this solicitation knows of any material personal interest, direct or indirect, that any member, official or employee of the College would have in the contract resulting from this solicitation, the firm must disclose this to the College. Persons submitting a response to this RFP must comply with all applicable laws and regulations of the State of New Jersey.

Time Time, when stated as a number of days, shall be calendar days including Saturdays, Sundays, and holidays.

Effect of Reviews and Approvals by the College No review, approval, or acceptance by the College, or any person or entity on its behalf, for any deliverable furnished by the College’s selected contractor for any purpose, shall operate to relieve the contractor of its sole and exclusive responsibility for the performance of all required services in accordance with the Agreement, applicable laws, codes and regulations, and prevailing professional standards of care.

G.

Responsibility for Costs Under no circumstances, whether or not any contract is awarded, will the College be responsible for any costs incurred by any person or entity responding to this RFP. If any proposer or prospective proposer brings a legal challenge to any action of the College in connection with any aspect of this procurement and the College is deemed the prevailing party in said action, the proposer shall be responsible for the payment of all costs and fees incurred by the College in connection with any such action including reasonable counsel fees.

Rejection of Proposals and Waiver of Irregularities

The College reserves the right to reject any or all proposals or to waive any irregularities or informalities in any proposal, to the maximum extent of discretion allowed it by applicable law and as it may deem in its interest. I.
