Election Notice

Ballots to elect candidates to the Permanent Board of Directors to the Harris Branch Residential Property Owner’s Association (HBRPOA) will be mailed the first week of March. It is imperative that each member return their ballot in a timely manner. About Directors: • Directors must be members of HBRPOA and do not receive compensation. Generally, the owner(s) of a lot in Harris Branch (“HB”) are members of HBRPOA. • Terms of directors are: 3 directors are elected for 2-year terms, and 2 directors are elected for 1-year terms, following the annual meeting and the initial election of directors in March of 2006. • Directors must meet at least quarterly every year. • Officers, such as president, secretary, etc., are elected by the board of directors at their first meeting. • With certain exceptions, meetings of the board of directors are open to all members of the HBRPOA. • Directors have broad powers to make decisions for Harris Branch and are able to contract management of HBRPOA to outside vendors. Voting Process: • The board of directors will be made up of five directors. • Members owning a lot in Harris Branch have five votes, one vote allotted for each director. • Cumulative voting is not allowed. This means that each of the five votes has to be cast for a different candidate. For example, all five votes cannot be cast for one candidate. • The candidates that receive the most votes are declared the winners.

Homeowner Association Dues

As a reminder, 2006 Homeowners Association Dues in the amount of $347.83 were due January 31, 2006. Homeowners delinquent in their payments will be assessed a $15.00 late fee each month for payments received after January 31, 2006. By accepting a deed to your property, you have contractually agreed to the payment of the annual HBRPOA dues and any special assessments levied during a given year. All overdue assessments are subject to legal action for collection and the delinquent accounts will be pursued. To ensure that funds received for 2006 dues are available to the Permanent Board after transition of the management of the Association, a secure lockbox was established. Nominating Committee

On February 7th, 2006, a meeting was held at the Harris Branch Rec. Center to establish a Nominating Committee to administer the election of the Permanent Board of Directors to the Harris Branch Residential Property Owner’s Association (HBRPOA). The Nominating Committee shall be made up of a chairman (who is a current Board member or appointee) and 3 or more members of the HBRPOA (Article III, Section 4 of Bylaws). Generally, the owner(s) of a lot in Harris Branch (“HB”) are members of HBRPOA. The Nominating Committee will receive candidate information/biography, compile list of all candidates, prepare, distribute and collect ballots and tally voting results.

As reported at recent HBRPOA Assistance Committee meetings, the Developer has repaired the lighting at the entrance to Speyside and the exterior lighting at the Rec. Center, resulting in a better-lit and safer environment for users of the facility and bus stop. The Interim Board would like to remind folks that maintenance issues such as these should continue to be reported to the Developer for resolution until the responsibilities of managing the residential property owners association are transitioned. The Interim Board continues to work with the Developer to obtain information necessary to prepare for the transition. All information gathered during this stage will be handed off to the Permanent Board for their use in the ongoing management of the Association. The Interim Board continues to meet with, and evaluate proposals from, residential property association management companies. The Interim Board will compile their findings for use by the Permanent Board. Spring Garage Sale

Harris Branch

As mentioned in the February issue of this newsletter, responsibility for the coordination of the bi-annual garage sale has recently transitioned to the Activities/Events/Planning Sub-Committee of the Harris Branch Residential Property Owner’s Association Assistance Committee. In that newsletter, an urgent plea was issued for volunteers to assist with the sub-committees. We again seek volunteers willing to coordinate community events, such as the garage sales. If no one comes forward, the Spring garage sale will be canceled. We’ll continue to solicit support in hopes that there will be more interest in the Fall. After 14 years of writing, printing, folding and mailing, Joyce Best is finished with the newsletter business. Joyce is a resident of Lakeview South and over the years has given countless hours of her personal time in the preparation and distribution of the Harris Branch Homefront newsletter. Responsibility for the newsletter has recently transitioned to the Communication/Education/Newsletter Sub-Committee of the HBPROA Assistance Committee, giving Joyce a much-deserved break. Thank you Joyce for your many years of service and all that you continue to do on behalf of the residents of Harris Branch. Upcoming Meetings

The HBRPOA Assistance Committee will meet February 28, March 14, and March 28, 2006, at 7:00 p.m. Meetings are held at the Harris Branch Rec. Center. Attending the meetings is a great way to stay up-to-date on the happenings within the neighborhood, learn the latest news regarding the transition to a homeowner-managed association and meet fellow residents. Seating options in the Rec. Center are limited, so please bring your own chairs.

by Jeremiah Bentley As we transition to a homeowner-managed association, communication is very important. One way that you can keep up with what is going on is to sign up for the Harris Branch Yahoo! Group. Members of the group receive meeting agendas and notes and reminders of the twice-monthly Assistance Committee meetings. To sign up for the group, go to groups.yahoo.com and type “Harris Branch” (use the quotation marks) into the Find a Group box. Click on the group name on the next screen, and then click “Join This Group.” You will need to be signed into Yahoo! in order to sign up for the group. A Yahoo! ID is free.

CC&R Reminders

by Jeremiah Bentley Most residents of Harris Branch do a fine job in maintaining their property. However, there are some issues that repeatedly appear. We wanted to take this opportunity to share with you a few of the most common CC&R violations observed throughout Harris Branch to educate residents who may not even know that they are in violation of a restriction. • Garbage cans. All garbage cans shall be located or screened so as to be concealed from the view of neighboring homes and streets. All rubbish, trash and garbage shall be stored in appropriate containers and shall not be allowed to accumulate. • Parking. Vehicles should be parked only in the garages or driveways of residences. • Lighting. Seasonal decorative lights may be displayed only between Thanksgiving and January 10. If you wish to report a violation, complaint forms are available on the Harris Branch Yahoo! group. They can also be obtained from the current Harris Branch Residential Property Owners Association (HBRPOA). Mail completed forms to the HBRPOA at 3018 North Lamar, Suite 201, Austin, TX 78705. One final note: Although it is not a rule of the Association, Austin City Ordinance 3-3-7 states that “It shall be unlawful for any person to fail to promptly remove and dispose of, in a sanitary manner, feces left by a dog or cat being handled by that person on property, public or private, other than the premises of the owner or handler of such dog or cat.” Violators are subject to a fine of up to $86.

Volunteers Needed

The Harris Branch Homeowner Association Assistance Committee continues to meet on the second and fourth Tuesday of each month at 7:00 p.m. at the Recreation Center. While there are close to 30 members signed up for the Assistance Committee, a very small number of folks have volunteered to serve on a sub-committee. Volunteers are URGENTLY needed. Please take a moment to review the descriptions of the sub-committees below to determine where you may be able to assist. Please keep in mind that attendance at every meeting or participation in every project is not expected or required. Much of the activity can be accomplished via email or phone communication. Any level of assistance will be appreciated and welcomed. Communication/Education/Newsletter Sub-Committee Responsible for: newsletter content; communication of Homeowner Association announcements; and information sharing. Activities/Events/Planning Sub-Committee Responsible for: coordination of the biannual garage sale; planning community events; and mobilization/rallying in response to issues that may impact our neighborhood (landfill expansion, annexations, etc.).
