NEWPORT-MESA UNIFIED SCHOOL DISTRICT REQUEST FOR PROPOSAL #110-13 Student Assessment & Data Analysis System (SADAS) REQUEST FOR PROPOSAL Notice is hereby given that proposals will be received at the Purchasing Office of the NewportMesa Unified School District for qualified independent firm or individual fully qualified to provide services related to a student assessment & data analysis system. Proposals shall be delivered no later than 2:00:00 P.M. on Monday, April 15, 2013 and addressed to the Newport-Mesa Unified School District, Attn: Purchasing Department, 2985 Bear St., Bldg. B, Costa Mesa, CA. 92626, and labeled “Student Assessment & Data Analysis System”, RFP 110-13. Any proposals received after the scheduled submittal deadline will be returned unopened. Firms submitting proposals must have substantial and verifiable experience in performing services related to a student assessment & data analysis for School Districts comparable to or larger than Newport-Mesa Unified School District. INSTRUCTIONS/INFORMATION TO PROPOSERS DUE DATE. Proposals must arrive in the Newport-Mesa Unified School District Assessment Office by mail, 2985 Bear St., Bldg. B, Costa Mesa, CA. 92626 by the date due shown above in the Request for Proposal. EXTENSION OF DATE DUE AND/OR TIME. The Newport-Mesa Unified School District reserves the right to extend the Date Due and/or time when it is in the best interest of the Newport-Mesa Unified School District. MANDATORY DOCUMENTS. FIRM PROPOSAL. Prices submitted shall remain firm for period of (90) days from the Date Due, unless otherwise specified in the Request for Proposal (RFP).

INFORMED PROPOSERS. Before submitting proposal, proposers must fully inform themselves of the conditions, requirements and specifications of the work, services or materials to be furnished. Failure to do so will be at proposers’ own risk and the proposer cannot secure relief on the plea of error. INK OR TYPEWRITTEN. All information, prices, notations, signatures, and corrections must be in ink or typewritten. Mistakes may be crossed out and corrections typed or printed adjacent to the mistake and initialed in ink by the person signing the proposal. QUESTIONS. Questions about the proposal documents should be directed to the Assessment Director, George Knights, and can be done through email at [email protected] or by calling (714) 424-7551. RESULTS. A tabulation of the proposals received will be available within a reasonable time after the date due. Results will be faxed or mailed to interested parties upon request. RESPONSIBILITY. Proposers are solely responsible for ensuring their proposal is received by the Newport-Mesa Unified School District in accordance with the solicitation requirements before the date and time specified in the RFP, and at the place specified. The Newport-Mesa Unified School District shall not be responsible for any delays in mail or by common carriers or by transmission errors or delays or mistaken delivery. Delivery of proposal shall be made at the office specified in this RFP. Deliveries made before the date due and time but to the wrong Newport-Mesa Unified School District office will be considered non-responsive unless redelivery is made to the office specified before the date due and time specified in the RFP. SIGNATURE. To be considered for award, each RFP shall be signed by an authorized representative of the proposer. TERMS OF THE OFFER. Newport-Mesa Unified School District’s acceptance of Proposer’s offer shall be limited to the terms herein unless expressly agreed in writing by the NewportMesa Unified School District. Proposals offering terms other than those shown herein will be declared non-responsive and will not be considered. DISTRICT INFORMATION. The District Office is located at 2985 Bear St., Costa Mesa, CA 92626. The District employs approximately 1,629 full time employees, and approximately 800 part time employees. This does not include substitute employees. District enrollment is approximately 22,000 students in 30 K-12 schools, including elementary, intermediate and high schools. The District General Fund budget is approximately $230 million with a total of $259 million in all funds, combined. Newport-Mesa Unified School District provides services to school sites within Orange County and operates educational programs for special populations of students. Services provided to the District include administrative, fiscal, personnel, transportation, maintenance and operations, information technology, media, curriculum, staff training, nutrition, health, psychological and governmental relations. TERMS AND CONDITIONS ASSIGNMENT OF RIGHTS OR OBLIGATIONS. Successful Proposer may not assign, transfer or sell any rights or obligations resulting from this proposal without first obtaining the specific written consent of the Newport-Mesa Unified School District. CANCELLATION OF SOLICITATION. The Newport-Mesa Unified School District may cancel this solicitation at any time. COMPLIANCE OR DEVIATION TO SPECIFICATIONS. It is understood that the services offered by the proposer will meet all requirements of the specifications in this Request for Proposal (RFP) unless deviations there from are clearly indicated in the pages of this solicitation, or in an attachment entitled “Exceptions to Specifications” submitted and signed by proposer’s authorized representative. In order for the proposal to be considered, an explanation must be made for each item in which an exception is taken, giving in detail the extent of the exception and the reason for which it was taken. LAWS GOVERNING THIS CONTRACT. This contract shall be in accordance with the laws of the State of California, County of Orange. Parties further stipulate that this contract was entered into in the County of Orange and the State of California is the only appropriate forum for any litigation resulting from breach hereof or any questions arising herefrom. RIGHTS RESERVED. A. Rejection. The Newport-Mesa Unified School District reserves the right to reject any or all proposals or any part thereof. Or to accept any proposal or any part thereof, or to waive any informalities in any proposal, whenever it is deemed to be in the best interest of the Newport-Mesa Unified School District. The Newport-Mesa Unified School District also reserves the right to reject the proposal of any proposer who has previously failed to perform adequately for the Newport-Mesa Unified School District or any other governmental agency. B. Severability. If any provision or any portion of any provision, of any contract resulting from this proposal shall be held invalid, illegal, or unenforceable, the remaining provisions or portions of any provisions shall be valid and enforceable to the extent possible. AWARD OF CONTRACT/ASSIGNMENT. No contract awarded under this Proposal shall be assigned. TERMS OF THE CONTRACT. The terms of the contract shall be limited to the terms herein unless expressly agreed otherwise in writing by the Newport-Mesa Unified School District. The Term of the Contract is subject to the terms and conditions of the AGREEMENT and the RFP, for up to a maximum of five years after Board of Education approval.

SCOPE OF WORK Through this RFP, NMUSD looks to enter into a contract with a qualified Proposer to provide a comprehensive web-based Student Assessment and Data Analysis System (SADAS). The SADAS should have the following capabilities: Student Information 1. Student information will be supplied by NMUSD from the NMUSD Student Information System. Student data should be uploaded nightly via automated scripts created and supplied by the vendor. Uploaded data should be available the next school day. NMUSD currently uses AERIES as its student information system. 2. NMUSD shall have the flexibility to add new data points as needed. 3. Summer School students will be considered as a normal upload of Student Data. 4. All student data shall be connected to the student over time. 5. The vendor must host the data at their site. The vendor must guarantee the safety of the data by providing dedicated hardware firewalls, virus protection, and offsite backup. The vendor must also supply a secure FTP link (minimum 128-bit encryption) for the uploading of confidential student data. The vendor must adhere to all rules and regulations related to the protection of confidential student information as described in FERPA and NMUSD student confidentiality Board Policies. 6. System must have a student/parent portal. 7. All data and user created materials will remain the property of NMUSD. Should the relationship of NMUSD and the vendor end, the vendor must surrender the data including NMUSD created materials in an electronic form acceptable to NMUSD. State and National Testing Results 1. Host historical State testing results (STAR program – CST/CMA/CAPA/STS, CELDT, CAHSEE, Common Core Standards, Smarter Balanced Consortium Assessments) dating back to 2002-03. District will provide data files. Data must be able to be utilized with reporting features. 2. Upload and host current/future State and National testing results within 7 business days of receipt of data from the district with the ability to utilize with reporting features. 3. CELDT results data aggregated by school year of test (and not by month of test). 4. CAHSEE results data aggregated by school year of test (and not solely by date of test). 5. Host District and teacher assessment results, including third party products such as DIBELS, Renaissance Learning products and other publisher’s test results. District/Teacher Generated Tests 1. Must include a mechanism for creating scanner-readable and web camera-readable answer sheets for District and classroom level assessments. The answer sheets should be plain paper based (not proprietary) and read/scanned using a web or document camera. 2. SADAS and electronic input systems integration (i.e., document cameras, remote responders, tablets, smart phones, etc.) is required. 3. Other options for data entry in the SADAS must include manual sheet fed scanning and file loading. 4. Must include the ability to create tests with a variety of questioning modalities within RFP# 110 -- 13 Student Assessment and Data Analysis

one exam. 5. Must include the ability to create multiple versions of the same test. 6. Must include the ability to generate answer sheets and accurately reads/scan scores for both short and long answer responses in addition to multiple choice items. 7. Must allow users to link test items to the Common Core Standards and California State Standards in all available content areas. 8. Must allow users to create question groups or clusters for data reporting. 9. Must allow users to set performance level thresholds based on raw scores and percent correct for data reporting. 10. Must allow users to modify answer keys after assessments have been scanned, if necessary, and the reports should be automatically updated. 11. Must include a mechanism to keep individual and teacher created tests separate from district-wide benchmark tests. 12. Must include the ability to move/copy tests to various folders or locations. 13. Must include the ability to keep tests private to a particular user/group or public to all users. 14. Must include the ability to host a file of an exam for download by various users. 15. Must include the ability to create and host district created test bank items for use by all users. 16. Must include access to test bank items offered through the proposing company or affiliated vendors. 17. Assessments and other documents must be able to be shared across school sites and users. District personnel must be able to access all assessments. 18. Must allow users to easily apply filters to report columns with minimum steps required. Reporting Capabilities 1. Report features must include reports at the student, classroom, teacher, school, and district levels for all national, state, local and teacher assessment data hosted in the SADAS 2. Pre-built reports include various CAHSEE, CELDT, CST, Accountability, class roster reports, and student profiles. 3. SADAS vendor must be willing to add pre-built reports recommended by District. 4. Reports must cross-compare student assessment results with results for the District, school, classroom, state, and teacher; including student transcript data (grades and course enrollment). 5. Reports must look professional using a variety of charts, tables, graphs and colors. 6. Reports on multiple measures must be available. The number of assessments available to report out is preferred to be unlimited and should extend through state, national, district and teacher created assessments. 7. User must be able to create disaggregated reports based on a wide variety of criteria. Such criteria would include but is not limited to gender, ethnic background, socioeconomic status, grade level, courses, educational programs, etc. 8. SADAS should be set up for ad hoc reporting and also contain an extensive number of pre-built reports. 9. SADAS must be able to store user built reports for easy recall and updating. 10. SADAS must be able to create item analysis and other statistical reports to analyze the reliability of exams. 11. SADAS must include longitudinal reporting capabilities.

Technical Criteria 1. The SADAS must be available over the Internet to District teachers, administrators, and other authorized staff. Access to the database should be validated by the use of a user name and password via a secure (encrypted) website. 2. A mechanism must be available to a district administrator to customize access to the data based on the user’s educational needs. A district administrator must be able to see the data from all schools. A building administrator must be able to see the data from all students within the school. Teachers must be able to see the data of students currently rostered to them in the Student Information System. Mechanisms that granulate access down to the individual student level are required. 3. The SADAS must utilize an integrated ETL (extract, transform, and load) tool. 4. The SADAS must utilize an integrated Business Intelligence Tool. 5. Must integrate with GradeCam web camera document scanning, and must have had fully functional GradeCam web camera integration for at least one year. 6. The SADAS must use Web 2.0 technologies. 7. The system should feature an easy to use permission management allowing users to see data based on their assigned permission levels. Management of system usernames, passwords should be facilitated in the system with online tools to enable the district to manage all users and their passwords. 8. Currently NMUSD uses DATA DIRECTOR as its SADAS. It will be expected that any new SADAS be able to import data exported out of DATA DIRECTOR. 9. The SADAS must include an online help link with detailed printable descriptions of all features, and online video clips for training. 10. Read/Scan solution needs to be able to utilize either a Windows- or Macintosh-based system. 11. It is expected that scanners be TWAIN compliant. 12. System users must be able to go back to previous roster years to find data. For example, a teacher should be able to see how his or her previous year’s students performed on State assessments. 13. The interface for accessing reports and data must be easy-to-use and intuitive. 14. The system should feature an easy to use permission management allowing users to see data based on their assigned permission levels. Management of system usernames, passwords should be facilitated in the system with online tools to enable the district to manage all users and their passwords. 15. The SADAS must include an online helpdesk ticket system. 16. Users must experience an intuitive, easy to use Graphical User Interface (GUI). 17. Reports from the SADAS should be able to be exported as a pdf, tab-delimited, or Excel spreadsheet formats. It is preferred that the formatting of the report remain the same when exported. 18. The initial database setup should be complete and the system in full operation by June 1, 2013, ready to accept 2013 STAR test data. 19. The Proposer will provide at no cost to the District all updates to the SADAS including but not limited to maintenance releases, major revisions, completely new systems that perform to these specifications that the proposing company releases during the length of this contract. 20. The SADAS must allow student response system data to be uploaded into assessments. 21. The SADAS must have a customizable dashboard (with graphs, charts, and tables) with customization at the user level (i.e., teachers may view CST, CAHSEE, CELDT, RFP# 110 -- 13 Student Assessment and Data Analysis

District benchmark, and their own assessments summaries on their dashboard; whereas administrators may have schoolwide data displayed on the dashboard). Experience 1. Key training team and account managers must have recent K-12 public school teaching or public school district administrative experience. 2. Preferred training and/or account management team members have previously served in district-level assessment and evaluation positions. 3. Training team based in Southern California. 4. Must have experience working with California schools’ data and accountability systems for five (5) or more years. Customer Support 1. 2.

Customer service calls made to the SADAS by NMUSD should require no more than five (5) minutes wait time before connecting to a live technical support person. Staff development/training to successfully implement the SADAS will be specified (Costs, labor hours, description) in the FEE SCHEUDLE.

EVALUATION CRITERIA Proposals will be evaluated by the Newport-Mesa Unified School District K-12 Assessment, Fiscal Services and Purchasing Departments. Newport-Mesa Unified School District reserves the right to reject any or all proposals, and will solely determine award. The proposals received will be evaluated according to the following: 1. Prior experience of the proposer for the work at other educational organizations. (20%) 2. Availability to begin the service by July 1st, 2013. (10%) 3. Ability of the firm to provide services that meet the scope of work requirements contained in this RFP and that meet the needs of NMUSD. (40%) 4. Cost of the service. ERRORS AND OMISSIONS If a proposer discovers any ambiguity, conflict, discrepancy, omission, or other error in the RFP, he shall immediately notify the District of such error in writing and request clarification or modification of the document. Modifications will be made by addenda. Such clarification shall be given by written notice to all parties who have been furnished an RFP for proposing purposes, without divulging the source of the request for same. Insofar as practicable, the District will give such notices to other interested parties, but the District shall not be responsible therefore.

If a proposer fails to notify the District prior to the date fixed for submission of proposals of an error in the RFP known to him, or an error that reasonably should have been known to him, he shall propose at his own risk; and if he is awarded the contract, he shall not be entitled to additional compensation or time by reason of the error or its later correction. The proposer should carefully examine the entire RFP and early addenda thereto, and all related materials and data referenced in the RFP or otherwise available to him, and should become fully aware of the nature and location of the work, the quantities of the work, and the conditions to be encountered in performing the work. CONTACTS FOR INFORMATION. Proposers may contact the Director of Assessment, George Knights, for visits to the District for purposes of familiarization and evaluation of the current processes or to obtain any additional information needed. Visits shall be made by appointment only during normal business hours. Visits will be permitted to the extent that they do not unduly interfere with the conduct of business. Oral communications by departmental officers and employees concerning the RFP shall not be binding on the District and shall in no way excuse the proposer of these obligations as set forth in this RFP. PROPOSER AGREEMENT. In compliance with this Request for Proposal, the proposer will propose and agree to furnish all labor, materials, transportation, and services for the work described and specifications and for the items listed herein. A proposal is subject to acceptance at any time within sixty (60) days after opening of same, unless otherwise stipulated. Proposals cannot be corrected, altered, signed or withdrawn after public opening. PROPOSAL SIGNEE. If the proposer is an individual or an individual doing business under a firm name, the proposal must, in addition to the firm name, be signed by the individual; if the proposer is a partnership, the proposal should be signed with the partnership name by one of the partners; if a corporation, with the name of the corporation by an officer authorized to execute a proposal on behalf of the corporation. PROPOSER’S UNDERSTANDING. It is understood and agreed that the proposer has, by careful examination, satisfied himself as to the nature and location of the work, the character, qualify and quantity of the materials to be encountered, the character of equipment and facilities needed preliminary to and during the prosecution of the work, and general and local conditions, and all other matters which can in any way affect the work under this contract. No verbal agreement or conversation with any officer, agent or employee of the District, either before or after the execution of this contract, shall affect or modify any of the terms or obligations herein contained. INTENT OF PLANS AND SPECIFICATIONS. All work/services that may be called for in the specifications shall be executed and furnished by the successful proposer and should any work/services or materials be required which is not denoted in the specifications or plans, either directly or indirectly but which is nevertheless necessary for the execution of the contract, the proposer is to understand the same to be implied and required, and shall perform all such work and furnish any such material as fully as if it were particularly delineated or described. EXTRA WORK. No bill or claim for extra work or materials shall be allowed or paid unless the doing of such extra work or the furnishing of such extra materials shall have been authorized in writing by the District.

INDEMNITY. The proposer shall indemnify and hold harmless the District from and against all losses and all claims, demands, payments, suits, actions, recoveries and judgments or every nature and description brought or recovered by it, by reason of any act or omission, of the said proposer, his agents or employees, in the execution of the work or in consequences of any negligence or carelessness regarding the same. The District shall have the right to make any changes that may be hereafter determined upon, in the nature or dimensions of the work, either before or after its commencement, and such changes shall in no way affect or void the obligations of this contract. If such changes make change in the cost of the work, an equitable adjustment shall be made by the District to cover said cost. DISPOSITION OF PROPOSALS. All materials submitted in response to this RFP will become the property of the District, and will be returned only at the District’s option, and at the proposer’s expense. The original copy shall be retained for official files and will become a public record after the date and time for Final Proposal submission as specified. However, confidential information submitted in support of the requirement will be returned upon request.
