New Laws to Expand Ban on Smoking in Workplace in June

New Laws to Expand Ban on Smoking in Workplace in JuneWhat is the law in California about smoking in the workplace? California employers may not knowingly or intentionally permit the smoking of tobacco products at a place of employment or in an enclosed space. This prohibition includes permitting non-employees to smoke in an enclosed workplace. When the smoking in the workplace ban was first enacted, there were exemptions in place for certain employers and specified working environments.

this month will change some of the workplace rules relating to smoking in the workplace and eliminate most of these specific exemptions. The amendments take effect beginning June 9, 2016. The bills making the changes are ABX2 7 (M. Stone; D-Scotts Valley), SBX2 5 (Leno; D-San Francisco) and SBX2 7 (E. Hernandez; D-West Covina). Few Exceptions to Smoking BanThe new law expands smoke-free workplace protections by getting rid of most of the existing exemptions that allow smoking in certain work environments.

The Claremont Chamber of Commerce provides so many opportunities for business growth. We have found that by taking advantage of the tools and encouragement they provide, we are becoming a greater organization. As the Executive Director of Dignity Group, a non-profit organization, it has been very helpful to attend the networking events where I am meeting with other businesses and individuals that I would not have a chance to meet otherwise. The speakers and attendees are from a variety of industries which has aided to our growth and development as a young, non-profit that is empowering special need families, one at a time. I truly believe, the Chamber desires to see success of businesses as much as it is our desire to become great! Grady Jennings, Dignity Group www.claremontchamber.org | Claremont Chamber of Commerce

A Letter from the

Chairman of the Board We always joke that each year comes and goes so much faster than the previous one. I can say that this year truly has come and gone much faster than I had expected it to, along with my term as the Board of Directors Chair for your Chamber of Commerce. Blink and its gone! This has been a wonderful year and the Board and Chamber staff has accomplished many wonderful things. We have had lots of mixing, red ribbon ceremonies, many laughs and most importantly we have continued to improve what we do for our members. I have firmly believed that for every dollar we donate, we will get two in return. A simple conversion can be made that for every minute we volunteer, will give us two in return. And with my time as this year’s Chair, I feel as if my time continues to be repaid tenfold. I believe that is it our responsibility to leave a lasting impression on everything we do, whether it is business, volunteerism or in life I began my term with all of the best intentions,

When it comes to sports: My husband and son watch lots of sports. Most people don’t know... I rode off-road motorcycles growing up, my family belonged to a motorcycle riding and camping club. The person I would consider my mentor... My grandmother, or Granny, as she liked to be called. She was funny and lived life to the fullest. She found the humor in everything. You couldn’t help but laugh a lot when you were around her!

If I could change professions... I love what I do, but if I changed professions, it would be to start a charitable foundation.

My ideal vacation would be... The Grand Wailea Resort in Maui – it’s beautiful.

As for my hobbies... My pets, 4 dogs and 2 cats! Music and traveling.

My favorite place to eat in Claremont is... We are very fortunate to have so many wonderful restaurants!

My favorite holidays... Christmas - and I love Christmas movies! We watch Christmas Vacation on Thanksgiving evening to kick off the season – its become a tradition. I became a Board Member... To make a difference, initiating an annual Women’s Leadership Conference, and various quarterly business education events. Being a Chamber Member... I’ve met great friends through the Chamber and it keeps me in touch with the business community. My advice to young entrepreneurs is... “If you want to be successful, it's just this simple: Know what you are doing. Love what you are doing. Believe in what you are doing. And success will surely follow.” Will Rogers

For example, the newly signed (continued from page 1)

legislation expands the workplace smoking ban to include owneroperated businesses. Before this new law, the smoking ban did not apply if you owned your own business and were the only person working there. That exception no longer exists; the law will now cover all employers, including owner operated businesses. The new law also eliminates the exception for small businesses with a total of five or fewer employees. These small businesses currently can allow smoking in enclosed areas if certain conditions are met, such as not allowing minors in the space and having proper ventilation; this practice is no longer allowed beginning June 9. Ban Expanded

8

The recent amendments further expand the workplace smoking ban by: • Eliminating the ability of employers to have designated smoking break rooms. Currently, such smoking break rooms are allowed if sufficient conditions are met. Beginning June 9, employer-designated smoking break rooms are prohibited outright. • Removing many of the exemptions for specific work environments, such as bars and taverns, hotel lobbies, banquet rooms and warehouse facilities A few limited exceptions to the ban on workplace smoking will still remain. The legislation also raises the legal minimum smoking age from 18 to 21, except for active military personnel. Vaping Prohibited The new legislation also treats the use of e-cigarettes and vaping devices that contain nicotine as “smoking”—thus ½ extending

existing workplace smoking bans to cover such products. Compliance Violation of the law subjects employers to fines of $100 to $500. With the new legislation going into effect on June 9, employers will want to examine their policies and practices to ensure compliance.
