Round Rock #4 Safest City

Among Cities Greater than 100,000 in Population

CQ Press has released City Crime R a n k i n g s 2 0 0 9 - 2 0 1 0 : Cr i m e i n Metropolitan America, and Round Rock ranks fourth among U.S. cities with a 100,000 population or greater. Round Rock is No. 1 among the 31 Texas cities with a population of 100,000 or greater included in the rankings. Round Rock improved to No. 18 overall in this year’s survey, which includes cities with at least 75,000 population. Last year, it ranked No. 19 overall. “The men and women of the Round Rock Police Department take great pride in their jobs and are committed to providing outstanding service to the community,” Chief Bryan Williams said. “Credit for this ranking must be shared with the residents, neighborhood associations and businesses we partner with every day to keep Round Rock safe. Four Years in Review I have served our community on the Forest Creek HOA Board of Directors for four years. It has been an exciting and challenging four years for our community and I would like to take this opportunity to thank those who supported and contributed to the significant accomplishments that have been achieved for our community during those years. For those who have not been in our community for long and for those who may not keep up with the HOA events, the following is a review of just a few of the events that have taken place during my watch on the Board for the past four years. Prior to my joining the HOA Board of Directors in 2006, the developer controlled the major voting block for electing Board members, the developer had annexed the additional property into the HOA (property now officially FC-III HOA), the HOA was broke and behind on their bills, and the pool facility was badly in need of major repairs. The two big issues for 2006 were raising money to improve the HOA’s financial situation and dealing with the consequences of the developer’s annexation of additional county land into the HOA. Within a year, we had raised the dues, collected most of the delinquent HOA dues and put our finances on a solid footing. The annexation issue took over two years to resolve. In the end, over 90% of the voting residents voted not to legally annex the additional land into our HOA and the developer transferred all of his authority in the Forest Creek HOA over to the resident elected Board of Directors. While the HOA received some unflattering media coverage during the struggle and we were unable to prevent the developer and builders of FC-III HOA from using the Forest Creek name, the Forest Creek HOA members did not end up paying for or supporting the community facilities in the FC-III area. Additionally, the residents of FC-III ended up with more and better facilities than were offered during the developer’s final bid for annexation; all at no cost to the residents of FC-III. (Unlike our amenities which were totally funded by our residents.) Historically, the Board only opened the pool when lifeguards were on duty. The Board instituted a “swim at your own risk” policy, like many HOAs, and substantially extended the pool season, while saving money by replacing a full time team of lifeguards with a prime-time “pool monitor”. Numerous other cost saving changes were implemented ranging from finding a cheaper supplier of electricity to switching from an expensive quarterly community newsletter to a cost free monthly newsletter. Major service contracts were changed to formal and competitive bidding. Neighborhood committees were made more accountable for how they spent HOA funds. And many other changes which all added up to substantially more effective use of HOA funds. The HOA lacked clear written rules and policies which the management company, Board and residents need to consistently and equitably deal with everything from deed restriction violations to requests to build or modify a home. We formed a full 7 member resident Architectural Review Committee (ARC) where previously, either the property manager, the developer or Board members were deciding upon ARC applications and variances, with few written guidelines and little consistency. Four Years - (Continued from Page 2) which are used today to provide guidance to homeowners and consistency during review, approval and enforcement. The HOA records were just boxes of eclectically gathered documents. Today they are electronically imaged and filed so that they can be easily found, referenced, and used as needed. This has proven to be invaluable in dealing with the Developer and the commercial lot development. The Board chartered a group of residents who gathered to propose some future major improvements for the community. As a result of their work and the money collected and saved over three years, we were able to build the new pool splash feature and replace the old bathroom and pump houses with the new beautiful and durable pool house you see today. The commercial area at the main entrance to Forest Creek had two remaining undeveloped commercial lots. Over the past four years there have been attempts to build things that would not have enhanced our community. One was to build a strip mall and convenience store/gas station on the corner lot. Another was to build a State run rehabilitation office building. Intimate knowledge of the rules and restrictions for the neighborhood and those lots resulted in bringing to light certain deed restrictions, and the need

The Caddie for the buyer to gain City and HOA approval for variances, which the HOA Board was not inclined to grant for facilities which aren’t good for our neighborhood. Now, the corner lot is being developed for another child development facility, which will directly serve and enhance our community. Transparency and constrained government (the HOA Board of Directors) have also been improved within our HOA. Board meeting minutes are kept and posted on the HOA web site. Monthly financial reports to the Board are reviewed and available to our members. A mandatory saving budget line-item for major capital improvements is now in the by-laws, along with the requirement to get approval from the HOA Members before committing significant amounts of those savings. The by-laws and structure of the Board and committees limits how much influence or “special interest” any single board member may have. The HOA is governed by an elected Board of Directors made up of volunteers from our property owners. It is the closest to home of any of the “representative governments” that impact our lives, liberty and fortunes, and the most easily influenced by its voting members. Four Years - (Continued from Page 3) voice be heard. Keep Forest Creek a great neighborhood and constantly getting better. Board and committee members are not paid for their efforts. They are subject to abusive comments and malicious rumors by some residents. They are only occasionally recognized for the positive things they do, none of which would happen without the dedication and work of your volunteer Board and committee members. While there certainly have been times when I questioned why I would volunteer to endure the abuse that some residents dumped on me, other residents have been kind enough to openly praise the positive changes in the community. I thank those who have provided encouragement, ask understanding from those who disagree, and encourage more involvement from those who haven’t noticed. A specialist who has worked with many HOAs for many years once said that the most critical time in the life of an HOA is the transition from developer control to homeowner control. I believe our HOA survived that transition and emerged a healthy, homeowner governed HOA that serves the best interest of our community. With this foundation in place, continued vigilance by our members, and dedicated service by our volunteer board and committee members, we will remain the Round Rock community where people want to live and homes are sought after. It has been my privilege to serve our community for the past four years as a member of the HOA Board of Directors and I extend my gratitude to all those who help make our community a great place to live and raise a family. FOREST AREA SWIM TEAM (FAST) 2010 SWIM TEAM REGISTRATION The Forest Area Swim Team (FAST) is gearing up for its seventh season. FAST is a nonprofit, recreational, competitive summer league swim team that focuses on swimmers who desire to improve swimming skills and stroke technique in order to successfully and confidently participate on a competitive swim team. We are extremely fortunate to have Pflugerville High Schools Head Swim Coach, Mark Stohrer, giving our swimmers expert instruction! Registration for returning members and their siblings will run from March 1st through March 14th. Registration for residents of Forest Creek, Forest Creek III or Lake Forest who are interested in joining FAST will be held from 1pm to 3pm on Sunday, March 28th at the Lake Forest clubhouse. The cost is $135 per swimmer. In addition, the FAST Frogs have a Tadpole program which targets beginning swimmers who have either taken beginner lessons or who are unable to swim the length of the pool but have no fear of water, have no separation anxiety and are interested in improving their swimming skills. The focus of the program is to work with the swimmers so they can comfortably and confidently swim the length

of the pool in freestyle and backstroke. This program is the building block of our competitive team. Upon graduation from the Tadpole program, swimmers are eligible to participate in swim meets as part of the competitive team. Our Tadpole program continues to be a raving success with nearly 80% of previous Tadpoles now participating on the competitive team. The cost is $150 per swimmer. Practices are held at the Lake Forest, Forest Creek and Forest Creek III neighborhood pools beginning the end of April and running through the end of June. Meets are hosted at various neighborhood pools in the north Austin area on Saturday mornings. The Championship Meet is held the last Saturday of the season at the University of Texas Swim Center. For those who missed the last article this is something we used to do with Boy Scout Troop 145 when we went camping with the boys. At the end of the weekend each boy would tell their peers and leaders what they like most/least from the weekend experience. PACE CAR PROGRAM On January 30, 2010 a 12 year old girl, Shayla Dame was hit and killed by a car on Gattis School Road. The driver of the car was going the speed limit. The child, a student at CD Fulkes Middle School, walked into the roadway near dusk and the driver could not stop. It was an accident. Could this happen in Forest Creek? Absolutely. It is up to all of us to do whatever we can to prevent such a tragedy from happening here! One way is to drill our children on street safety and another is to just slow down and be more aware! The BoD is looking for a volunteer to help reinstate the Pace Car Program in Forest Creek. The Pace Car Program was founded several years ago as part of the Neighborhood Watch Program. One volunteer could help make a difference in Forest Creek. Goals of the program are to raise traffic awareness, benchmark traffic/speeding issues in Forest Creek, determine if additional traffic control programs are warranted and help ensure a safer environment for our pedestrian and bicycle traffic. HOA SURVEY RESULTS Thanks to all Residents who returned the HOA Survey. The BoD is always interested in Resident Feedback. We received 52 surveys with 13 Residents requesting direct BoD feedback. Your comments are most helpful. I have emailed each resident to initiate discussion regarding their personal inquiries. If you submitted a Survey and requested feedback and have not been contacted please email Alan Aguais at [email protected]. The graphic below is a summary of the results. Our web site took the biggest hit and the BoD has begun to investigate options on how we can make improvements.

CC&R VIOLATIONS AND FINE PROCEDURES

Residents, as your Board and Centex Property Management continue to work toward amicable solutions to the Overnight Parking challenges our HOA faces I wanted to provide an excerpt from the current HOA Covenants, Conditions, and Restrictions (CCR’s). Paragraph 5.4 below was last updated on January 8, 2008. Under paragraph 5.4 of the Forest Creek First Amendment and Restatement of Master Declaration of covenants, Conditions and Restrictions (CC&Rs), the Board of Directors of the Forest Creek Homeowners’ Association has the authority to establish rules and regulations in connection with use, occupancy, and maintenance of properties within the Subdivision, to enforce deed restrictions, and to impose fines as a means of enforcing the provisions of the Rules or CC&Rs. The Board has adopted the following procedures for notification of violations and imposition of fines as one means of securing compliance with the governing documents. 1. The Association Management Company will identify noncompliance with the rules and regulations of the CC&Rs. 2. The first violation of the CC&Rs will result in a courtesy “reminder” letter sent to the owner of a property with no fine attached and a deadline for correcting the violation. This

letter will also include a copy of this Violations and Fine Procedures. If the same or similar violation occurs within six (6) months of the first violation it is considered a repeat violation. The Board may assess a separate fine against an owner for each repeat violation of the Declaration. Before the Board may levy a fine, it shall give to the owner written notice by certified mail that: (a) Describes the violation and states the amount of the proposed fine; and (b) States that not later than the 15th day after the day the notice was mailed, the owner may request a hearing before the Board to contest the fine. In order to be effective, an owner's request for hearing under paragraph 4(b) above must be in writing, directed to the property manager, and received by the manager by the 20th day after the date the notice of violation was sent to the owner. A certified mail letter that is returned to the Association due to the owner's failure or refusal to claim the letter shall be deemed received by the owner on the 10th day after the postmark date of the letter. Violations & Fines - (Continued from Page 8) be scheduled for the next regular Board Meeting. If the owner is unable to attend that Board meeting, the matter shall be scheduled for the succeeding Board Meeting. If an owner fails to attend two such meetings, the owner will not be entitled to any further hearings, unless the Board specifically waives this provision. 8. Unless otherwise authorized by the Board, the fine schedule shall be as follows:(a) The first notice of violation will be a courtesy reminder and carry no fine or fee.(b) For the second violation within six months, the first repeat violation: $25. (c) Each subsequent violation of the same or similar rule within six months of the most recent similar violation shall incur a fine of $50. (d) If a violation is of an ongoing nature (e.g. construction of improvements not authorized by the Architectural Control Committee), the Board may impose a fine that accrues daily for each day of the violation; the daily fine shall not exceed $50 per day. 9. The Board may enforce/collect fines through a lawsuit or any other applicable legal procedure.

IT IS ALL ABOUT RESPECT All of us when we wrote a contract to buy a house in Forest Creek received a copy of the rules for the neighborhood. By proceeding with the buying of our homes we made a commitment to follow the rules as laid down by our Homeowners association. There were no surprises. I personally read the entire document before buying. I assumed (apparently wrongly) that my neighbors would comply with their agreements. Our HOA management is pretty much constantly tied up with trying to get people to do what they committed to do. As some examples; take care of their yards, not have cars everywhere, no over night parking, and other things. No one was forced to buy in Forest Creek. The rules are not that hard to follow. I have heard of neighborhoods where committees nightly walk the streets handing out fines for some really silly things, like the wrong curtains. We have a great neighborhood. Isn't that why you bought here? So your neighbors do not follow the rules. So you figure you will not either. Is that what you teach your children? Do whatever everyone else does? It has got to stop. You agreed to keep certain standards. If it is too hard and confining I beg you sell your house and move. I have a right, as do each of us, to our property values not diminishing because you want 6 cars and do not want to do your weekly yard work. A Billion Grasshoppers

A high school physics teacher told the students that one grasshopper on the railroad tracks wouldn't slow a train very much, but a billion would. With that in mind, every time you shop, look for the words “MADE IN USA”. In our current economic situation, every little thing we do or purchase affects someone else -- even their job. Also, throw out the myth that you cannot find everyday products made by Americans. For example, my favorite toothpaste used to be Colgate. It is made in Mexico, now I have switched to Crest. I used to buy GE 60 watt bulbs. Guess what? They’re also made in Mexico.I am now buying the “Everyday Value” brand made in Cleveland, Ohio. They are identical bulbs, but the Everyday Value costs less. These are just a couple of items. The real challenge is to take the time to read the labels. So come on, let's get with the program ... help our fellow Americans keep their jobs and create more jobs here in the U.S.A. Remember - the job you save may be your own !
