Watering Restrictions

Currently, we officially in Stage Two restrictions as imposed by the San Antonio Water System (SAWS). If the level of the Edwards Aquifer drops below 640 feet, Stage Three restrictions will be imposed. Both are described below: STAGE TWO ALERT begins when the Aquifer level reaches 650 feet mean sea level at the monitored well. • All restrictions from Stage One remain in effect, unless added to or replaced by Stage Two rules. • Landscape watering with an irrigation system, sprinkler or soaker hose is allowed only once a week from 3-8 a.m. and 8-10 p.m. on your designated watering day, as determined by your address. • Watering with drip irrigation or 5-gallon bucket is permitted any day, but only between 3-8 a.m. and 8-10 p.m. • Watering with a hand-held hose is allowed any time on any day. FENCE ISSUES

Our Architectural Control Committee (ACC) has been doing a commendable job in reviewing and approving or requesting changes to homeowner modifications. We seem to be having problems with fences and need to establish some criteria for future fence submissions.  Residents need to remember that shared fences belong to both neighbors, regardless of who paid for the fence,and nothing can be done to that fence without the agreement of both neighbors.  If a neighbor takes it upon themself to remove, change, modify a shared fence without neighbor permission they can open themself to litigation for destruction of property, criminal trespass and I am sure other not so nice results.  The ACC will no longer approve shared fences unless there is neighbor agreement, even if one homeowner is paying for the whole fence.  In order to take down and/or erect a shared fence, it requires destruction of both neighbors’ property and will also require workers to be on both properties so the best approach is to establish a good relationship with your neighbor and build fences that both can agree to. FREQUENTLY ASKED QUESTIONS Q:  I do not have a neighbor at this time, can I put up a fence? A: Yes, upon approval of the ACC. You do not need to wait for a neighbor to move in. mountain lodge Fence Issues- (Continued from Cover Page) Q: I have a neighbor and no fence, can I put one up? A:  With approval of the ACC and agreement of the neighbor. Q: My neighbor will not share the cost of a new or replacement fence?  Since I will have to pay for the fence, can I put up any fence I want? A: No, since it will be a shared fence even if you pay for it you have to have agreement from your neighbor. Q: My fence is falling down and I cannot get agreement from my neighbor, what can I do? A: If mediation or attempted resolution is not possible the ACC, in some cases, may be able to approve the same fence as is currently installed, or may be able to approve a ‘good neighbor’ fence.  A good neighbor fence is one that alternates the front and back sides of the fence every other section so that each neighbor has both front and back sides. Q: The back of my property is up against a Green Belt.  Do I need agreement from any neighbors? A: No, only approval of the ACC. Q: I want to build fences higher than six feet, can I do that? A:  Fences can be as high as 8 feet, but shared fences must have agreement of the neighbor. They must be approved by the ACC. Q:  I want to build a fence in my front yard, am I able to do that? A: No, fences cannot be in front of the front side of the house. Q: I cannot get agreement with my neighbor, can I build a fence inside of the shared fence? A: With approval of the ACC, a homeowner may build a second fence as long as it is totally on the homeowner’s property and does not trespass on the neighbor’s property. Weed control of the ‘no man’s land’ is the responsibility of the resident that put up the individual fence. Message from Management

The HOA has seen an increase in the storing of trash and recycle containers on driveways, side yards and in front of garages over the last few months.Per the association’s governing documents trash and recycling containers must be shielded from view of the street and side yards on non-collection days.Trash and recycling containers need to be stored behind owner’s fences or in a garage. Storing containers on the side of your home is not shielding them from view of the street and side yard and does constitute a violation of the governing documents. During management’s property inspections, homes with trash/ recycling containers that are left on the street outside of collection days, or not stored out of view of the street/side yards, will be notified via a violation letter. Owners who repeatedly violate the governing documents are subject to fines imposed on their account with the Association. We ask that you please retrieve your containers in a timely manner from the curb and store all trash and recycle containers out of view to be compliant with the Associations documents. We know how difficult it is during the current drought conditions to keep lawns adequately watered and maintained. Management strives to be sensitive to the busy schedules of everyone that makes it difficult to regularly hand water during SAWS imposed restrictions for running sprinklers and irrigation systems. We would like to ask that residents please make every effort to keep lawns maintained while operating within the limitations of the SAWS imposed restrictions. It is a pleasure working with your community and we look forward to continued improvements as we strive to maintain and protect each owner’s property values in Mountain Lodge Homeowners Association.

As you probably know, Father’s Day was June 19. Ironically, that was also Juneteenth, which is celebrated as the day that word of slavery’s abolition was formally announced in the State of Texas. Perhaps it is ironic that the two holidays fell on the same day this year. Juneteenth is a celebration which often flies under the radar of many people. While it is not unique to Texas alone, the fact that its genesis occurred in the Lone Star State is important. Technically a southern state, and a former member of the Confederacy, Texas however, tends to define itself and a state unique in the nation with a strong sense of state pride and identity. Many people who move here are at first amused by the Texan mystique, but before long they tend to adopt at least some of the state’s pride. The news that slaves had been emancipated took the long route to Texas: two full years and a thousand miles across the Deep South. When word reached, Texas did not enter into a suddenly period of enlightenment, but rather embarked, as did the rest of the nation, on the path of reconciliation and repair. The struggle was mighty, and continues to this day. As the vestiges of years of social inequality stemming from a system that legally profited from racial segregation and discrimination are still felt in our society, one of the most powerful means to combating it is the role of adult role models for our children. Father’s Day is the recognition of the importance of the role that dads play in the lives of children. It is a celebration of playing catch, going on bike rides, playing house, going to girls scout functions, giving driving lessons, and catching the occasional spider. Dads’ perspectives are different from moms’ and that is a good thing. Our advice can be blunt, unapologetic, but is usually out of caring, compassion, and experience. I know a lot of families, and I have never met one, not one, that is perfect. Not even close. But in their imperfection, they strive to get things right, or at least close. The best part is that regardless of religion, nationality, race, language, or any other demographic or social classification, people tend to group together to make common cause. Dads have a role in that process that is unique to dad. Juneteenth spread from Texas to other reaches, and helped set the difficult, often brutal, course that is still leading to equality. The equality is societal in nature, and society is likewise built on the courage and guidance of all its members – including dear old dad. PS – thanks for the tie! Love you all! (Cellular on Patrol/Citizens on Patrol) The Safety Committee is looking for homeowners interested in becoming volunteers for the Mountain Lodge HOA COP Program. The COP program serves as the “eyes and ears” of the law enforcement community to make our neighborhood a safer place to live. Training is required, which consists of (2) four-hour sessions, conducted by the Bexar County Sheriff ’s Office. A criminal background history is also required, and a ride-along with a Bexar County Patrol Officer is recommended, but not required.
