1. PURPOSE AND DESCRIPTION OF SERVICE 1.1. Overview and Program Background 1.1.1. The Commission on Peace Officer Standards and Training (POST). The Commission on Peace Officer Standards and Training (POST) was established by the Legislature in 1959 to set minimum selection and training standards for California law enforcement. The POST organization, with more than 120 staff members, functions under the direction of an Executive Director appointed by the Commission. The POST Program is voluntary and incentive-based. Participating agencies agree to abide by the standards established by POST. More than 600 agencies participate in the POST Program and are eligible to receive the Commission's services and benefits. POST also awards professional certificates to recognize peace officer achievement and proficiency. POST and law enforcement agencies form a partnership when providing training. Local agencies are authorized to develop and deliver their own training. In some cases, POST develops courses and support materials to meet a specific training mandate or need. Participating agencies are encouraged, but not required, to use these materials. 1.1.2. POST Learning Technology Resources Bureau. The Learning Technology Resources Bureau is located within the Standards and Development Division of POST. The Learning Technology Resources Bureau administers distance training and education programs through the production of video (DVD) and self-paced modules delivered via a web-based POST Learning Portal. Distance delivery enables California peace officers, dispatchers, and other law enforcement personnel to access POST’s educational content on an as-needed basis at their local agency for in-service and specialized/advanced training. 1.1.3. Law Enforcement Video Training Programs at POST. Since its inception in 1989, the POST video-based training program has proven to be one of the most valuable, cost-effective services offered to California law enforcement agencies by POST. POST-certified video programs provide high-quality, in-service training to local law enforcement agencies in the California POST program. Each topic-specific video is carefully designed to assist law enforcement training managers and instructors in meeting timely training needs and legislative mandates for their agency. The video-based trainings are used by agencies in the California POST program to satisfy Continuing Professional Training (CPT) requirements at a fraction of the cost and staff time required for traditional classroom training. Video-based training programs produced by POST provide CPT credit annually for agencies in the POST program at no charge to agencies and with no travel/per diem costs to the Commission. The programs are facilitated at the local agency by presenters/supervisors qualified to teach the specific topics. POST law enforcement video-based trainings are divided into segments totaling up to two hours per program. Approximately 1,600 DVD copies of each new video-based training program are routinely mailed to agencies and basic academies in the California POST Program statewide. Law enforcement agencies may also order previous POST videos via POST’s online video catalog and DVD-by-mail distribution services. Law enforcement agencies not in the POST program or outside California may purchase these videos via the same service. To ensure that California law enforcement agencies in the POST Program continue to receive these valuable video-based trainings, POST is seeking a qualified proposer to manage all phases of development, production, distribution/fulfillment, and archival and storage of its videobased law enforcement training programs. 2 6/9/2015 1:33 PM

1.1.4. Quality Standards for the POST Video-Based Training Program. POST is a nationwide leader in distance learning programs and for more than two decades has consistently produced broadcast quality, award-winning in-service law enforcement video-based training programs. POST and its production team have received numerous awards from professional video competitions including the Regional Emmy Awards, Aurora Awards, Communicator Awards, Telly Awards, and Videographer Awards. POST’s professional video productions utilize the most contemporary techniques and approaches to training video development and instructional design, together with leading-edge subject matter expertise in the areas of law enforcement training, tactics, and procedures. From development to delivery, the POST video production team adheres to the highest production and law enforcement training standards. 1.1.5. The POST Video-Based Training Program Audience. POST’s video-based training programs are developed specifically for in-service and basic training of California law enforcement peace officers and public safety dispatchers. POST videos are carefully crafted to incorporate the particular interests, learning styles, and personality types of our law enforcement audience. In a Myers-Briggs Type Indicator (MBTI) personality profile specific to law enforcement, the majority of learners tended to cluster around two personality types: 85% ESTJ (Extraversion, Sensing, Thinking, Judgment) and 15% ISTJ (Introversion, Sensing, Thinking, Judgment). Typical demographics of POST’s training audience include:     

1.2. Program Scope 1.2.1. POST is seeking a two (2) year contract with a qualified proposer for High Definition (HD) broadcast-quality, digital video-based law enforcement training program design, development, production, media storage, and distribution/fulfillment services, which include, but are not limited to: a full range of pre-production editing and compression services, multi-camera location and studio video shooting, post-production editing services, DVD authoring and replication with copy protection, digital asset archival and management, distribution and fulfillment, and streaming media services. 1.2.2. The POST video-based law enforcement training program is comprised of five (5) distinct tasks per year: Task 1: Production and delivery of up to four (4) in-service, topic-specific law enforcement video-based trainings per year with companion reference guides (electronically-produced print documents, or PDFs) to aid instructors, facilitators, and trainees. These videos are presented in an easy-to-navigate, menu-driven format. Segments in the menu include an introduction, scenarios, questions for discussion, model facilitation of the scenarios, and interviews of subject matter experts to substantiate the learning objectives. The program includes PDF files containing separate support material for instructors and students. The programs are presented in a two-track design that accommodates either facilitated group training by an instructor or individual viewing by a trainee; the selection of either track by the viewer determines the order of play of the segments. The programs address contemporary law enforcement issues and are designed to meet POST’s continuing professional training requirements. 3 6/9/2015 1:33 PM

The video programs are long-form, news documentary style with length up to 120 minutes per program, delivered in quantity of 2,000 DVD hybrid (enhanced DVD) discs and digital format for streaming media services. A hardcopy DVD sample of a current POST in-service, topic-specific law enforcement training video and companion reference guide document(s) are available to Proposers for review/reference upon request. A memo providing an overview of the design and functionality of these in-service training videos is provided in POST Bulletin 2012-09 (See Additional Attachments, page 48). Task 2: Production and delivery of up to three (3) in-service, Homeland Security/Terrorism Prevention-specific law enforcement video-based trainings per year. Similar to Task 1 above, these videos will be designed in a format that allows the courses to be sectioned into expanded presentations or viewed in their entirety to meet Homeland Security law enforcement training requirements. Videos are long-form, news documentary style specific to Homeland Security topic with length up to 120 minutes per program, delivered in quantity of 2,000 DVDs and digital format for streaming media services. This task would occur in year two only (2016-2017), and completion of this task is contingent upon U.S. Department of Homeland Security grant award funding and upon POST Commission approval. A hardcopy DVD sample of a current POST inservice, Homeland Security/Terrorism Prevention law enforcement training video is available to Proposers for review/reference upon request. Task 3: Production and delivery of up to three (3) officer safety/information service announcement videos per year. Short-form, public service announcementstyle videos featuring a timely topic with length up to 120 seconds per program. Delivered in digital format for streaming media services. Online streaming video samples of these programs are available to Proposers for review/reference at http://post.ca.gov/safe-driving-videos.aspx . Task 4: Production and delivery of one (1) law enforcement video-based vignette/scenario training per year in support of a specialized POST project or Bureau program. This video will be designed in a format that features multiple vignettes, scenarios, reenactments, or full-length video segments to meet specialized POST program training requirements. The program addresses timely law enforcement issues targeting the needs of specialized groups such as law enforcement supervisors, Regular Basic Course trainees, or public safety dispatchers. Video scenario(s) are longform, dramatic or news-documentary style with length up to 60 minutes for the finished program, delivered in digital format for streaming media services. Task 5: DVD inventory storage, distribution, and fulfillment services. DVD storage, inventory management, and distribution/fulfillment services. Includes secure DVD video program inventory storage; DVD distribution support; DVD video fulfillment service for all existing and newly produced POST video programs as applicable. At any time after the commencement of the contract, the DVD inventory storage, distribution and fulfillment services may be canceled and transferred to the California Office of State Publishing for completion. Task 6: Master media storage, POST Training Video Catalog management, DVD replication, and streaming media services. Master/archive and source media inventory management and secure storage, management of online POST Training Video Catalog, DVD replication of previously-produced titles, and streaming media services. Video Catalog support, hosting, and maintenance; and, video digitization, encoding, and hosting (streaming media services) for up to twenty-four (24) two-hour video programs. 1.3. Program Requirements 1.3.1. Deliverables. Proposer responsibilities will include supplying professional video production personnel and facilities for coordinating and managing control of all video production elements resulting in the production and delivery/distribution of completed law enforcement video-based training and informational programs. 1.3.1.1. For the long- and short-form videos described in Tasks 1, 2, and 3 and 4 of Section 1.2.2., the video program development process is comprised of four major parts, or deliverables, further described as: 1) Pre-Production, 2) Production, 3) PostProduction, and 4) Digital Media Production. Pre-Production Subject Matter Expert (SME) outreach and coordination. Under POST’s direction, Proposer contacts potential SMEs, inviting participation in the development of the video-based trainings. SME attendance is confirmed, and logistics associated with SME participation throughout the development process are closely coordinated with POST (POST coordinates and attends the development meetings and pays for meeting facility and SME travel costs). Pre-Production meeting. Proposer will attend the SME meetings that are directed by approved Proposer staff. At the meetings, POST, Proposer and the SMEs will review existing documentation, identify learning objectives, and develop situational awareness-based scenarios that are reflected in a project outline. POST and Proposer work with SMEs to develop a master outline that will be used by Proposer to direct and produce all technical aspects of the video production. POST and SMEs provide Proposer with the content outline. Proposer will convert the outline into a video production script format, which becomes the first deliverable for the video program. Pre-production development meetings last up to three (3) eight-hour days. Production Production meeting and field production video shoot for scenarios. Proposer establishes the production plan, hires production crew and cast (role players), conducts location scouting, budgeting, and scheduling for all video shoots. POST and selected SMEs attend this second meeting and participate in the scenario shoot, overseeing the shoot for continuity and content accuracy. Proposer completes the field shoot at the end of this second meeting, which becomes the second deliverable for the program. Field production video shoots of scenarios last up to three (3) ten-hour days and one (1) five-hour day. Production meeting and field production shoot for facilitation session and interviews. POST and SMEs meet with Proposer to review the scenarios from the first field production video shoot and then plan the facilitation session (roll call) shoot and on-camera interviews. As with preceding scenario shoots, Proposer arranges for all field production requirements, including role players and SMEs. Selected SMEs are also interviewed on-camera for inclusion in the video program. Production meeting and shoots last up to three (3) eight-hour days and one (1) five-hour day. 5 6/9/2015 1:33 PM

Post-Production Post-production offline editing. Video from the field production video shoot is screened and a rough-cut is assembled. The offline video is prepared for on-line editing. Post-production online editing. Video graphics, animations, music and soundtrack are added. The draft video is encoded, and uploaded to a secure, web-based discussion board provided by Proposer, where POST and SMEs review the rough-cut online edit and provide input regarding suggested changes. A final edit is made, followed by the final video master of the program, which becomes the third deliverable for the program. Digital Media Production (Applicable to Task 1 only of Section 1.2.2.) DVD authoring and development. A DVD map is created that shows how the program will be organized and how the DVD will function. The DVD map is used as a guide to author the final DVD program. Video assets are digitized, menu graphics are designed, and the DVD program is authored. A DVD “check disc” is produced that demonstrates the full interactivity and functionality of the final DVD master. Digital archiving and DVD replication. Upon approval of the DVD check disc by POST, Proposer creates a digital archive of the DVD master (for future repurposing, streaming media, and use in other POST video programs) and replicates 2,000 copies of the video-based training DVD. The replication becomes the fourth and final deliverable for the program. 1.3.1.2. For the DVD inventory storage, distribution, and fulfillment services described in Task 5 of Section 1.2.2., the process is comprised of two parts, or deliverables, further described as: 1) DVD inventory management, and 2) DVD distribution/fulfillment services. DVD Inventory Management Secure storage and inventory management of approximately 35,000 distribution copy DVDs in bulk spindles; secure and climate-controlled storage for all DVD media. DVD Distribution/Fulfillment Services DVD video distribution and fulfillment services for all existing and newly-produced POST video programs. Includes: Pre-sort bulk permit USPS mailing of up to 1,600 DVD copies of newly-produced programs, up to four (4) new programs per year; First-class USPS single or bulk mailing of previously-produced DVD programs (as ordered from video catalog), up to 50 catalog orders per month. 1.3.1.3. For the Master media storage, POST Training Videos Catalog management, DVD replication, and streaming media services described in Task 6 of Section 1.2.2., the process is comprised of four parts, or deliverables, further described as: 1) Master/source videotape and media storage and management, 2) online POST Training Video Catalog management, 3) DVD replication and packaging, and 4) Streaming media services. 6 6/9/2015 1:33 PM

Master/Source Videotape and Media Storage and Management Archival and storage of, and barcode tracking/inventory control for, approximately 8,000 master and camera original/source tapes and other hardcopy master video media, to remain in the facility, for use in production/post-production. POST Training Video Catalog Management Management, hosting, and technical support for the online POST Training Video Catalog of approximately 120 video titles. POST’s custom-designed existing catalog website utilizes “Bizar Shop 1.6.1” e-commerce catalog software and allows user registration and ordering of POST videos; the catalog generates email orders that are reviewed/approved by POST and forwarded to DVD fulfillment services for processing. Vendor may utilize alternative e-commerce catalog software/platform with equivalent features to manage POST’s catalog. DVD Replication and Packaging DVD replication and DVD packaging to include bulk replication from DLT master of previously-produced DVD programs in inventory (listed in POST Training Video Catalog); this replenishment of out-of-stock DVDs requires a minimum of 500 standard definition 4-color silkscreened DVD copies per program, up to 6 programs per year. DVD packaging is white, clear poly window non-gummed flap paper CD/DVD envelope. Streaming Media Services Streaming media services to include video digitization, encoding, and hosting for up to twenty-four (24), two-hour training video programs; Host storage requires a minimum of 50 GB space for the video program files, with an average bandwidth of one (1) TB transfer per month.

1.3.2. Facility and Equipment Specifications. Digital video production services include, but are not limited to, the following key facility and equipment specifications: 1.3.2.1. Facility Specifications. To ensure optimal video quality throughout the production process, uncompressed digital video pathways and pre-processing filters must be used in the facility. POST will not accept offers from Proposers using analog or composite digital video signal paths at any phase in production. Because all projects will require delivery via DVD and/or online video streaming, Proposers will be required to employ an internal network system capable of transporting all video signals and AES/EBU for audio by means of uncompressed component serial digital (SD-SDI, HDSDI). A design layout and documentation of the facility’s digital signal infrastructure is required. 1.3.2.2. Videotape Format and Recording/Playback Equipment. POST shoots/acquires all original camera video in HD format; therefore, field and studio video cameras shall include SONY XDCAM and/or SONY HDCAM series or equivalent HD professional series. Proposers must maintain on site and in good operating condition SONY high-definition (HD) video HVR series videotape decks or equivalent, and SONY Series 500 (e.g., DVW-A500) Digital Betacam video decks or equivalent that provides playback of both analog and digital Betacam tapes from archive and/or outside sources. 7 6/9/2015 1:33 PM

Additionally, Proposers must own and maintain in good operating condition on site the following additional videotape formats: D1, BetacamSP, DV CAM, and VHS. 1.3.2.3. Video Encoding, Compression, Preview, and Storage. Working in the uncompressed digital domain ensures the final product has the best possible image quality from acquisition to final delivery. 1.3.2.3.1. Video footage will be acquired in High Definition and Standard Definition formats in multiple frame rates (24P, 29.97, 30P & 60i) and aspect ratios (4:3 and 16:9). Field video acquisition formats may include, but are not limited to, XDCAM HD, XDCAM EX, HDV and DVCAM. 1.3.2.3.2. Proposer must own and maintain in good operating order at least one MPEG 2 encoder and one MPEG 4 encoder system that produce high quality image files that are compatible across the range of operating systems, desktop, and portable/mobile browsers. All compressed video must be colorcorrected and processed with temporal and spatial filters to improve encoding quality and efficiency. A high-bandwidth, fiber optic or equivalent storage area network (SAN) of a minimum capacity of 10TB will be required to support the concurrent digitizing and editing of footage and assets for the POST video projects. 1.3.2.3.3. In-progress review (draft) copies of each video shall be hosted on a secure, password-protected website featuring a discussion board format that allows for viewing and comments to be posted by authorized users and subject matter experts. 1.3.2.3.4. Final delivery of each finished video is to be on professionally authored and replicated Standard Definition DVDs and H.264 encoded files at multiple bit rates for digital archive and/or streaming web delivery. 1.3.2.3.5. All acquisition assets must be archived using an LTO-5 or higher version tape backup system. 1.3.2.3.6. All media processing and storage facilities must be secured from the greater facility. Access must be secured/locked and restricted to key staff. 1.3.2.4. Audio Production. Proposer will be required to maintain an audio recording bay that follows Sony design specifications and offers triple floating walls or equivalent noise reduction/noise insulation, complete AC-3 surround sound mixing, and AES-EBU audio signal processing. Proposer must be able to sync to videotape formats listed above. Because of POST’s level of audio needs, the Proposer will be required to run ProTools 9 or higher, or equivalent. Additionally, the ProTools software or equivalent must be referenced to house sync to maintain sample accuracy. Proposers must possess 10+ years of experience with audio compression technologies and own the necessary hardware/software equipment to perform various audio compression technologies for CD-ROM, DVD, and internet delivery. Proposer shall have a professional sound effects and stock music library for use in audio sweetening for video. 1.3.2.5. Non-Linear Editing (NLE) Systems. Proposer must use component, serial digital video for the transport of all video signals and AES/EBU for audio. These professional, high industry standards ensure that no noise or artifacts are introduced that results in a final product-- a DVD, CD-ROM or Internet video-- with the best possible image and audio quality. uncompressed, serial digital capture and export such as the Avid Media Composer 7.0 or higher, or equivalent. 1.3.2.6. Animation Services. High quality animation services are a requirement for this program. Proposer shall incorporate comprehensive animation production capabilities from pre-to post-production. Two-dimension graphic design is required, with proven experience in concept, design, placement, and color assessment. Proposers shall operate with and be well-versed in AfterEffects (Creative Suite 6 or higher) or equivalent. Proposers shall have at least one senior art director with commercial art and design experience and computer animation experience for integration into video and digital media. 1.3.2.7. Media Storage and Asset Security. POST’s vast collection of video materials span more than 20 years and thousands of hours of quality, original law enforcement video programming, representing a significant financial investment by the State. Additionally, POST law enforcement video-based trainings are restricted to law enforcement use only and may contain sensitive information and images not intended for public viewing. Proposer must provide interior climate-controlled, secure on-site storage for all of POST’s valuable, information-sensitive media and must adhere to strict guidelines (e.g., ANSI, SMPTE, or MPAA videotape media storage guidelines) for media storage. Additionally, copy protection must be used with DVDs and streaming video programs to prevent illegal copying or downloading. Proposer must employ the Content Scramble System (CSS) digital rights management system on all DVDs authored and replicated for POST. 1.3.2.8. Media Playback Compatibility. California law enforcement agencies operate under a variety of technical environments and parameters. POST has no control or authority over the video playback systems used by these agencies or their networks. However, video program materials produced for POST must provide a trouble-free experience for our audience and run as intended on the chosen media (standard definition DVD or web-based streaming video). 1.3.3. Standards and Requirements 1.3.3.1. Video Produced for Online Delivery. Video produced for online delivery, as deemed necessary and described in section 1.2.2. above, will be encoded as H.264 MPEG-4 for users with a minimum 300Kbps connection. Hosting minimum of 50 GB space for up to 24 (twenty-four) two-hour video programs, with an average bandwidth of one (1) TB transfer per month. 1.3.3.2. Third Party Software. Proposer will ensure compliance with any requirements of third party software to display the logo or give other credit for any tools used in development of the product (e.g., the “DVD” logo). POST expects clear identification of any product requirements and documentation that details adherence. 1.3.3.3. Ownership of Material. All video, data, technical information, materials gathered, oriented, developed, prepared, used or obtained in the performance of the contract, including, but not limited to, all reports, surveys, plans, charts, literature, brochures, mailings, recordings (video and/or audio), pictures, drawings, analyses, graphic representations, software computer programs and accompanying documentation and print-outs, notes and memoranda, written procedures and documents, regardless of the state of completion, which are prepared for or are a result of the services required under the resulting contract shall be and remain the property of POST and shall be delivered to POST upon thirty (30) days notice by POST. 9 6/9/2015 1:33 PM

1.3.3.4. Warranty. The final version of each video program must be bug-free and warranted for one (1) year from delivery. A bug is defined as an error that is repeatable on the target system (e.g., DVD). The warranty is a promise by Proposer to fix, free of charge, all bugs that are discovered within one-year of final delivery of a video program. POST expects Proposer to fix bugs in an expedient manner (less than five (5) business days). 1.3.3.5. Experience and Expertise. POST expects Proposer to staff this program with experienced, professional personnel who are skilled in video project coordination and management, field- and studio-based video production, post-production, and distribution/fulfillment services. The proposal must list any partners or subcontractors the Proposer intends to use, including but not limited to, independent writers/producers, production technicians, graphics/animators, outside replication, packaging, fulfillment/catalog, and/or distribution and streaming media hosting resources. 1.3.3.6. Conflicts of Interest, Security and Confidentiality. POST video-based law enforcement training programs are restricted for use by government law enforcement agencies and intended for viewing only by authorized law enforcement personnel/peace officers. POST program materials are confidential and sensitive in nature. Proposer must provide secure facilities and adhere to safeguarded procedures for all POST program materials; Proposer must fulfill POST security and confidentiality requirements as set forth in the Conflict of Interest / Security and Confidentiality Statement (sample attached). 1.3.3.7. Insurance. 1.3.3.7.1. General Requirements - Insurance companies must be acceptable to the Department of General Services. If self-insured, review of financial information may be required. 

Coverage Term - Coverage needs to be in force for the complete term of the contract. If insurance expires during the term of the contract, a new certificate must be received by the State at least ten (10) days prior to the expiration of this insurance. This new insurance must still meet the terms of the original contract.



Cancellation- Contractor must provide written notice to the State immediately if Contractor receives notice by their insurer that the insurance policy has been cancelled.



Deductibles - Contractor is responsible for any deductible or self-insured retention contained within the insurance program.



Contract Termination - In the event the Contractor fails to keep in effect at all times the specified insurance coverage, the State may, in addition to any other remedies it may have, terminate the contract upon the occurrence of such event, subject to the provisions of the contract.



Primary Insurance- Any insurance required to be carried shall be primary, and not excess, to any other insurance carried by the State.

The policy shall include coverage for liabilities arising out of premises, operations, independent contractors, products, completed operations, personal and advertising injury, and liability assumed under an insured contract. This insurance shall apply separately to each insured against whom claim is made or suit is brought subject to the contractor's limit of liability. The policy must include the State of California, its officers, agents, employees and servants as additional insured, but only insofar as the operations under the contract are concerned. 

Automobile Liability - Contractor shall maintain motor vehicle liability with limits of not less than $2,000,000.00 per accident. Such insurance shall cover liability arising out of a motor vehicle including owned, hired, and non-owned motor vehicles.



Workers' Compensation/Employer's Liability - Contractor shall maintain statutory workers' compensation and employer's liability coverage for all its employees who will be engaged in the performance of the contract, including special coverage extensions where applicable. Employer's liability limits of $1,000,000 shall be required.



Professional Liability - Contractor shall maintain Professional Liability covering any damages caused by an error, omission or any negligent acts. Limits of not less than $1,000,000.00 shall be provided. Proposer must provide proof of insurance requirements prior to the effective start date of contract.

2. MINIMUM QUALIFICATIONS FOR PROPOSERS NOTE: Only proposals meeting all Minimum Qualifications described below will be evaluated. 2.1. Proposers must operate video production and distribution facilities and utilize staff and resources within the State of California. Due to the nature of POST’s video program development process, the major involvement of California-based law enforcement agency personnel and local agency resources, and the integral role that POST personnel and Californiabased subject matter experts serve throughout program development and production, proposers must conduct all work phases and services within the State of California. Further, Proposer’s facilities must be convenient to California metropolitan regions and conducive to minimizing travel costs (i.e., are located near major metropolitan airports and offer nearby lodging and ground transportation costs consistent with California State Government travel per diem rates). 2.2. Proposers must furnish evidence of experience in the last five (5) years with videobased public safety (law enforcement or emergency services) training program design, production, and distribution. Evidence of experience shall be in the form of: two (2) DVD examples, one long-form (defined as a minimum length of 30 minutes) and one short-form (defined as a minimum length of 30 seconds) and one (1) online streaming long-form video example (defined as a minimum length of 30 minutes) of comparable projects (online video example must be different from DVD examples provided; include a URL/website address for online video example). One (1) example of a companion training program reference guide or other print- or web-based resource to aid instructors of the video program must also be provided. If Proposer has worked with POST in the past, at least one of the two video examples shall be for non-POST projects. Section 3.2.6. provides additional details for required work examples. 2.3. Proposers must furnish evidence of professional qualifications of the key video production and distribution personnel whom Proposer will commit to this program. Proposer shall include résumés for all key personnel that show: names, position titles, job descriptions/roles, education, professional training, employment experience, and years of professional experience for each person. Section 3.2.5. provides additional details for required personnel qualification information. 2.4. Proposers must furnish three (3) references of former or current clients (other than POST) for whom Proposer has worked in the last five (5) years producing video-based training programs. POST will contact these references to validate Proposer’s experience in designing, producing, and distributing video-based training programs. Such references must include the company/agency name, name of contact person, address, phone number, e-mail address (if available), website address (if available), and a brief description of those video-based training project(s) that have been completed. 2.5. Proposers must provide evidence that master media storage is co-located and managed within the Proposer’s production facility and immediately accessible to the production team. Proposer must provide evidence of dedicated, climate-controlled, secure storage facilities (media vault or similar) for all of POST’s valuable, information-sensitive media assets including digital media, videotapes, other recordings and program media as described in section 1.3.2.7. above. 3.2. Proposal Requirements 3.2.1. Description of Facilities, Technical Capabilities, and Standards. Describe how your facility is equipped to meet POST’s requirements and technical standards as described in Sections 1.2. and 1.3. Within your description, include the following information: 3.2.1.1. Provide a facility layout/diagram that shows the key areas (rooms) that your facility offers, indicating functions, descriptions, and sizes for each room listed. 3.2.1.2. Allow sufficient time for POST to review each deliverable, taking into account any subsequent revision efforts. 3.2.3.1. If Proposer has worked with POST in the past, at least one of the video examples must be for non-POST projects. Comparable work examples submitted by Proposer must meet the format, minimum lengths, and content criteria listed above, must be similar in scope and/or budget, and must be consistent with POST’s high technical standards for quality video production. Available for comparison are the following samples of POST work: “Human Trafficking: Identify and Respond” long-form video and companion reference guide sample, program I.D. #258 / 2014 (DVD-ROM hardcopy available upon request); “SAFE Driving Videos” short-form video samples (available at http://www.post.ca.gov/safe-driving-videos.aspx ); and “Preventing Law Enforcement Officer Suicide” long-form streaming video sample (available at http://www.post.ca.gov/post-training-videos.aspx). 3.2.6.2. For each public safety training video example, provide: 1) the topic/title, 2) describe the training goals or objectives, 3) describe the intended audience, 4) provide the date the project was completed, and 5) provide the length of the program. 3.2.6.3. For one of the long-form, news documentary style public safety training video examples, provide a summary of the project that describes the project scope and timeline, from concept to completion (if the proposer has worked with POST in the past, this summary must be for a non-POST project).

3.3. Cost Detail Format and Requirements. The cost of proposed work shall be broken down into the eight distinct program tasks listed according to the scope of work (section 1.2.2.) and deliverables (section 1.3.1.) for the resulting contract. 3.3.1. Provide the associated price for each deliverable shown in the scope of work section 1.2.2. and deliverables section 1.3.1. 3.3.2. All administrative and production costs, including proposer’s/subcontractor’s personnel travel, indirect costs and overhead must be included in the quote. 3.3.3. Cost proposals exceeding $2,300,000.00 for all six program tasks for two years will not be considered. 3.3.4. Proposers must use the Cost Proposal Worksheets (section 5.3.) in preparing the cost proposal. Proposers may recreate (i.e., cut and paste) or reprint the worksheets as necessary to fit within their actual proposal document; all cost proposal details and line items shown on the Cost Proposal Worksheets provided in section 5.3 must be included in the response. 3.4. Submission of Proposal 3.4.1. Proposals shall provide straightforward and concise descriptions of Proposer’s ability to satisfy the requirements of this RFP and resulting contract. The proposal must be complete and accurate. Omissions, inaccuracies or misstatements may be cause for rejection of a proposal. 3.4.2. The proposal package shall be prepared in the least expensive method. Expensive bindings, color displays, and similar presentation approaches are not necessary. 3.4.3. Proposals shall be single-spaced with a minimum 11-point font size and no longer than one hundred twenty-five (125) total pages, with a table of contents and corresponding page numbers. Proposal responses shall cite the corresponding RFP sections or may follow a similar section outline as presented in this RFP document. 3.4.4. All proposals must be submitted under sealed cover and received at the Commission on POST headquarters at 860 Stillwater Road, Ste. 100, West Sacramento, CA 95650 by the dates and times shown in Section 3, Proposal Requirements and Information, Item 3.1 Key Action Dates. Proposals received after this date and time will not be considered. 3.4.5. A minimum of one (1) original and five (5) copies of the proposal must be submitted. 3.4.6. The original proposal must be marked “ORIGINAL COPY”. All documents contained in the original proposal package must have original signatures and must be signed by a person who is authorized to bind the proposing firm. The five additional proposal sets may contain photocopies of the original package. 3.4.7. The proposal envelope must be plainly marked with the RFP number and title, your firm’s name and address and must be marked with “DO NOT OPEN”. 3.4.12. Proposals must be submitted for the performance of all the services described herein. Any deviation from the work specifications will not be considered and will cause a proposal to be rejected. 3.4.13. A proposal may be rejected if it is conditional or incomplete, or if it contains any alterations of form or other irregularities of any kind. The State may reject any or all proposals and may waive an immaterial deviation in a proposal. The State’s waiver of an immaterial deviation shall in no way modify the RFP document or excuse the proposer from full compliance with all requirements if awarded the agreement. 3.4.14. Costs incurred for developing proposal and in anticipation of award of the agreement are entirely the responsibility of the proposer and shall not be charged to the State of California. 3.4.15. An individual who is authorized to bind the proposing firm contractually shall sign the Proposal/Proposer Certification Sheet, (section 5.2.). The signature must indicate the title or position that the individual holds in the firm. An unsigned proposal may be rejected. 3.4.16. Proposer may modify a proposal after its submission by withdrawing its original proposal and resubmitting a new proposal prior to the proposal submission deadline as set forth in Section 3.1 Key Action Dates. Proposal modifications offered in any other manner, oral or written, will not be considered. 3.4.17. Proposer may withdraw a proposal by submitting a written withdrawal request to the State, signed by the proposer or an authorized agent in accordance with 3.4.15 above. Proposer may thereafter submit a new proposal prior to the proposal submission deadline. Proposals may not be withdrawn without cause subsequent to proposal submission deadline. 3.4.18. The Commission on POST may modify the RFP prior to the date fixed for submission of proposals by the issuance of an addendum to all parties who received a proposal package. 3.4.19. All required facilities and equipment must be established and in place prior to posting of the Notice of Intent to Award as shown in 3.1 Key Action Dates. The Commission on POST reserves the right to conduct an in-person, on-site visit and inspection of a Proposer’s facilities to verify that Proposer’s facilities and equipment meet all RFP requirements and to ensure full compliance with 3.4.1. above. 3.4.20. The Commission on POST reserves the right to reject all proposals. The agency is not required to award an agreement. 3.4.21. 3.4.22. Where applicable, Proposer should carefully examine work sites and specifications. No additions or increases to the agreement amount will be made due to a lack of careful examination of work sites and specifications. 3.4.23. More than one proposal from an individual, firm, partnership, corporation or association under the same or different names, will not be considered. 3.4.24. The State does not accept alternate contract language from a prospective proposer. A proposal with such language will be considered a counter-proposal and will be rejected. The State’s General Terms and Conditions (GTC) are not negotiable. 3.4.25. No oral understanding or agreement shall be binding on either party. 3.4.26. Proposals shall be valid for 90 calendar days after final proposal submission. 3.4.27. The program scope of work for the resulting agreement may be later amended with mutual consent of both parties at the same costs/rates where adjustments in video production is required (such as substitution or addition of video programs due to unforeseen legal training mandates, emergency training needs, and changes in grant awards). 3.4.28. Pursuant to Assembly Bill (AB) 926, Chapter 490, Statutes of 2009, It is unlawful for any person engaged in business within this State to sell or use any article or product as a “loss leader” as defined in the Business and Professions Code § 17030. 3.5. Evaluation Process 3.5.1. At the time of proposal opening, each proposal will be checked for the presence or absence of required information in conformance with the submission requirements of this RFP. 3.5.2. Proposals that contain false or misleading statements, or which provide references that do not support an attribute or condition claimed by Proposer, shall be rejected. 3.5.3. Award, if made, will be to the highest scored responsible proposal. In the event of a tie, the award will be made to the highest score with the lowest monetary offer. 3.5.4. Proposal Evaluation 3.5.4.1. Each eligible Proposal will be evaluated by an Evaluation Committee comprised of three (3) or more POST staff members. Proposals will be evaluated for form and content in accordance with this RFP. 3.5.4.2. Proposals that do not meet all Minimum Qualifications listed in Section 2 will be considered non-responsive and will not be evaluated. (A responsive proposal is one that meets or exceeds the requirements stated in this RFP.) 3.5.4.3. Proposals that meet the Minimum Qualifications listed in Section 2 will be evaluated and scored according to the criteria indicated in 3.5.5. A total of One Hundred (100) maximum points are available for Technical Merit and Cost Proposal; however, a minimum combined score of Eighty (80) points for Technical Merit and Cost Proposal must be achieved to be considered responsive. The award of the contract, if an award is made, will be to the Proposer whose proposal receives the highest total score for Technical Merit, Cost Proposal, and if applicable, any SB Preference or DVBE Incentives.

3.5.5.5. Cost Proposal (Up to 30 Points)

The cost of proposed work shall be broken down into the eight distinct program tasks listed according to the scope of work for this proposal. Using the Cost Proposal Worksheets from section 5.3. provide the associated price for each deliverable shown in 1.2.2. All administrative and production costs, including proposer’s/subcontractor’s personnel travel, indirect costs and overhead must be included in the quote. 3.6. Award and Protest 3.6.1. Notice of the proposed award shall be posted in a public place in the office of the Commission on POST, 860 Stillwater Road, Suite 100, West Sacramento, CA 95605 for five (5) working days prior to awarding the agreement. 3.6.2. If any proposer, prior to the award of agreement, files a protest with the Commission on POST and the Department of General Services, Office of Legal Services, 707 Third Street, 7th Floor, Suite 7-330, West Sacramento, CA 95605, pursuant to Public Contract Code Section 10345, the agreement shall not be awarded until either the protest has been withdrawn or the Department of General Services had decided the matter. It is suggested that you submit any protest by certified or registered mail. 3.6.3. Within five (5) days after filing the initial protest, the protesting proposer shall file with the Department of General Services, Office of Legal Services and the Commission on POST a detailed statement specifying the grounds for the protest. 3.6.4. Upon resolution of the protest and award of the agreement, Proposer must complete and submit to the awarding agency the Payee Data Record (STD 204), to determine if the Proposer is subject to state income tax withholding pursuant to California Revenue and Taxation Code Sections 18662 and 26131. This form can be found on the Internet at www.osp.dgs.ca.gov under the heading FORMS MANAGEMENT CENTER. No payment shall be made unless a completed STD 204 has been returned to the awarding agency. 3.6.5. Upon resolution of the protest and award of the agreement, Proposer must sign and submit to the awarding agency all pages of the Contractor Certification Clauses (CCC), which can be found on the Internet at www.dgs.ca.gov/contracts. 3.7. Disposition of Proposals 3.7.1. Pursuant to Public Contract Code Section 10344 (c) (2) “. . . All proposals and all evaluation and scoring sheets shall be available for public inspection at the conclusion of the committee scoring process.” Therefore, all documents submitted in response to this RFP will become the property of the State of California, and will be regarded as public records under the California Public Records Act (Government Code Section 6250 et seq.) upon conclusion of the proposal evaluations. 3.7.2. Proposal packages may be returned only at the proposer’s expense, unless such expense is waived by the awarding agency. 3.8. Agreement Execution and Performance 3.8.1. Prior to signing of resulting agreement, POST reserves the right to conduct an in-person site inspection of Proposer’s facilities. 3.8.2. Performance shall start not later than 30 days, or on the express date set by the awarding agency and the Proposer, after all approvals have been obtained and the agreement is fully executed. 3.8.3. Should the Proposer fail to commence work at the agreed upon time, the awarding agency, upon five (5) days written notice to the Proposer, reserves the right to terminate the agreement. 4. PREFERENCE AND PARTICIPATION PROGRAM INFORMATION 4.1. Narrative It is the Proposer’s responsibility to provide all necessary documentation in support of any preference requested. Darfur Contracting Act Certification

Effective January 1, 2009, all Invitations for Bids (IFB) or Requests for Proposals (RFP) for goods or services must address the requirements of the Darfur Contracting Act of 2008 (ACT). Due to the nature of POST’s video program development process, the major involvement of California-based law enforcement agency personnel and local agency resources, and the integral role that POST personnel and California-based subject matter experts serve throughout program development and production, proposers must conduct all work phases and services within the State of California. Proposers must furnish evidence of experience in the last five (5) years with video-based public safety (law enforcement or emergency services) training program design, production, and distribution. Evidence of experience shall be in the form of: two (2) DVD examples, one long-form (defined as a minimum length of 30 minutes) and one short-form (defined as a minimum length of 2 minutes) and one (1) online streaming long-form video example (defined as a minimum length of 30 minutes) of comparable projects (online video example must be different from DVD examples provided; include a URL/website address for online video example). One (1) example of a companion training program reference guide or other print- or web-based resource to aid instructors of the video program must also be provided. If Proposer has worked with POST in the past, at least one of the two video examples shall be for non-POST projects. Section 3.2.6. provides additional details for required work examples. 2.3. Proposers must furnish evidence of professional qualifications of the key video production and distribution personnel whom Proposer will commit to this program. Proposer shall include résumés for all key personnel that show: names, position titles, job descriptions/roles, education, professional training, employment experience, and years of professional experience for each person. Section 3.2.5. provides additional details for required personnel qualification information. 2.4. Proposers must furnish three (3) references of former or current clients (other than POST) for whom Proposer has worked in the last five (5) years producing video-based training programs.
