T H E H O M E S E C R E T A R Y s a i d that t h e O p p o s i t i o n would be p r o v i d i n g m o s t o f the t i m e f o r t h e debate o n I m m i g r a t i o n o n M o n d a y , 10 M a r c h w h i c h w o u l d l a s t f r o m 7 p m to 11. 30 p m . T h e y could therefore d e t e r m i n e t h e f o r m o f the d e b a t e . T H E H O M E S E C R E T A R Y s a i d that the r e m a i n i n g stages o f the C h i l d M a i n t e n a n c e O r d e r s (Annual U p r a t i n g a n d E x e m p t i o n ) B i l l , s p o n s o r e d b y M r R o b e r t T a y l o r , would take p l a c e o n F r i d a y 14 M a r c h . T h e B i l l was not a c c e p t a b l e to the G o v e r n m e n t and, f o l l o w i n g d i s c u s s i o n at L e g i s l a t i o n C o m m i t t e e the p r e v i o u s day, he and the C h a n c e l l o r o f the D u c h y of L a n c a s t e r h a d both s e e n M r T a y l o r i n the hope that h e m i g h t a g r e e t o w i t h d r a w the B i l l . It s e e m e d u n l i k e l y that he would do s o . It would t h e r e f o r e be n e c e s s a r y to t r y to t a l k out the r e p o r t stage o f the B i l l , even though o v e r t a t t e m p t s b y the G o v e r n m e n t to p r o l o n g p r o c e e d i n g s o n the B i l l would be s e e n b y s u p p o r t e r s o f the A b o r t i o n ( A m e n d m e n t ) B i l l , which was the next B i l l down f o r debate, a s a n attempt to b l o c k p r o g r e s s o n that B i l l . H e was a r r a n g i n g f o r a m e n d m e n t s to be p r e p a r e d w h i c h G o v e r n m e n t s u p p o r t e r s m i g h t table f o r the R e p o r t Stage o f the B i l l . In d i s c u s s i o n i t was p o i n t e d out that M r T a y l o r b e l i e v e d that he had m a d e a m e n d m e n t s to the B i l l w h i c h m e t the objections p r e v i o u s l y seen b y the G o v e r n m e n t . T h e p r i n c i p l e of the a u t o m a t i c u p r a t i n g of m a i n t e n a n c e p a y m e n t s had support a m o n g G o v e r n m e n t b a c k b e n c h e r s . O n th 3 o t h e r h a n d , i t was s t r o n g l y a r g u e d that the p r o v i s i o n s o f the B i l l w e r e u n a c c e p t a b l e because they would c r e a t e g r e a t e r i n j u s t i c e i n the o p e r a t i o n o f the d i v o r c e l a w s . A u t o m a t i c uprating of m a i n t e n a n c e would w o r s e n the p o s i t i o n o f the h u s b a n d and s e c o n d wife a s a g a i n s t that o f f o r m e r w i v e s , a n d a d d to the c r i t i c i s m a l r e a d y m a d e o f the p r e s e n t l a w . T h e B i l l would a l s o c a l l f o r i n c r e a s e s i n staff and a d d to t l e work o f the c o u r t s . In d i s c u s s i o n o f the P a r l i a m e n t a r y h a n d l i n g of the debate, i t was pointed out that i t m i g h t be d i f f i c u l t to f i n d G o v e r n m e n t s u p p o r t e r s w i l l i n g to p r o l o n g debate o n M r T a y l o r ' s B i l l i n v i e w o f the l a r g e n u m b e r s o f M P s i n t e r e s t e d i n the p r o g r e s s of the A b o r t i o n (Amendment) B i l l . O n the o t h e r h a n d , the opponents o f the A b o r t i o n ( A m e n d m e n t ) B i l l m i g h t seek to p r o l o n g the debate. It was i n any event u n l i k e l y that the R e p o r t Stage of the A b o r t i o n (Amendment) B i l l c o u l d be c o m p l e t e d i n anything l e s s than a f a l l day. T H E P R I M E M I N I S T E R , s u m m i n g up the d i s c u s s i o n , s a i d that the Cabinet a g r e e d that the C h i l d M a i n t e n a n c e O r d e r s (Annual U p r a t i n g and E x e m p t i o n ) B i l l s h o u l d not be a l l o w e d to m a k e p r o g r e s s i f i t c o u l d be p r e v e n t e d . No f u r t h e r p r e s s u r e s h o u l d be put o n M r T a y l o r to withdraw the B i l l , but the a r g u m e n t s o f p r i n c i p l e against i t s p r o v i s i o n s s h o u l d be d e p l o y e d i n the debate. E v e r y effort should be m a d e b y way o f the t a b l i n g and d i s c u s s i o n o f a m e n d m e n t s to e n s u r e that the R e p o r t Stage o f the B i l l was t a l k e d out. If n e c e s s a r y , h o w e v e r , t h e C h i e f W h i p should seek to e n s u r e that i t was defeated at T h i r d R e a d i n g .

T h e Cabinet 2. Invited the C h i e f Whip, i n consultation with the H o m e S e c r e t a r y , to a r r a n g e that the C h i l d Maintenance O r d e r s (Annual Up r a t i n g and Exemption) B i l l should be p r e v e n t e d f r o m m a k i n g further p r o g r e s s .

T H E S E C R E T A R Y O F S T A T E F O R E M P L O Y M E N T s a i d that a g r e e m e n t had been r e a c h e d through the u s u a l channels f o r the C o m m i t t e e Stage of the E m p l o y m e n t B i l l to be completed before E a s t e r and f o r the G o v e r n m e n t ' s new c l a u s e s on i m m u n i t i e s to be d i s c u s s e d d u r i n g an extended R e p o r t Stage. It would be helpful i f the p u b l i c a t i o n of the S o c i a l S e c u r i t y (No 2) B i l l could be d e f e r r e d until after the C o m m i t t e e Stage of the E m p l o y m e n t B i l l had been completed; o t h e r w i s e the t i m e t a b l e a g r e e d with the O p p o s i t i o n might be put at r i s k . Subject to that point, he hoped that the a r r a n g e m e n t s would enable the B i l l to be sent to the House of L o r d s i n t i m e f o r i t to complete i t s p a s s a g e t h e r e and r e c e i v e R o y a l A s s e n t by the beginning of J u l y . T H E S E C R E T A R Y O F S T A T E F O R E D U C A T I O N A N D S C I E N C E said that he had been a d v i s e d that the G o v e r n m e n t w e r e l i k e l y to l o s e the c l a u s e i n the E d u c a t i o n (No 2) B i l l which would enable l o c a l education a u t h o r i t i e s to m a k e charges for school t r a n s p o r t . It was opposed by C a t h o l i c P e e r s o f a l l P a r t i e s , by L a b o u r , L i b e r a l and c r o s s - b e n c h P e e r s , and even by some G o v e r n m e n t s u p p o r t e r s . If the c l a u s e w e r e l o s t i n the H o u s e o f L o r d s i t would be v e r y difficult to r e s t o r e i t i n the H o u s e of C o m m o n s ; and, even i f that attempt were s u c c e s s f u l , the H o u s e of L o r d s might well throw out the clause again, thus j e o p a r d i s i n g the p r o s p e c t s of the B i l l b e c o m i n g l a w before E a s t e r . T h e G o v e r n m e n t had estimated that the i n t r o d u c t i o n of school t r a n s p o r t c h a r g e s might save £20 m i l l i o n i n 1980-81, a n d i n c r e a s e d sums i n future y e a r s . T h e savings to be m a d e by those l o c a l authorities who had d e c i d e d to charge were, i n fact, l i k e l y to r e a c h £20 m i l l i o n i n the c o m i n g y e a r . T h e best chance of getting the school t r a n s p o r t c l a u s e through the House of L o r d s would be to make a further amendment l i m i t i n g i t s o p e r a t i o n to two c h i l d r e n i n a family. T h e r e c o u l d be no guarantee that this would s e c u r e i t s 3

passage, but some G o v e r n m e n t s u p p o r t e r s and c r o s s - b e n c h e r s would accept the clause o n that b a s i s . Such a n amendment would be popular i n the House o f C o m m o n s where s i m i l a r amendments had been tabled at R e p o r t Stage, but not been r e a c h e d u n d e r the timetable M o t i o n . H e sought the a g r e e m e n t o f the Cabinet to putting down the amendment he h a d d e s c r i b e d . T H E P R I M E M I N I S T E R , s u m m i n g up a b r i e f d i s c u s s i o n , s a i d that the C a b i n e t a g r e e d that i n the c i r c u m s t a n c e s the S e c r e t a r y of State should seek to a m e n d the s c h o o l t r a n s p o r t c l a u s e , l i m i t i n g the c h a r g i n g p o w e r s of l o c a l education authorities to two c h i l d r e n i n a family. T h e Cabinet 4. Invited the S e c r e t a r y of State f o r E d u c a t i o n and S c i e n c e to a r r a n g e f o r the n e c e s s a r y amendment to be tabled to the E d u c a t i o n (No Z) B i l l before d i s c u s s i o n of the s c h o o l t r a n s p o r t c l a u s e i n C o m m i t t e e of the H o u s e of L o r d s .

T H E C H A N C E L L O R O F T H E D U C H Y O F L A N C A S T E R s a i d that on 4 M a r c h the H o u s e of C o m m o n s had debated the M o t i o n s he h a d tabled following the C a b i n e t ' s d e c i s i o n s on the r e c o m m e n d a t i o n s of the T o p S a l a r i e s R e v i e w Body ( T S R B ) on P a r l i a m e n t a r y P a y and Allowances. T h e r e had been f r e e votes on the M o t i o n s , and the outcome had not been altogether s a t i s f a c t o r y . A n amendment supporting some f o r m of linkage o f the pay of M e m b e r s of P a r l i a m e n t ( M P s ) with that o f outside groups had not been p r e s s e d , and a n amendment that would have i n c r e a s e d the allowance f o r s e c r e t a r i a l and r e s e a r c h a s s i s t a n c e to"£11, 000, r a t h e r than £6,750 as p r o p o s e d , had been defeated. T h e H o u s e had, however, p a s s e d three amendments against his a d v i c e : f i r s t , there had been a l a r g e m a j o r i t y i n favour of an additional allowance of £675 to M P s for payment into an approved p e n s i o n s c h e m e for t h e i r s e c r e t a r i e s ; second, the H o u s e had voted to double the s e v e r a n c e payments p r o p o s e d by the T S R B f o r M e m b e r s who l o s t t h e i r seats at a G e n e r a l E l e c t i o n after s e r v i n g for ten y e a r s o r m o r e and who were aged 50 or o v e r ; t h i r d , the House had voted to i m p l e m e n t the T S R B r e c o m m e n d a t i o n that t r a v e l allowances should be available for t r a v e l o n P a r l i a m e n t a r y b u s i n e s s i n any p a r t of the United K i n g d o m . T h e i n c r e a s e s p r o p o s e d i n the amended Motions would not take effect unless the G o v e r n m e n t i n d i c a t e d t h e i r support for t h e m . H e had indicated d u r i n g the debate that the G o v e r n m e n t would accept the d e c i s i o n s of the House i n p r i n c i p l e , while r e s e r v i n g t h e i r p o s i t i o n on

t i m i n g a n d o n the d e t a i l o f the p r o p o s a l s . H e thought a r r a n g e m e n t s c o u l d be m a d e to m e e t s o m e of the m i s g i v i n g s that h a d b e e n e x p r e s s e d about the l a c k o f a c c o u n t a b i l i t y f o r the a l l o w a n c e s , a n d he h a d i t i n m i n d , i f the C a b i n e t a g r e e d , to w o r k out d e t a i l e d p r o p o s a l s i n c o n s u l t a t i o n with the H o u s e a u t h o r i t i e s and to b r i n g t h e m to the C a b i n e t b e f o r e E a s t e r . In d i s c u s s i o n o f the p r o p o s e d a l l o w a n c e f o r p e n s i o n s f o r s e c r e t a r i e s , i t was s a i d that t h e A c c o u n t a n t o f the H o u s e would be able to e n s u r e that the a d d i t i o n a l a l l o w a n c e of £675 was p a i d d i r e c t to a n a p p r o v e d p e n s i o n fund. It would be n e c e s s a r y to e n s u r e that o n l y one p e n s i o n a l l o w a n c e was p a i d f o r e a c h s e c r e t a r y even though s o m e s e c r e t a r i e s w o r k e d f o r two o r t h r e e M P s . T h e severance pay p r o p o s e d b y the T S R B m i g h t m o r e p r o p e r l y be c a l l e d a r e d u n d a n c y p a y m e n t , s i n c e i t w a s not p a i d to M P s who r e s i g n e d o r d i d not stand f o r r e - e l e c t i o n , but o n l y t o t h o s e who w e r e defeated a t a n e l e c t i o n . T h e i n c r e a s e d a m o u n t s , although b e t t e r than the State s c h e m e , w e r e not e s p e c i a l l y g e n e r o u s when j u d g e d b y the r e d u n d a n c y p a y a v a i l a b l e u n d e r s o m e p r i v a t e o r p u b l i c s c h e m e s ; the c o s t to p u b l i c funds would not a r i s e f o r four y e a r s and would be s m a l l . T h e position of t h j s e M P s whose seats d i s a p p e a r e d b e c a u s e o f a r e d i s t r i b u t i o n of c o n s t i t u e n c i e s o r whose c o n s t i t u e n c i e s w e r e affected b y b o u n d a r y changes n e e d e d c l a r i f i c a t i o n . C o n c e r n was e x p r e s s e d about the l a c k of accountability for c l a i m s f o r t r a v e l allowances. It would be n e c e s s a r y to c o n s i d e r a r r a n g e m e n t s w h e r e b y M e m b e r s gave a d v a n c e n o t i c e to the A c c o u n t a n t o f j o u r n e y s o n P a r l i a m e n t a r y b u s i n e s s o u t s i d e t h e i r c o n s t i t u e n c i e s f o r w h i c h they intended to c l a i m the a l l o w a n c e , a s w e l l a s h a v i n g t o give s t r i c t a c c o u n t o f t h e i r j o u r n e y s after the event. T H E P R I M E M I N I S T E R , s u m m i n g up the d i s c u s s i o n , s a i d that the C a b i n e t a c c e p t e d that i t would be i n a d v i s a b l e to seek to go a g a i n s t the d e c i s i o n s t a k e n by a f r e e vote o f the H o u s e . In w o r k i n g out detailed p r o p o s a l s the C h a n c e l l o r of the Duchy of L a n c a s t e r should take a c c o u n t o f the p o i n t s m a d e i n d i s c u s s i o n , p a r t i c u l a r l y a s r e g a r d s the p o s i t i o n of s e c r e t a r i e s w o r k i n g f o r m o r e than one M P and the n e e d to p r e v e n t a b u s e o f the i n c r e a s e d scope f o r c l a i m i n g travel allowances. H e s h o u l d b r i n g h i s p r o p o s a l s t o the C a b i n e t i n due c o u r s e . The Cabinet 5. Invited the C h a n c e l l o r o f the D u c h y of L a n c a s t e r to b r i n g f o r w a r d d e t a i l e d p r o p o s a l s f o r i m p l e m e n t i n g the M o t i o n s , t a k i n g account o f the p o i n t s m a d e i n d i s c u s s i o n a n d of the o u t c o m e o f the d i s c u s s i o n s w h i c h h e p r o p o s e d to have with the H o u s e a u t h o r i t i e s .

2. T H E L O R D P R I V Y S E A L s a i d that the R h o d e s i a n e l e c t i o n s h a d p a s s e d off q u i e t l y . T h e r e s u l t was u n e x p e c t e d , but M r M u g a b e ' s r e a c t i o n to h i s v i c t o r y s e e m e d so f a r to have b e e n r e s p o n s i b l e a n d mod-rate. H e would be f o r m i n g a c o a l i t i o n g o v e r n m e n t with M r N k o m o , and m i g h t i n c l u d e M r D a v i d S m i t h o r another white representative. G e n e r a l W a l l s would b e s t a y i n g o n to o v e r s e e the i n t e g r a t i o n o f the t h r e e a r m i e s . T h e G o v e r n o r would be m a k i n g r e c o m m e n d a t i o n s about the t i m i n g o f i n d e p e n d e n c e and of h i s o w n departure. T h e two w o u l d be s i m u l t a n e o u s , a n d s h o u l d not be l o n g delayed. B u t t h e r e was a c a s e f o r a v o i d i n g p r e c i p i t a t e a c t i o n , w h i c h w o u l d not be w e l c o m e to M r M u g a b e and would d a m a g e the m o r a l e o f the white c o m m u n i t y . T h e r e s h o u l d now be n o p r o b l e m over international recognition. T h e r e a c t i o n s o f the l e a d e r s o f the F r o n t L i n e States h a d v a r i e d c o n s i d e r a b l y . President Machel of M o z a m b i q u e h a d behaved h e l p f u l l y a n d w o u l d be c o n g r a t u l a t i n g the P r i m e M i n i s t e r on her Government's achievement. T h e President of B o t s w a n a , S i r S e r e t s e K h a m a , h a d a l s o o f f e r e d h i s c o n g r a t u l a t i o n s . P r e s i d e n t K a u n d 1 o f Z a m b i a and P r e s i d e n t N y e r e r e o f T a n z a n i a h a d p r e f e r r e d to give c r e d i t f o r the o u t c o m e to, r e s p e c t i v e l y , t h e R u s s i a n s and the C h i n e s e . T h e r e a c t i o n o f the South A f r i c a n s h a d so f a r b e e n r e s t r a i n e d . B u t i t s e e m e d l i k e l y that t h e p r o b l e m o f N a m i b i a would now b e c o m e m o r e d i f f i c u l t to r e s o l v e . T h e Cabinet 1.

T H E SECRETARY O FSTATE FOR NORTHERN IRELAND s a i d that the C o n f e r e n c e o n the future* g o v e r n m e n t o f N o r t h e r n I r e l a n d was now a d d r e s s i n g the c e n t r a l i s s u e s of how a d e v o l v e d e x e c u t i v e would a c t u a l l y f u n c t i o n and what was to be the r o l e o f the m i n o r i t y c o m m u n i t y a n d i t s e l e c t e d r e p r e s e n t a t i v e s . In a g e n e r a l d i s c u s s i o n of the e c o n o m i c situation and p r o s p e c t the a t m o s p h e r e h a d been r e a l i s t i c and c o n s t r u c t i v e , without any attempt to p r o v o k e confrontation.
