WARRANTY AND CONSENT OF PARENT / GUARDIAN ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY / INDEMNITY AGREEMENT IN CONSIDERATION of the Fernie Alpine Ski Team (“FAST”) permitting my minor child / ward (“Child”) to participate as an athlete in FAST programs and related events and activities (the “Program”) and enrollment of my Child in Alpine Canada: I WARRANT THAT: 1.

I am a parent / guardian having full legal responsibility for decisions regarding my Child:

I am familiar with the risk of serious injury and death which any participant in the Program may suffer AND am familiar with all aspects of the Program;

3.

I believe that my Child is physically, emotionally and mentally able to participate in the Program and that their equipment not supplied by the Program is mechanically fit for their use in the Program and will continuously throughout my Child’s participation in the Program ensure that their equipment not supplied by the Program remains mechanically fit and properly adjusted for my Child’s use;

4.

I understand and will instruct my Child, that all applicable rules for participation must be followed and that at all times the sole responsibility for personal safety remains with my Child, and

5.

I will immediately remove my Child from participation and notify the nearest official or coach, if at any time I sense or observe any unusual hazard or condition or if I feel that my Child has experienced any deterioration in their physical, emotional or mental fitness for continued participation in the Program.

I UNDERSTAND AND AGREE, ON BEHALF OF MY CHILD, MYSELF, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN, THAT MY EXECUTION OF THIS DOCUMENT CONSTITUTES: 1.

An unqualified ASSUMPTION OF ALL RISKS associated with participation in the Program by my Child even if arising from negligence, or gross negligence, including any compounding or aggravation of injuries caused by negligent rescue operations or procedures, of FAST and any persons associated therewith or participating therein, and

2.

A FULL AND FINAL RELEASE AND WAIVER OF LIABILITY of FAST and all persons and organizations associated with it and the Program including, without limiting the generality of the foregoing, its: officers, directors, officials, contractors, agents and/or employees, other participants, sponsors, advertisers. owners and/or Lessor of the premises used to conduct the Program, sanctioning bodies, medical or rescue personnel (the RELEASEES) of and from any and all injury, disability, death or loss or damage to person or property whether arising from the negligence, or negligent rescue of or by the foregoing or otherwise, and

3.

An UNDERSTANDING AND AGREEMENT NOT TO SUE the RELEASEES for any loss, injury, costs or damages of any form or type, howsoever caused or arising, and whether directly or indirectly from the participation of my Child in the Program, and

4.

An AGREEMENT TO INDEMNIFY and to SAVE and HOLD HARMLESS the RELEASEES, and each of them, from any litigation expense, legal fees, liability, damages, award or costs, or loss of any type or nature whatsoever, that they may incur as a result of any claim made against them or anyone of them whether the claim is based on the negligence or the gross negligence of the RELEASEES or otherwise arising from or relating to my Child’s participation in the Program.

I ACKNOLWEDGE AND AGREE THAT THIS WARRANTY AND CONSENT OF PARENT/GUARDIAN SHALL CONTINUE IN EFFECT FOR EACH YEAR THAT MY CHILD PARTICIPATES IN THE PROGRAM AND THE INDEMNITY CONTAINED HEREIN SHALL SURVIVE INDEFINITELY. I FUTHER ACKNOLWEDGE AND AGREE THAT IF AT ANY TIME I HAVE INFORMATION OR REASON TO BELIEVE THAT THE WARRANTIES AS SET OUT HEREIN ARE INCORRECT OR INACCURATE, THAT I WILL IMEDIATELY NOTIFY FAST IN WRITING. I HAVE READ THIS DOCUMENT THOROUGHLY. I UNDERSTAND THAT THE RELEASEES ARE RELYING UPON MY WARRANTIES, ASSUMPTIONS, WAIVER AND RELEASE, UNDERTAKINGS AND AGREEMENTS WHEN ACCEPTING MY CHILD’S PARTICIPATION IN THE PROGRAM. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT I GIVE UP SUBSTANTIAL LEGAL RIGHTS I AND/OR MY CHILD WOULD OTHERWISE HAVE. This agreement shall be governed by and interpreted in accordance with the laws of the province of British Columbia and any litigation involving the parties to this agreement shall be brought within the province of British Columbia.

__________________________ PARENT / GUARDIAN INITIALS BY SIGNING ABOVE, THE PARENT / GUARDIAN AND THE ATHLETE (age 14+) ACKNOLWEDGE AND AGREE THAT THEY HAVE CAREFULLY READ, AND AGREE TO ABIDE BY, THE ATHLETE AND PARENT RESPONSIBILITIES, CODES OF CONDUCT, AND ATHLETE DROP OFF POLICY. The Parent / Guardian further acknowledge and agree that in recognition of registration fees paid to FAST, the athlete’s family becomes an immediate member of BC Alpine Ski Association, as well as the governing body of FAST (the “FAST Society”.

RESPONSIBILITIES OF PARTNERS The Partners to this agreement are the athletes, parents, coaches and the Board of Directors of the Fernie Alpine Ski Team (“FAST”). It is important that all partners apply a coordinated, “team” effort to best achieve the stated objective. All partners must agree and commit to doing their part. It is only in this way that the best chances for athlete success will be realized. By signing this document, all parties agree that they have read the Partner Agreement and agree to conduct themselves according to the guidelines in this document.

1.

ATHLETE RESPONSIBILITIES

The athlete, by signing this agreement, has agreed to:  Participate in as much of the offered training and racing program as designed by the coaching staff as possible with reference to the individual athletes personal goals (dry land training, on snow training, competition, equipment, diet, rest etc.), giving maximum effort during all sessions.  Arrive at training on time, physically & mentally prepared.  Communicate with the coaches on all aspects of their training.  Respect the coach’s directions and decisions.  Behave in a fashion that brings credit to themselves, their team and FAST.  Support team and FAST sponsors, when possible.  Show respect for athletes, coaches, officials, volunteers and mountain staff at all times. FAIR PLAY CODE FOR ATHLETES • • • • • • • • • • •

I will participate because I want to, not just because my parents or coaches want me to. I will play by the rules, and in the spirit of the sport (this includes the rules and policies of the ski club and the governing bodies of the sport). I agree that good sportsmanship is when teammates, opponents, coaches, and officials treat each other with respect, and will avoid outbursts that include foul language, disrespectful behavior, and violence. I agree that discrimination and harassment of other athletes or participants in the sport is unacceptable. Bullying has no place within FAST. I will remember that coaches and officials are there to help me. I will listen to and obey the coach regarding matters of proper behavior and training, and I will accept their decisions and show them respect. I will remember that winning isn’t everything – that having fun, improving my skills, making friends and doing my best are as important. I will acknowledge all good performance – by my teammates and by my opponents. I will avoid swearing and abusive language and disruptive behavior, including behavior that is dangerous to self or others, including acts of violence, physical, or sexual abuse or harassment. I will abstain from all illegal activity. I will not carry any items that can be dangerous to myself or to others. I understand this code of conduct and what is expected of me as a FAST athlete.

2.

PARENT RESPONSIBILITIES

The parent, by signing this agreement, has agreed to:  Be aware of their child’s interests as they enter, participate and exit from the program.  Monitor their own expectations of their child’s performance and progress, realizing that athletes, who feel that they cannot meet their parents’ expectations, quickly lose motivation.  Communicate and meet with coaches / FAST Board members as needed on aspects of the training program.  Support fundraising activities.  Support team and program sponsors, when possible.  Volunteer at races, and fundraising events both in Fernie and in other locations. FAST has volunteer opportunities on and off the snow.  Support getting athletes to training on time, physically and mentally ready, and prepared for the session with good nutrition, hydration, clothing and appropriately tuned equipment.  Warranty and consent including assumption of risk, release, and waiver of liability.  The athlete drop off policy (outlined below). FAIR PLAY CODE FOR PARENTS • • • • • • • • • •

I will not force my child to participate in FAST. I will remember that my child skis for his/her enjoyment, not for mine. I will adhere to and require my child to adhere to the rules, and to the spirit of FAST as defined by the Club and the governing bodies for ski racing. I will teach my child that doing one’s best is as important as winning, by offering praise for competing fairly and trying hard so that my child will not feel defeated by the outcome of an event. I will not ridicule or yell at my child for making a mistake or losing a competition. I will remember that children learn best by example and will be a positive role model. I will applaud the good performances of my child, our team, and opponents. I will never question an official’s judgment or honesty in public, I will respect race procedures outlined by my child’s coach. I will support all efforts to remove harassment and abuse from children’s sporting activities and agree that such behavior is not allowed. Bullying has no place within FAST. I will respect and show appreciation to the coaches and volunteers who give their time to provide a ski racing training to my child.

ATHLETE DROP OFF POLICY The FAST Club policy for release of athletes at lunchtime and/or after the training day is done is as follows: U8 (Fast Tracks / Nancy Greene): All U8 athletes are to be dropped off at the Racer’s Hut in the morning and picked up at the Racer’s Hut at 3:00 pm. If the U8 athlete is late, it is the parent’s responsibility to find the coach. Note that it is U8 policy never to have athletes ride the chairlift without an adult. U10/U12: All U10/U12 athletes are to be dropped off and picked up at the top of the Elk Chair, or at another location as communicated by the coach to all parents. If a parent wishes to have the athlete released on their own recognizance on the hill at lunchtime or after training ends, they must initial as such under the Acknowledgement of Warranty and Consent section of this document. U14/U16/FIS: All U14 /U16/FIS Athletes will be released on their own recognizance at lunchtime and at the end of training wherever they happen to be on the hill.

3.

COACHES RESPONSIBILITIES

The coach has committed to:  Teach the athletes, in a logical sequence, using all the available tools in the quest to achieve training and competition success.  Commit 100% to the designed training plan.  Communicate with athletes on any and all aspects of their training (listening – explaining – deciding – acting).  Communicate and schedule meetings with parents on appropriate aspects of the FAST training programs.  Behave according to the NCCP & CSCF Alpine Coaching Code of Ethics and be a member in good standing.  Represent the athlete’s best interests at all times.  Support FAST sponsors, when possible.  Constantly look for ways to upgrade coaching skills and knowledge.  Keep current on all safety regulations that pertain to ski coaches, including WCB regulations which mandate helmet use at all times. FAIR PLAY FOR COACHES • • • • • • • • • • • • •

I will teach my athletes to compete fairly. I will adhere to the rules of the sport as defined by the Club and the governing bodies for the sport, and teach my athletes to adhere to these rules. I will teach my athletes to respect officials and opponents. I will ensure that all athletes have the opportunity for equal instruction and support. I will treat my athletes with respect and will encourage them to always do their best. I will remember that children play to have fun and must be encouraged to have confidence in themselves. I agree that I will not verbally, physically or mentally harass or abuse athletes, coaches, parents, or volunteers participating in the sport. I will make sure that training, training equipment, and training venues are safe and match the athlete’s age and abilities. I will remember that children need a coach they can respect. I will be generous with praise, constructive comments and set a good example. I will obtain proper training and continue to upgrade my coaching skills. I will respect, consider and be open to athlete communication. I work collaboratively with the athletes, parents, program director, therapists and the Board of Directors for the benefit of the athlete and the FAST team.

4.

BOARD OF DIRECTORS RESPONSIBILITIES

The Board of Directors have committed to:  To use their positional power for the betterment of the club as a whole. It will be considered a breach of trust if they attempt to use their position for personal gain or personal convenience especially in relationship to gaining an advantage to a related athlete or themselves.  Ensure that the program is well defined and well understood by all parties involved and is available in a written outline form.  Provide written and signed employment agreements with all coaching staff to include an employment agreement, job description and code of conduct.  To communicate with athletes, parents, coaches, sponsors and other interested parties through a regular newsletter and regularly updated website.  Host an Annual General Meeting (“AGM”) for parents, coaches, sponsors and other interested parties to promote an understanding of the program philosophy, financial review, fundraising efforts, and strategic initiatives.  Conduct the affairs of the program in an ethical and financially responsible way.  Organize fundraising events that will help reduce the cost to participating families.  Support team and program sponsors, when possible.  Report regularly on all aspects of the Program to club and Zone Boards as required.  Represent the Program interests within and outside of the Kootenay Zone.  Attend all Board meetings scheduled; attendance of less than a majority of the number of meetings during a season may result in requested resignation.
